KIDZTALENTS PARTICIPATION AGREEMENT PLEASE READ CAREFULLY. BY CLICKING "AGREE," YOU CONFIRM THAT YOU HAVE READ, UNDERSTOOD, AND ACCEPT THE TERMS BELOW.

For and in consideration of the Participant’s permission to take part in activities organized by Kidztalents (“Kidztalents”), including but not limited to sports, arts, and recreational programs (collectively referred to as "Activities"), I, on behalf of myself, the Participant, and our legal representatives, heirs, and assigns (collectively, "I") agree to the following:

RELEASE OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNIFICATION AGREEMENT

  1. Assumption of Risk
  2. I acknowledge and understand that the Activities involve physical movement, creative expression, and interaction with others. I confirm that the Participant is in good health and fit to participate. If at any time I believe conditions to be unsafe, the Participant will stop participating immediately.
  3. Acceptance of Risks and Responsibilities
  4. I recognize that participating in the Activities involves risks, including but not limited to physical injury, emotional distress, permanent disability, illness, and death ("Risks"). These Risks may result from my actions, the actions of others, or the negligence of the Released Parties (defined in Section 4). I accept full responsibility for any losses, costs, or damages resulting from participation.
  5. COVID-19 Acknowledgment
  6. I understand the contagious nature of COVID-19 and voluntarily assume all risks related to potential exposure or infection, including personal injury, illness, or death. I acknowledge that this release includes claims related to the actions or negligence of Kidztalents and its representatives.
  7. Release of Liability
  8. I release, discharge, and agree not to sue Kidztalents, its staff, volunteers, sponsors, and affiliates ("Released Parties") from any claims, demands, or damages arising from the Participant’s involvement, including those caused by the negligence of the Released Parties.
  9. Indemnification
  10. I agree to indemnify and hold harmless the Released Parties from any legal fees, losses, or damages resulting from claims made by or on behalf of myself or the Participant.
  11. Legal Costs and Jurisdiction
  12. If legal action is necessary to enforce this Agreement, the prevailing party shall be entitled to recover reasonable legal fees and costs. This Agreement is governed by the laws of the state in which Kidztalents operates and is enforceable in the appropriate jurisdiction.


PHOTO AND VIDEO RELEASE POLICY

By participating in Kidztalents Activities, I, as the Participant or legal guardian, grant Kidztalents the right to:

  1. Capture and Use Media
  2. I consent to Kidztalents capturing photographs, videos, sound recordings, and/or verbal statements ("Likeness") of me or the Participant during Activities or events.
  3. Approved Uses
  4. I permit Kidztalents to use the Participant’s Likeness for promotional purposes, including but not limited to:
  • Kidztalents’ website
  • Social media (Facebook, Instagram, YouTube, etc.)
  • Printed materials (brochures, flyers, newsletters)
  • Advertising and broadcasting media
  1. Privacy Protection
  2. Kidztalents will not disclose full names or personal information without prior written consent.
  3. Opt-Out Option
  4. If I do not wish for the Participant’s Likeness to be used, I will:
  • Notify the event photographer or organizer at the time of the event.
  • Contact Kidztalents in writing and provide a photo for identification purposes.
  1. Release and Indemnification
  2. By not opting out in writing, I release, defend, and hold harmless Kidztalents from any claims regarding the use of the Participant’s Likeness.
  3. Restrictions on Use by Third Parties
  4. No person or organization unaffiliated with Kidztalents may use, copy, alter, or modify Kidztalents’ media without written permission from an authorized Kidztalents representative.


ACKNOWLEDGMENT AND SIGNATURE

By signing below, I confirm that:

  • I have read and understand this Agreement and the Photo and Video Release Policy.
  • I am waiving substantial legal rights.
  • If signing for a minor, I certify that I am the parent or legal guardian and that the Participant is in proper condition to participate.
