Waiver of Liability, Release, Hold Harmless, and Indemnification Agreement (“Agreement”)

I, the UNDERSIGNED, on behalf of myself, my heirs, next of kin, successors in interest, assigns, personal representatives, administrators, and agents, hereby agree that I have voluntarily, at my own risk, engaged in “Training and Shooting Instruction, Activities, Products” (collectively, the “Activity” or “Activities”) with Practical Readiness Training Group, LLC (hereinafter referred to as “PRTG” or “Releasees”). As lawful consideration for being permitted to participate in PRTG’s Activities, I hereby acknowledge and agree to all the terms and conditions set forth in this “Agreement” as follows:

INCLUSION: I, the UNDERSIGNED, acknowledge and understand that “PRTG” includes all owners, officers, directors, attorneys, agents, employees, contractors, volunteers, guests, and affiliated individuals or organizations (e.g., host facilities, classrooms, or ranges).

ELECTIVE PARTICIPATION / CONDUCT: I, the UNDERSIGNED, acknowledge and understand that my participation in PRTG Activities is elective and I am participating at my own free will. I understand that “Activities” include, but are not limited to firearm training, de-escalation training, use of force training, and other firearm or self-defense related educational exercises, programs, or courses all of which may include handling and discharge of firearms, loud noises, handling of ammunition, handling of other lethal and less than or non-lethal self-defense devices or substances, physical activity, and outdoor exposure (e.g., sun, wind, rain, snow, ice, plants, insects, and animals). I acknowledge that “Activities” include any movements, demonstrations, exercises, drills, or courses of fire of any kind whatsoever in which I engage or observe while in training or on the premises where the training is conducted. I acknowledge and understand that professional and instructive physical contact may occur in relation to firearms training. 


I, the UNDERSIGNED, acknowledge and agree that PRTG reserves the right to restrict or prevent my participation in its Services at any time if PRTG reasonably determines that my behavior is unsafe or objectionable to PRTG or other participants, in PRTG’s absolute discretion.I understand that in PRTG or its designees’ sole discretion, I, or those under my supervision, may be removed from said Activities. I acknowledge and understand that disrespectful, careless, or unsafe behavior is prohibited and may result in immediate ejection from PRTG Activities. 


RULES AND REQUIREMENTS: I, the UNDERSIGNED, acknowledge and agree to abide by all PRTG Code of Conduct and Safety rules included herein or presented within the Activities. 

I, the UNDERSIGNED, SWEAR, and AFFIRM I am of good character and moral standing and am legally entitled to possess and/or purchase a firearm. I have no criminal convictions, pending criminal charges, or indictments nor do I suffer from any form of mental illness that would prohibit me from legally and safely possessing and using a firearm, or would be determined or dangerous to me or others. I further AFFIRM that I will not be under the influence of alcohol, cannabis, or any other drug that may impair my physical, mental, or emotional abilities within eight (8) hours before or during PRTG Activities.

I, the UNDERSIGNED, represent and AFFIRM that to the best of my knowledge, information, and belief that:

1. I am not currently under indictment or information in any court for a felony, or any other crime that a judge could impression me for more than one year.

2. I am not a current member of the military who has been charged with violation(s) of the Uniform Code of Military Justice and whose charge(s) have been referred to a general court-martial.

3. I have never been convicted in any court, including military court, of a felony, or any other crime for which the judge could have imprisoned me for more than one year, even if I received a shorter sentence including probation.

4. I am not a fugitive from justice.

5. I am not an unlawful user of, or addicted to, marijuana or any depressant, stimulant, narcotic drug, or any other controlled substance.

6. I am not under the influence of alcohol or any lawful drug that may impair my abilities and I have not consumed any alcohol or lawful drug that may impair my abilities within the last eight (8) hours.

7. I have never been adjudicated mentally defective or committed to a mental institution.

8. I have never been dishonorably discharged from the Armed Forces.

9. I am not subject to a court order, including a Military Protection Order, restraining me from harassing, stalking, or threatening my child or an intimate partner or child of such a partner.

