WAIVER - WARNING PLEASE READ CAREFULLY BEFORE SIGNING!

Definition - "Boat Boss" is a 4-day practical marine training course on small boats.

This Waiver is a requirement for participation in Datum Marine Services Ltd.’s “Boat Boss” which includes training participants to operate small, open boats on the ocean. There are risks and dangers associated with operating a boat and activities around and on the water. For your own safety it is important that you understand the risks.

Assumption of Risks

I am aware that the “Boat Boss” course involves many risks, dangers and hazards which include but are not limited to, rough or variable sea conditions such as strong currents, eddies, large waves, swells, wakes from other vessels, floating objects, underwater waves and hazards such as cables, wreckage, stumps, rocks or shoals, any of which may be encountered suddenly and without warning; dangerous actions by wildlife, rough or variable weather conditions, including heavy rain, lightning and high winds; spray; wet and slippery decks, ramps and stairs; sudden or violent movement of the vessel; collision with docks, wharves, shore, objects or other vessels; prolonged exposure to cold water; hypothermia; capsizing; accidental drowning; tripping and falling; pulled muscles; twisted ankles; knee and arm injuries, injuries caused by other participants not following best practices, and instructor negligence.

Datum Marine Services Ltd (DMSL) mitigates these risks as far as possible. Examples of how DMSL mitigates these risks include, but are not limited to the following:

·       Requiring marine training program participants to wear the provided Personal Flotation Device at all times when out on the water or on the dock.

·       Participants will receive detailed instruction before carrying out any boat operation.

·       Hiring only fully certified and experienced marine Captain’s as instructors. DMSL instructors receive thorough instructor training from DMSL.

·       DMSL vessels carry the Transport Canada required marine safety equipment and are maintained to the highest standard.

·       The marine training program timetable may be rearranged to avoid bad weather or sea conditions.

By signing this waiver, you agree the following:

·       You do not have any medical or other condition that would render it unsafe for you to participate in the marine training program.

·       You will wear the provided Personal Flotation Device (PFD) at all times when on the water or on the dock.

·       You will follow the directions of DMSL’s instructors.

·       You will not attend the marine training program intoxicated or under the influence of marijuana/ cannabis or any substance/ drug / medicine which could impair your ability to operate a boat.

·       You have read and understood Boat Boss Welcome letter


Indemnity Agreement

I hereby release Datum Marine Services Ltd., and its employees, instructors, agents and directors from any claim for loss or damage that I may incur as a result of my participation in any activity offered by Datum Marine Services Ltd. including the Boat Boss course and specifically release Datum Marine Services Ltd for any claim arising from Negligence.

Photo and Video Release

I consent to having photos or videos taken of me while participating in adventure activities and to the publication of the photos and videos by the Releasees for advertising, marketing and promotional purposes.
