LIABILITY WAIVER, ASSUMPTION OF RISK & RELEASE

ACKNOWLEDGMENT OF NATURE OF PLAY / ASSUMPTION OF RISK

I understand that this facility is a natural playground using existing trees, wood structures, ropes, nets, and natural terrain. Unlike manufactured playground equipment, natural play environments involve uneven surfaces, height, weather exposure, and natural materials. I acknowledge that participation involves inherent risks, including but not limited to falls, slips, collisions, rope or wood contact, splinters / scrapes / scratches / other injuries, insects, and actions of other participants. I voluntarily assume all risks, whether known or unknown, associated with using the playground.

RELEASE OF LIABILITY

In consideration for being permitted to enter, use, and participate in activities within the natural playground (the “Premises”), the undersigned participant, and/or the parent or legal guardian of a minor participant, hereby voluntarily agrees to release, waive, discharge, and covenant not to sue the property owner, operator, employees, volunteers, agents, and any affiliated entities (collectively, the “Released Parties”) from any and all liability, claims, demands, actions, or causes of action whatsoever arising out of or related to any loss, damage, or injury, including but not limited to bodily injury, illness, disability, death, or property damage, that may be sustained by the participant, whether caused by the negligence of the Released Parties or otherwise, while participating in or being present on the Premises.

The undersigned acknowledges and understands that a natural playground environment may include inherent risks, including but not limited to uneven terrain, natural obstacles (such as rocks, logs, water features, and vegetation), exposure to insects and wildlife, and other hazards that cannot be fully eliminated. The undersigned voluntarily assumes all such risks, both known and unknown.

The undersigned further agrees to indemnify and hold harmless the Released Parties from any loss, liability, damage, or costs, including court costs and attorney’s fees, that may arise due to participation in activities on the Premises, whether caused by negligence or otherwise, to the fullest extent permitted by law.

This Release of Liability is intended to be as broad and inclusive as permitted by the laws of the state in which the Premises are located. If any portion of this provision is held invalid, the remainder shall continue in full legal force and effect.

By signing below, the undersigned acknowledges that they have read this Release of Liability, fully understand its terms, understand that they are giving up substantial rights, and sign it freely and voluntarily without any inducement.

MINORS & SUPERVISION

I certify that I am the parent or legal guardian of the minor participant(s) listed below. I understand that active supervision is required and agree to assume full responsibility for the minor’s participation. Unless stated in writing, The Finch-Lee House does not provide individual supervision.

RULES & CONDUCT

I agree to:

  • Follow posted rules and staff instructions
  • Use elements only as intended
  • Wear appropriate clothing and footwear

Failure to comply may result in removal without refund.

MEDICAL AUTHORIZATION

In case of emergency, I authorize medical treatment for myself or the minor participant(s) and accept financial responsibility for all care.

GOVERNING LAW

This agreement is governed by the laws of the State of North Carolina.

CONTINUING WAIVER AND RELEASE

The undersigned acknowledges and agrees that this Release of Liability is a continuing waiver that applies to any and all present and future visits and participation by the minor participant at the Premises. This agreement need only be executed once and shall remain in full force and effect for all subsequent visits unless expressly revoked in writing by the undersigned.
