Membership Agreement

The following outlines the terms and conditions for the One Pass Membership Agreement (the “Agreement”) between the Regional Recreation Corporation of Wood Buffalo (the “RRC”) and the Members

1.0 PAYMENTS & PRICE CHANGES

AMOUNT DUE AT SIGNING :

  • Facility Pass: Full Monthly Membership Cost
  • CONTINUOUS: $15 administration fee & First Installment
  • ANNUAL: Full Annual Membership Cost
  • GROUP PAID IN FULL: Full Annual Membership fee (after applicable group discount)

PRICE CHANGES:

  • Facility Pass: No price change during Monthly Term 
  • CONTINUOUS: Price change upon change in member age, ex: from Youth to Adult. Thirty (30) day notice for all other price changes.
  • ANNUAL: No price change during Annual Term
  • GROUP PAY IN FULL: No price change during Annual Term

1.1 The Member acknowledges and agrees that this is a binding legal agreement to pay all current and future dues to the RRC incurred by the Member or dependent Member(s) as listed on this Agreement or added in the future to the membership account. The Customer authorizes the RRC to charge their saved credit card for agreed upon purchases. The Customer further understands that the credit card information will be saved on file for future transactions on my account.

1.2 All memberships are non-transferrable and cannot be downgraded.

1.3 The Member acknowledges and agrees that there are no refunds, transfers or deferrals for all fees paid except as specified in this Agreement.

1.4 Any payments returned on account of either insufficient funds or bank or credit card account cancellation will result in the restriction of Member account and a twenty five dollar ($25.00) administration fee will be applied.

1.5 If payment for the prior month membership installment and administration fee is not received before the next scheduled payment date, the membership will be terminated and the member will no longer be eligible for payment plans with the RRCWB.

1.6 Restriction, cancellation or termination of membership shall not relieve the Member from the obligation to pay account balances owed.

1.7 If the Member fails to pay any account balances, the Member shall pay all costs and expenses of collection incurred by the RRC, including reasonable collection agency fees and expenses. 

2.0 CANCELLATION, REFUND & TEMPORARY SUSPENSION POLICY

2.1 Summary: Please see subsequent clauses for 2.2.1 Cancellation, refund and temporary suspension detailed policies

MINIMUM TERM COMMITMENT:

  • Facility Pass: No commitment
  • CONTINUOUS: Minimum three (3) Full Calendar Months
  • ANNUAL: Annual (365 days from date of purchase)
  • GROUP PAY IN FULL: Annual (365 days from date of purchase)

REFUNDABLE:

  • Facility pass: N/A
  • CONTINUOUS: N/A
  • ANNUAL: Refundable (see clause 2.2)
  • GROUP PAY IN FULL: Refundable (see clause 2.2)

TEMPORARY SUSPENSION:

  • Facility Pass: N/A
  • CONTINUOUS: N/A
  • ANNUAL: One (1) time during current term for a maximum of ninety (90) consecutive days (see clause 2.2)
  • GROUP: One (1) time during current term for a maximum of ninety (90) consecutive days (see clause 2.2)

2.2 Annual Membership Cancellation, Refund and Temporary Suspension:

2.2.1 Annual Memberships can be cancelled only if the Member has a medical reason or is moving outside the Wood Buffalo Region.

2.2.2 If cancelling owing to a medical reason, a medical certificate from a qualified medical practitioner is required.

2.2.3 If cancelling owning to relocation out of town, the Member has to provide a forwarding address outside of the Wood Buffalo region.

2.2.4 All refunds will be pro-rated for the remaining term of the annual membership and an administration fee of twenty-five dollars ($25.00) or ten percent (10%), which ever is greater, of the refund produced will be applied.

2.2.5 All eligible refunds will be issued based within four weeks.

2.2.6 Annual and Group Pay In Full memberships have the privilege of one (1) temporary suspension during the current term of the membership. Members in good standing may avail of a three (3) month temporary suspension wherein the membership expiry date is extended by the duration of the suspension. No refunds are due to the Member owing to a temporary suspension.​

2.3 Continuous Membership Cancellation:

2.3.1 Continuous memberships can only be cancelled after minimum of three (3) full calendar months of membership.

2.3.2 Eligible cancellation requests must be received at minimum 2 business days prior to request for cancellation.

2.3.3 No refunds will be issued for any unused portion of the Continuous Membership.

2.4 Facility Passes:

2.4.1 Facility Passes are non-refundable and non-transferable.


3.0 Smart Scan Wristband Access


3.1 The member acknowledges that the Smart Scan Wristband will be activated and ready for use within a 24 hour period


3.2 The Member acknowledges the Smart Scan wristband must be worn at any time you visit an RRC facility as proof of access. Wristband eligibility may be requested to be verified by an RRC employee at any time.


