Watercraft Rental Agreement, Terms, and Liability Waiver

This Agreement is entered into between Dakota Thrill Rentals LLC ("Company") and the undersigned renter ("Renter"). By signing this document, the Renter agrees to all rental terms, safety rules, liability waivers, and legal conditions described below.

Rental Terms and Conditions

Renter agrees to return the equipment in the same condition received except for normal wear and tear.

Renter accepts full responsibility for the watercraft, trailer, and equipment during the rental period.

Late returns will be charged $2 per minute past the scheduled return time.

A minimum damage fee of $500 may apply plus the cost of repairs for any damage to the equipment.

Operators must be at least 18 years old and possess a valid driver's license.

Maximum capacity is three riders or 485 pounds total weight.

No racing, stunts, wave jumping, towing persons or objects, or reckless operation.

Alcohol and Drug Policy

The use or possession of alcohol, marijuana, narcotics, or illegal substances before or during the rental is strictly prohibited. Violation will result in immediate termination of the rental without refund.

Assumption of Risk

The Renter acknowledges that operating personal watercraft involves inherent risks including collisions, drowning, equipment malfunction, weather hazards, injury, and death. The Renter voluntarily assumes all risks associated with participation in this activity.

Release of Liability

The Renter releases and holds harmless Dakota Thrill Rentals LLC, its owners, employees, agents, and affiliates from any claims, injuries, damages, or losses arising from the use of the rented equipment, including claims resulting from alleged negligence.

Indemnification

Renter agrees to indemnify and defend Dakota Thrill Rentals LLC from any claims, lawsuits, legal fees, damages, or liabilities arising from the Renter’s use of the equipment, including injuries to passengers or third parties.

Equipment Responsibility Clause

Renter assumes full financial responsibility for any damage, theft, or loss of the watercraft or equipment during the rental period, regardless of fault.

Passenger Responsibility Clause

Renter accepts responsibility for the safety and conduct of all passengers and guests using the rented equipment.

Personal Property Clause

Dakota Thrill Rentals LLC is not responsible for any personal belongings lost, stolen, or damaged during the rental.

Life Jacket Requirement

All riders must wear a life jacket at all times while operating or riding the watercraft.

Photo and Media Release

Renter grants Dakota Thrill Rentals LLC permission to use photos or videos taken during the rental for marketing or promotional purposes.

Governing Law

This Agreement shall be governed by the laws of the State of South Dakota.

Acknowledgment

By signing below, the Renter confirms they have read and understand this entire agreement and voluntarily accept all terms, risks, and responsibilities.
