RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISKS AND INDEMNTIY AGREEMENT BY SIGNING THIS DOCUMENT YOU WILL WAIVE CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.

PLEASE READ CAREFULLY! 

In consideration of being allowed to participate in rider training at Gopher Dunes, I hereby warrant and agree to the following:

1. I understand that participating in dirt bike training involves inherent risks, including but not limited to falls, collisions, unpredictable terrain, equipment failure, and serious injury or death.

2. I acknowledge that my/my child’s participation is voluntary, and I assume full responsibility for any risks, injuries, or damages that may occur during training.

3. I agree to follow all rules, instructions, and safety guidelines provided by Gopher Dunes instructors. If at any time I/my child feel unsafe or experience mechanical issues, I will immediately notify an instructor.

I UNDERSTAND AND AGREE, ON BEHALF OF MYSELF, MY HEIRS, ASSIGNS, PERSONAL REPRESENTATIVES, AND NEXT OF KIN, THAT MY EXECUTION OF THIS DOCUMENT CONSTITUTES:

1. AN UNQUALIFIED ASSUMPTION OF ALL RISKS associated with participation in rider training, even if arising from the negligence, gross negligence, or rescue procedures of Gopher Dunes, its owners, staff, instructors, contractors, and affiliates (collectively, "the Releasees").

2. A FULL AND FINAL RELEASE AND WAIVER OF LIABILITY for any loss, damage, injury, or expense that I/my child may suffer due to any cause whatsoever, including but not limited to negligence, gross negligence, breach of contract, or breach of any statutory or other duty of care owed under the Occupiers' Liability Act or any other applicable laws.

3. AN AGREEMENT NOT TO SUE THE RELEASEES for any loss, injury, costs, or damages, whether arising directly or indirectly from participation in any training activities.

4. AN AGREEMENT TO INDEMNIFY AND HOLD HARMLESS THE RELEASEES from any litigation expenses, legal fees, liabilities, damages, awards, or costs incurred due to any claims made by me, on my behalf, or by my child’s estate, even if such claims arise from the negligence or gross negligence of the Releasees.

5. AN AGREEMENT THAT THIS DOCUMENT SHALL BE GOVERNED BY THE LAWS OF THE PROVINCE IN WHICH THE TRAINING OCCURS.


RIDER TRAINING RULES & POLICIES

  • All participants must follow instructor directions at all times to ensure safety. Failure to comply may result in termination of the session without a refund.
  • All necessary safety gear must be worn at all times while riding.
  • Deposits are non-refundable for no-shows. Deposits can be used for rescheduling or as in-store credit if we are notified at least 24 hours prior to the scheduled lesson.
  • If you arrive late, you are not guaranteed the full duration of your lesson. All students must arrive at least 15 minutes prior to their session.
  • Reckless or irresponsible riding will result in immediate termination of the session without refund.
  • All provided safety gear must be returned before leaving Gopher Dunes.
  • Any damages to training bikes due to misuse, recklessness, or failure to follow instructor directions will be the responsibility of the participant. Repair costs will be assessed by Gopher Dunes staff, and the participant will be required to cover the damages.

I HAVE READ AND UNDERSTAND THIS AGREEMENT AND I AM AWARE THAT BY SIGNING THIS AGREEMENT I AM WAIVING CERTAIN SUBSTANTIAL LEGAL RIGHTS WHICH MY MINOR CHILD/WARD, HIS/HER HEIRS, NEXT OF KIN, EXECUTORS, ADMINISTRATORS AND ASSIGNS AND I AND/OR MY MINOR CHILD/WARD MAY HAVE AGAINST THE RELEASEES.