3.3 The Member acknowledges that the Smart Scan wristbands are assigned to each specific user and cannot be shared/transferred to non-members. 


3.4 The Member acknowledges that all lost or damaged wristband will be $25 replacement fee. After the initial replacement, unless the original is returned the member may loose Smart Scan privileges up to 3 months. 


3.5 Misuse of Smart Scan wristbands including but not limited to, sharing wristbands, tampering with wristband, selling wristbands, etc. will result in privileges being revoked.


{Digital Signature}

4.0 FORCE MAJEURE

4.1 Performance of this Agreement is contingent upon the ability of the facility to complete the same and is subject to labor, disputes, strikes or picketing, accidents, government (federal, state or local) requisitions, restrictions upon travel, transportation, supplies and other causes, where to enumerated herein or not, which are beyond the control of the facility. In no event shall the facility be liable for the loss of profit or other similar or dissimilar collateral of the consequential damages, whether based on breach of agreement, warranty or otherwise.

5.0 INDEMNITY & RELEASE

5.1 The Member shall indemnify and save the RRC the Regional Municipality of Wood Buffalo (the “RMWB”); and each and every director, officer, employee, affiliate, agent, delegate, representative, contractor, supplier, volunteer, sponsor, elected official and all individuals associated with the RRC and the RMWB with respect to their involvement with the RRC in any way (collectively all such parties are the “Released Parties”) harmless for any and all damage, causes, suits or claims which may arise by virtue of being a member at the RRC, whether such damages, causes, suits or claims are occasioned by the Member or any other person while the Member is present at, has leased and or is in control of the said facility.

5.2 The Member further covenants and agrees to pay any costs that may be incurred pursuant to or arising from any damages, causes, suits or claims.

5.3 The Member and dependent members must sign separate Release of Liability, Waiver of Claims, Assumption of Risk and Indemnity Agreement (the “Release”). Where dependent members are under the eighteen (18) years of age, the parent or legal guardian of the dependent member must sign on behalf of the dependent member.

5.4 The Member and dependent members agree to be bound by all facility rules and regulations in place.

6.0 GOVERING LAW & OTHER CLAUSES

6.1 This Agreement shall be governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein without regard to conflict of laws principles.

6.2 All Members must sign the Agreement, the Release and a PAR Q form at least once per calendar year.

6.3 The Member agrees that all prior agreements are replaced by this Agreement and by the execution of this Agreement all provisions in prior agreements are hereby superseded in their entirety and replaced herein and shall have no further force or effect.



RELEASE & WAIVER

RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISK & INDEMNITY


BY SIGNING THIS DOCUMENT YOU WILL WAIVE CERTAIN LEGAL RIGHTS,

INCLUDING THE RIGHT TO SUE OR CLAIM COMPENSATION.

PLEASE READ CAREFULLY


In consideration of permission, granted now or in the future by the Regional Recreation Corporation of Wood Buffalo (the “RRC”) to the Participant (as defined below) to utilize RRC’s equipment and/or facilities to participate in a sport or recreation activity (an “Activity”), and for other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the undersigned accepts and agrees to this Release of Liability, Waiver of Claims, Assumption of Risk and Indemnity (the “Release”) in favor of the RRC, the Regional Municipality of Wood Buffalo (the “RMWB”), and each and every director, officer, elected official, employee, affiliate, agent, delegate, representative, contractor, supplier, volunteer, or sponsor of the RRC or the RMWB, and all individuals associated with the RRC or the RMWB with respect to their involvement with the Activity in any way (collectively all such parties are the “Released Parties”). The undersigned may be a participant in an Activity, or a user of RRC’s equipment and facilities (and is in either such case, or both, referred to herein as the “Participant”), or the undersigned may be the parent or legal guardian of a Participant that is under 18.


This Release applies to all present and future claims, demands, or causes of action that the Participant, or anyone acting on their behalf, may have against the Released Parties, whether arising now or in the future.