10. I have never been convicted in any court of a misdemeanor crime for domestic violence or probation before judgment.

11. I am not now, nor have I ever been a member of the military and been convicted of a crime that included, as an element, the use of force against a person.

12. If a United States Citizen, I have never renounced my United States citizenship.

13. I am not an alien illegally in the United States.

14. I am not an alien admitted to the United States under a Non-Immigrant Visa.

15. I have no unlawful, illegal, wrongful, or otherwise deceitful intentions in executing this Agreement or in utilizing PRTG and, if applicable, firearms, ammunition, and other PRTG property.

I, the UNDERSIGNED, acknowledge and understand that Maryland law prohibits any person convicted of a felony from possessing a firearm or being in any environment where firearms are present. All Federal, State, and Local firearms laws must always be obeyed. Anyone under the influence of drugs, alcohol, or prescription medication that impairs or affects mental alertness and/ or coordination is prohibited from participating in firearms training or shooting activities.

COMMITMENT TO SAFE FIREARM HANDLING: I, the UNDERSIGNED, acknowledge and agree that anyone who uses a firearm has a responsibility to themselves and othersto use the firearm safely. I acknowledge that I have reviewed PRTG’s Basic Rules of Firearm Safety (included below). I agree to always follow all of the basic rules of firearm safety during PRTG Activities. The safe use of firearms dictates that I understand and agree to follow these instructions:

1. I WILL TREAT EVERY FIREARM AS IF IT WERE LOADED AND ALWAYS KNOW THE CONDITION OF MY FIREARM.  

2. I WILL NOT PLACE MY FINGER ON THE TRIGGER OR IN THE TRIGGER GUARD UNTIL I HAVE MADE THE DECISION TO SHOOT.  

3. I WILL ALWAYS KEEP THE FIREARM POINTED IN A SAFE DIRECTION.  

4. I WILL ALWAYS BE AWARE OF MY TARGET AND WHAT IS BEYOND IT AND AROUND IT.  

5. I WILL ALWAYS KEEP THE FIREARM UNLOADED UNTIL READY TO USE IT.  

6. I WILL ALWAYS WEAR APPROPRIATE EYE AND EAR PROTECTION.  

7. I WILL ALWAYS BE IN CONTROL OF MY FIREARMS. 

8. I WILL NOT BRING LIVE AMMUNITION INTO ANY CLASSROOMS WHERE FIREARMS ARE PRESENT. 

9. I WILL ALWAYS ADHERE TO THE INSTRUCTORS AND RANGE SAFETY OFFICER’S (RSO) INSTRUCTIONS AT ALL TIMES. 

10. I WILL NOT USE ALCOHOL OR DRUGS BEFORE OR WHILE HANDLING OR SHOOTING FIREARMS.

ACKNOWLEDGMENT OF RISK: I, the UNDERSIGNED, understand the effect of this Agreement and acceptance of risk on my legal rights. By signing this Agreement and participating in PRTG activities, I expressly agree to ACCEPT AND ASSUME ANY AND ALL RISKS resulting from or arising in any way out of my participation in PRTG Activities to the fullest extent permitted by law.

I, the UNDERSIGNED,acknowledge and understand that firearms, shooting, and self-defense activities are inherently hazardous and involve both known and unanticipated risks that could result in damage or destruction of property and physical or emotional injury, including paralysis or death to myself or other persons. The risks include but are not limited to being shot by or shooting myself or others; partial or total loss of eyesight or hearing; inhalation or other harmful contact with lead or other contaminants; injuries associated with athletic physical activities, tripping, and falling; and being struck by flying or falling objects. I understand that such risk cannot be eliminated without compromising the essential qualities of shooting activities. 

I, the UNDERSIGNED, further acknowledge and understand that the nature and condition of the training facilities (e.g., classrooms, indoor or outdoor shooting range), premises, and environment are such that both known and unanticipated hazards exist, which create or contribute to both known and unanticipated risks inherent in participating in training or using range facilities and in engaging in or observing any activities of any kind whatsoever. I understand that such hazards and risks cannot be eliminated without compromising the essential qualities of the training, facilities, equipment, premises, and environment.  


