Participation Agreement and Talent Release Agreement - SNOWMOBILE

Aramark Sports and Entertainment Services, LLC, dba Scenic Safaris


In consideration of the services of Aramark Sports and Entertainment Services, LLC, dba Scenic Safaris, their officers, agents, employees, and other persons or entities associated therewith (hereinafter referred to as “Scenic Safaris”), I agree as follows:

 

Although Scenic Safaris has taken reasonable steps to provide you with appropriate equipment and skilled guides so you can enjoy an activity in Yellowstone National Park, and/or the Bridger-Teton National Forest for which you may not be skilled, we wish to remind you this activity is not without risk. Certain risks cannot be eliminated without destroying the unique character of this activity. The same elements that contribute to the unique character of this activity can be causes of loss of or damage to your equipment, accidental injury or illness, or in extreme cases, permanent trauma or death. We do not want to frighten you or reduce your enthusiasm for this activity, but we do think it is important for you to know in advance what to expect and to be informed of the inherent risks. The following describes some, but not all, of those risks: frostbite, hypothermia, limited braking ability of a snowmobile while running on snow or ice, falling off the snowmobile, putting one’s feet on the ground instead of the running boards while the machine is in motion, other participants, other objects on and off the trail, losing control and rolling over the snowmobile, losing control of the machine and driving off of the trail into a dangerous situation, rough trails, fatigue and poor trail conditions all may be encountered. Furthermore, Scenic Safaris guides have difficult jobs to perform. They might be unaware of a participant’s fitness or ability.  I also understand and acknowledge that other individuals may likely be participating in the activity, and Scenic Safaris is not responsible for the health status of its participants, including whether or not individuals are carriers of any infectious diseases.

 

I am aware that this activity entails risk of injury or death. I understand that the description of these risks is not complete and that other unknown or unanticipated risks may result in injury or death. I agree to assume responsibility for the risks identified herein and those risks not specifically identified including, but not limited to, any and all risks that are reasonably foreseeable. My participation in this activity is purely voluntary; no one is forcing me to participate and I elect to participate in spite of these risks. I certify that I am completely capable of participating in this activity. Therefore, I assume full responsibility for myself, including minor children, for bodily injury, death and loss of personal property and expenses thereof as a result of those inherent risks and dangers and of my acts or omissions in participating in this activity.

 

Consent to Reproduce Physical Likeness

Scenic Safaris occasionally photographs snowmobile drivers and passengers while they are engaged in snowmobile trips/activities. The photographs may be used in promotional/advertising materials in the future. The undersigned hereby grants to Scenic Safaris and its affiliated accompanies, their agents, employees, legal representatives, successors and assigns (the “Company”), the right to make, use, tape (audio and video), re-use, publish and copyright my statement(s), if any, so long as the meaning is not substantially changed. I hereby disclaim any right to the copyright in any such works and assign any rights that I may have in such works to the Company. I acknowledge I am not relying on any oral, written, or visual representations or statements made by Scenic Safaris including those made in its brochures or other promotional material, to induce me to participate in this activity.

 

Release, Indemnification, and Scope

Furthermore, I hereby release and forever discharge on behalf of myself, my heirs, assigns, personal representatives and estate and for all members of my family and their representatives (collectively, the “Releasing Group Members”), Scenic Safaris and its affiliates (including Aramark, and all other persons or entities controlling, controlled by or under common control with, Aramark Sports and Entertainment Services, LLC, their principals, directors, officers, agents, employees, representatives, members, stockholders, owners and volunteers, their insurers and every land owner and/or governmental agency upon whose property the activity is conducted and their insurers, if any (collectively, the “Releasees”) FROM ANY AND ALL LIABILITY OF ANY NATURE FOR ANY AND ALL LOSSES, DAMAGES, INJURY OR HARM (INCLUDING DEATH) TO OR BY RELEASING GROUP MEMBERS, AS A RESULT OF THEIR PARTICIPATION IN THE ACTIVITY AND/OR USE, NAVIGATION OR OPERATION OF THE VEHICLE, UNLESS SUCH LOSSES, DAMAGES, INJURY OR HARM ARE CAUSED BY THE GROSS NEGLIGENCE OF THE RELEASEES. I further agree on behalf of myself and the other Releasing Group Members to indemnify, defend and hold harmless the Releasees from any loss, damage or liability, including attorney’s fees and other costs, that result from claims, demands, or causes of action that are related in any way to losses, damages, injury or harm (including death) arising from participation in the activity, Scenic Safaris’ related services or facilities, the Vehicle or the use, navigation or operation of the same in the activity or otherwise.