Release of Liability & Waiver of Claims:

The undersigned releases, discharges and waives any and all allegations, actions, suits, demands, and claims against the Released Parties for any loss, cost, personal injury, property damage, death, or any other liability arising out of or in any way connected with the Participant’s participation in the Activity or access to or use of RRC’s facilities or equipment, no matter how caused, and whether foreseen or not (collectively, “Claims”).

For greater certainty, but without limiting the generality of the foregoing, Claims include claims for negligence, breach of contract, breach of any statutory, equitable or common law duty of care, and claims for any failure of Released Parties to take reasonable steps to safeguard or protect the Participant from the risks, dangers and hazards of participating in an Activity or using RRC’s facilities or equipment.

This Release does not extend to claims arising from gross negligence or willful misconduct of the Released Parties.


Indemnity:

The Undersigned shall indemnify and hold the Released Parties harmless against all Claims, and against any damages, liabilities, obligations, losses, settlements, judgments, costs and expenses (including legal costs on a solicitor-and-own-client basis) which may arise out of, relate to or result from any act or omission of the Participant (or the undersigned, as the case may be).


Assumption of risk:

The undersigned explicitly acknowledges and agrees that participation in the Activity is purely voluntary and that participating may put the Participant at risk of serious injury or illness, including, without limitation, death or paralysis.

The undersigned acknowledges and accepts all risks arising from or in any way connected with the Participant’s participation in the Activity and use of RRC’s facilities or equipment. Such risks include, but are not limited to: inherent risks from participating in the activity, the diagnosed or undiagnosed health conditions of the Participant; failure on the part of the Participant or others to follow safety procedures; wet, icy or otherwise dangerous surfaces; contacting or being exposed to viruses, pathogens or other contaminants; falling objects and ice; equipment failure; improper use or maintenance of equipment or facilities; the actions of other people (including other users, spectators and Released Parties); the equipment and facility being unstaffed or unsupervised, including lack of surveillance; unauthorized access; emergencies; and the negligence of the Released Parties or any of them.

Inherent risks include, but are not limited to, any and all risks associated with participation in the Activity, including risks that are not foreseeable or are unpredictable.



Medical Treatment:

The undersigned consents (on behalf of the Participant, if the Participant is under the age of 18) to the administration to the Participant of first aid or other emergency medical treatment for any injury or illness arising from or during the Participant’s participation in an Activity or use of RRC’s equipment or facilities.


Without limiting the generality of any other provision of this Release, the undersigned releases and forever discharges the Released Parties from any claim, cost, loss, damage, or other liability whatsoever which arises or may hereafter arise on account of any first aid treatment or other medical treatment provided to the Participant.

This release extends to any medical treatment provided by any personnel, regardless of medical training, whether onsite or offsite.



Applicability and enforcement:

The undersigned expressly agrees that this Release is intended to be as broad and inclusive as permitted by the laws of the Province of Alberta.

The undersigned agrees that if any part of the Release is held to be invalid or illegal or unenforceable for any reason, such invalidity shall not affect the remaining provisions of this Release, which shall continue to be enforceable. This Release shall be governed by the laws of the Province of Alberta.

Any dispute arising out of or related to this Release shall be brought exclusively in the courts of the Province of Alberta.

In cases of family memberships or when one family member is registering other family members for an Activity or for using the facilities, the individual signing this Release on behalf of the family or registering another family member (the “Signing Family Member”) hereby acknowledges and accepts the responsibility of sharing this Waiver & Release with each participating family member. The Signing Family Member agrees to assume full accountability for ensuring each member of the family understands and agrees to the terms of this Waiver & Release before participating in the Activity or using the facility.

I acknowledge that certain activities may carry additional risks, which may be higher in nature than other activities, and I expressly accept such risks.



I HAVE READ THIS DOCUMENT FULLY. I UNDERSTAND WHAT IT SAYS AND I AM INTENTIONALLY AND VOLUNTARILY SIGNING THIS RELEASE IN ORDER TO PERMIT THE PARTICIPANT TO PARTICIPATE IN AN ACTIVITY AND/OR TO USE RRC’S EQUIPMENT OR FACILITIES. I UNDERSTAND THAT BY DOING SO I AM WAIVING SUBSTANTIAL LEGAL RIGHTS, WHICH I AND MY HEIRS, NEXT OF KIN, EXECUTORS, ADMINISTRATORS, AND ANYONE ELSE WHO MIGHT CLAIM OR SUE IN MY NAME OR ON MY BEHALF, MAY HAVE AGAINST THE RELEASED PARTIES.