HOLD HARMLESS: I, the UNDERSIGNED, on behalf of myself, my heirs, next of kin, successors in interest, assigns, personal representatives, administrators, and agents fully and forever, irrevocably and unconditionally defend, indemnify, completely release, and hold harmlessPRTG from any and all past, present, and future claims, lawsuits, demands, right or causes of action, liabilities, deficiencies, loss, damages, judgments, settlements, interest, awards, penalties, fines, costs, or expenses of any kind whatsoever (including without limitation all claims for monetary loss, property damage, equitable relief, personal injury, and/or wrongful death), whether they be known or unknown, anticipated or unanticipated, whether brought by an individual or other entity arising out of or attributable to my participation in the Activities, whether arising out of the negligence of PRTG, any Releasees, or otherwise and I intend to be legally bound by this release to the fullest extent permitted by law.  

I, the UNDERSIGNED, on behalf of myself, my heirs, next of kin, successors in interest, assigns, personal representatives, administrators, and agents shall fully defend, indemnify, completely release, and hold harmless PRTG from any and all past, present, and future claims, lawsuits, demands, causes of action, liability, loss, damage, and/or injury, of any kind whatsoever (including without limitation all claims for monetary loss, property damage, equitable relief, personal injury, and/or wrongful death), whether brought by an individual or other entity, or imposed by a court of law or by administrative action of any federal, state, or local governmental body or agency, arising out of, in any way whatsoever, any acts, omissions, negligence, or willful misconduct, of myself, or those individuals participating under my supervision.

COVENANT NOT TO SUE: I, the UNDERSIGNED, in consideration of PRTG allowing my participation hereby voluntarily release, waive, and forever discharge and covenant not to sue PRTG or all other persons or entities acting on its behalf. I agree that neither I nor my heirs, executors, administrators, personal representatives, and/or anyone else claiming on my behalf, shall institute any suit or action at law or otherwise, or assist in the prosecution, of any claims against PRTG. I hereby so instruct my heirs, executors, administrators, personal representatives, and/or anyone else claiming on my behalf.  

I, the UNDERSIGNED, acknowledge and understand that PRTG makes no warranty as to the design, manufacture, condition, or fitness for any particular purpose of any facility, classroom, premises or equipment including, but not limited to firearms, firearms accessories, ammunition, eye or hearing protection, training devices, less than or non-lethal self-defense devices, ventilation systems, bullet traps, backstops, targets, target holders, target retrievers, medical equipment, or first-aid supplies. Therefore, I release PRTG of claims resulting from injuries, including death, and any loss sustained which arise out of or are in any way associated with the use of any facility, classroom, premises, or equipment.

LITIGATION: I, the UNDERSIGNED, acknowledge and agree that any controversy or claim arising out of or relating to this Agreement, or the breach thereof, shall be determined by final and binding arbitration administered by the American Arbitration Association (“AAA”) under its Commercial Arbitration Rules and Mediation Procedures (“Commercial Rules”). There shall be one arbitrator agreed to by the parties within twenty (20) days of receipt by the respondent of the request for arbitration, or in default thereof appointed by the AAA in accordance with its Commercial Rules. The award rendered by the arbitrator shall be final, non-reviewable, non-appealable, and binding on the parties and may be entered and enforced in any court having jurisdiction. The place of arbitration shall be in the State of Maryland. Except as may be required by law, neither a party nor the arbitrator may disclose the existence, content, or results of any arbitration without the prior written consent of both parties, unless to protect or pursue a legal right. The arbitrator will have no authority to award punitive damages or consequential damages.

I, the UNDERSIGNED, acknowledge and agree that I waive, to the fullest extent permitted by applicable law, any right I may have to a Trial by Jury in any legal action, proceeding, cause of action, or counterclaim arising out of or relating to my participation in PRTG Activities. I CERTIFY and ACKNOWLEDGE that I make this waiver knowingly and voluntarily.

