BIRCHVIEW STABLES

EQUINE TREADMILL USE WAIVER & RELEASE OF LIABILITY

This Equine Treadmill Use Waiver and Release of Liability (“Waiver”) is entered into by and between Birchview Stables,

Ball Ground, Georgia (“Stable”), and the undersigned horse owner, lessee, rider, or authorized agent (“Participant”).

1. Description of Service

Birchview Stables offers equine treadmill services for conditioning, fitness, or rehabilitation-related programs.

Participation is voluntary and provided solely as a handling and equipment-use service.

2. Operation and Control of Equipment

Only Birchview Stables staff and authorized personnel may operate the treadmill. Birchview Stables retains sole

discretion over all aspects of use.

3. Veterinary Instructions / No Medical Advice

Birchview Stables is not a veterinary or medical provider and offers no diagnosis or treatment. Written veterinary

instructions may be followed as a courtesy only, without responsibility for outcomes. All medical decisions remain with

Participant and their veterinarian. Birchview Stables may discontinue use if unsafe.

4. Assumption of Risk

Equine activities and equipment involve inherent risks. Participant voluntarily assumes all risks of loss, injury, illness,

damage, or death arising from participation.

5. Release and Waiver of Liability

To the fullest extent permitted by Georgia law, Participant releases Birchview Stables from all claims arising from

treadmill use, including ordinary negligence, excluding gross negligence or willful misconduct.

6. Right to Refuse or Discontinue Service

Birchview Stables may refuse or discontinue service if participation is deemed unsafe.

7. Indemnification

Participant agrees to indemnify and hold harmless Birchview Stables from claims arising from the horse or participation.

8. Authorization to Act on Behalf of Horse

Participant represents authority to execute this Waiver, binding all interested parties.

9. No Bailment or Special Duty

No bailment or special duty of care is created.

10. Monitoring and Recording

Participant consents to monitoring or recording without expectation of privacy.

11. Relationship to Boarding Agreement

This Waiver is incorporated into any Boarding Agreement or stands alone.

12. Governing Law

This Waiver is governed by Georgia law.

13. Severability

Invalid provisions do not affect enforceability of remaining terms.

14. Entire Agreement / No Reliance

This Waiver is the entire agreement regarding treadmill use.

15. Acknowledgment

Participant acknowledges understanding and acceptance of this Waiver.

Authority to Enter Agreement
Authority to Enter Horse Into Service The undersigned Participant represents and warrants that they are the legal owner of the horse identified above, or are otherwise duly authorized by the legal owner to enroll the horse in the equine treadmill service and to execute this Waiver on the owner’s behalf. Participant further represents that all owners, co-owners, lessors, lessees, trainers, insurers, and other interested parties have been informed of and consent to the horse’s participation in the Service, and agree to be bound by the terms of this Waiver. *

WARNING: Under Georgia law, an equine activity sponsor is not liable for injury or death resulting from the inherent risks of equine activities pursuant to O.C.G.A. § 4-12-1 et seq. *

Parent(s) or Court-Appointed Legal Guardian(s) must sign for any participating minor (those under 18 years of age) and agree that they and the minor are subject to all the terms of this document, as set forth above.