***ON NATIONAL PARK SERVICE (“NPS”) PROPERTY ONLY: It is NPS' policy to have visitors assume responsibility for their own negligence that may result in bodily injury, death, or loss of personal property. The NPS allows concessioners to advise visitors of the inherent risks of the activity and warn visitors of those risks.  If an accident occurs on NPS property, the above-referenced waivers of liability or indemnification provisions are inapplicable. ****

 

This Agreement is subject to the rules, regulations, laws, and other requirements applicable to Scenic Safaris, including as a National Park Service concessionaire under the National Park Service Commercial Services Program, if applicable. Snowmobile operation is strictly limited to legal legally licensed motor vehicle operators. Snow suit, boots, gloves, and helmets (provided) are required to be worn by snowmobile riders and operators. If licensed motor vehicle operator is under the age of eighteen (18), Scenic Safaris requires the signature of the legal guardian or parent releasing and allowing Lessor to rent a snowmobile to their underage child. No one under the age of sixteen (16) will be allowed to operate a snowmobile.

 

I, the undersigned, hereby accept for use as-is the snowmobile (the “Vehicle”), and accept full responsibility for the care of the Vehicle while this Participation Agreement, Talent Release Agreement, Acknowledgement of Risks) is in effect, and agree to reimburse Scenic Safaris (as defined below) for any loss or damage to the Vehicle arising from its use. When used in this Agreement, the terms “I” and “me” refer to the undersigned.

 

In consideration for the rental of the Vehicle and related services of Scenic Safaris, and for being allowed to participate in and/or being provided with off-road sport or other recreational property or services as contemplated herein, I hereby further agree as follows:

 

By acceptance of the Vehicle, I acknowledge that the Vehicle is in good operating condition.  If I fail to notify Scenic Safaris of any defects or deficiencies with respect to the condition of the Vehicle and its related gear, equipment and accessories prior to departure, such failure shall constitute an acknowledgement that the Vehicle and its related gear, equipment and accessories were received in satisfactory condition. I will return the Vehicle, its related gear, equipment and accessories in the same condition in which they were received by me at the required return time. I authorize Scenic Safaris to charge my credit card for loss or damages to the Vehicle, its related gear, equipment and accessories which I am responsible for. A valid credit card is required for any snowmobile rental.

As an additional service to our customers, Scenic Safaris offers an optional “Damage Waiver.” This Damage Waiver will help reduce the cost to you for damage to your rented equipment (Vehicle) caused by you or someone in your rental party under normal operating conditions. If you elect the Damage Waiver, you will only be liable and fully responsible to pay a maximum of $750 for damage occurring to the Vehicle while on rent and used under normal operating conditions. The Damage Waiver, however, does not waive costs to recover a damaged vehicle or damages reasonably related to misuse, abuse, reckless behavior, or intentional damage, including, but not limited to, mysterious disappearance or theft.

I have carefully read, clearly understand and accept the terms and conditions stated herein and acknowledge that this Agreement, including the release, discharge and indemnification obligations contemplated in this Agreement, shall be effective and binding upon myself and the other Releasing Group Members

DAMAGE WAIVER OPTION:
Scenic Safaris is pleased to enhance your adventure experience by including our Damage Waiver Protection Plan with every rental. This inclusion is part of our commitment to providing you with peace of mind during your adventure. The Damage Waiver Protection limits your financial liability in the event of damage to the rented equipment (Vehicle) under normal operating conditions. With this plan, your liability is capped at a maximum out-of-pocket deductible of $750 for any damage to the Vehicle during your rental period, as long as the Vehicle is used according to normal operating conditions. Please note that this Damage Waiver does not extend to costs associated with the recovery of a damaged vehicle, nor does it absolve liability for damages resulting from misuse, abuse, reckless behavior, or intentional damage. This includes, but is not limited to, situations involving the mysterious disappearance or theft of the Vehicle.*