HEALTH/SAFETY: I, the UNDERSIGNED, AFFIRM that I am aware of all applicable personal medical needs, and I am unaware of any health-related reasons or problems that preclude or restrict my participation in PRTG Activities. I understand and agree that PRTG is not obligated to attend to any of my medical or medication needs, and I assume all risk and responsibility for the same. If I require medical treatment or hospital care PRTG is not responsible for the costs or quality of such treatment or care.

I, the UNDERSIGNED, acknowledge and understand that PRTG has no duty to undertake first-aid or rescue operations or procedures in the event any such property damage or physical or emotional injury occurs, and that any such operations or procedures may result in compounded or increased damages or injuries whether by chance or by negligent emergency response or rescue operations of PRTG or Releasees. I agree that PRTG may, but is not obligated to, take any actions it considers necessary under the circumstances regarding my health and safety. In the event of such illness or injury, I authorize PRTG and any of the Releasees to obtain necessary medical treatment for me and hereby release and hold harmless all of the Releasees in the exercise of this authority. I acknowledge associated medical expenses will be at my own expense or the expense of my personal insurers. I AFFIRM that I have adequate and appropriate insurance to provide coverage for such medical expenses.

PHOTO and VIDEO RELEASE: I hereby grant to PRTG the irrevocable and unrestricted universal right and permission to release and publish my image(s) and video(s) in conjunction with PRTG Training and Shooting Activities. The foregoing pictures and videos (collectively, the “Content”) are owned by PRTG.

AMENDMENT AND MODIFICATION: I, the UNDERSIGNED, acknowledge and agree that no modification, or amendment of this Agreement shall be binding unless executed in writing and signed by both Parties. 

WAIVER: I, the UNDERSIGNED, acknowledge and agree that no waiver of any default shall constitute a waiver of any other default or breach, whether of the same or other covenant or condition. No waiver, benefit, privilege, or service voluntarily given or performed by a Party shall give the other Party any contractual right by custom, estoppel, or otherwise.

ATTORNEYS' FEES AND COSTS: I, the UNDERSIGNED, acknowledge and agree that if any legal action or other proceeding is brought in connection with this Agreement, the successful or prevailing Party, if any, shall be entitled to recover reasonable attorneys' fees and other related costs, in addition to any other relief to which that Party is entitled. In the event that it is the subject of dispute, the court or trier of fact who presides over such legal action or proceeding is empowered to determine which Party, if any, is the prevailing party in accordance with this provision.

ENTIRE AGREEMENT AND DURATION: I, the UNDERSIGNED, acknowledge and agree that this Agreement contains the entire agreement between the Parties related to the matters specified herein and supersedes any prior oral or written statements or agreements between the Parties relating to such matters. I further acknowledge and agree that this Agreement shall remain in full force and effect from the date of execution and ever after, including any signed written amendment or modifications to it, and shall apply to each and every occasion that I participate in PRTG activities, as well as participate or observe in any activities at associated or affiliated classrooms or range facilities.

ENFORCEABILITY, SEVERABILITY, AND REFORMATION: I, the UNDERSIGNED, acknowledge and agree that this Agreement intends to provide as broad and inclusive indemnification as possible under Maryland law. If any provision of this Agreement shall be held to be invalid, void, or otherwise unenforceable, I agree and intend that the remaining provisions shall continue to be valid, enforceable, and in full legal force and effect. If a court finds that any provision of this Agreement is invalid or unenforceable, but that by limiting such provision it would become valid and enforceable, then such provision shall be deemed to be written, construed, and enforced as so limited.

APPLICABLE LAW, EXCLUSIVE VENUE, AND JURISDICTION: I, the UNDERSIGNED, acknowledge and agree that this Agreement shall be governed exclusively by the laws of Maryland, without regard to conflict of law provisions and that the venue for any action or proceeding shall be the State of Maryland, without regard for the conflict of law rules for the State of Maryland.

SIGNATURES: In signing this Agreement, I acknowledge and represent that I have fully read it, fully understand it, sign it voluntarily of my own free will. I ATTEST that no other oral representation, inducement, assurance, or guarantee has been made to me in consideration of my signing this Agreement.
