WAIVER, RELEASE AND INDEMNITY

 

To the Tulsa Red Castle Gun Club (“Gun Club”) members and families: 

WELCOME TO THE ZINK RANCH! 

We are pleased to have you as our guests.  We want you to enjoy your use of the Gun Club facilities located here within the Zink Ranch (“Ranch”). 

The Zink Ranch is a well-known, bona fide Tulsa-area landmark. The Gun Club’s facilities here are part of thousands of beautiful acres which offer amenities such as hiking, fishing, and camping, to other groups, including the Boy Scouts and Girl Scouts. We are proud to be associated with all of these Ranch uses, and we appreciate the combined reputation which we’ve earned together. 

To be sure our expectations are clear, we’ve put down in writing some of the basic rules governing your use of the facilities here. These will probably seem like common sense, but we’d rather just get these on the table than assume too much. Below, we ask that you sign and acknowledge that you’ve read and understand these basic rules and are waiving certain legal rights, releasing potential claims and indemnifying certain parties.

 

1. Membership:  A Membership in Gun Club will be defined as one family unit.

Primary Member:  The specific family member named on the ID Card for any Membership.

Spouse:  The spouse of the Primary Member.

Member Children:  The children of the Primary Member and/or Spouse, by birth, adoption, or guardianship, who are (a) under age 18, or (b) if age 18 or over, full-time students living with the Primary Member and/or Spouse.

ID Card:  A unique card issued by Gun Club to each Primary Member along with an automated gate access/entry card.

Vehicle Decal: An identifying decal issued annually for all Primary Member vehicles, to be affixed to the rear of the vehicle on the back glass (if applicable) and visible from the rear of the vehicle.


2. Permitted Areas:  The “Permitted Areas” will include these shotgun, pistol, and rifle ranges which are commonly known and used as part of the Gun Club:

Sporting Clays and Wobble Traps (shotgun) and lounge/storage building in this area

Auxiliary parking area and special shotgun event area located west of the above ranges

Plinking Range, Pistol Range, Action Pistol Ranges, Junior and Pistol Practice Range, Bench Rest Range, Small Bore Rifle and Pistol Silhouette Range, High Power Rifle and Silhouette Rifle ranges, and lounge and storage buildings in this area

Skeet fields including trap field

Tractor and workshop building located in the area of the skeet fields 

You agree not to use any other area of the Ranch for any purpose (including any other gun range, or fishing, hiking, etc.) unless you have been invited other than as a member of the Gun Club. Further, you agree to use each of the Permitted Areas only for its designated purpose.


3. Usage Times:  Generally, you are allowed access to the Permitted Areas every day, including holidays, from 7:00 A.M. (and under no circumstances earlier than 7:00 A.M.) until thirty minutes prior to official time of sunset.  Provided, however, that use shall not be allowed when visibility is impaired (whether by overcast, inclement, or other conditions) to an extent that normal driving would be done only with the use of headlights.  You also agree that the Ranch reserves the right to restrict usage at any time, with or without notice.

 

4. Safety and Conduct:  You agree to conduct yourself with the utmost regard for safety, including the use of proper eye and ear protection, and strict prohibition of any alcohol or drugs, and all driving on Ranch property. You and those accompanying you are welcome guests of the Ranch and are expected to conduct yourselves accordingly.  You must have your ID Card at all times while at the Ranch and you agree to show your ID Card to any Ranch employee or representative at any time if requested. If you do not have the card, you will be asked to leave the Ranch. If any Ranch employee or representative asks you to surrender your ID Card or leave the Ranch for any reason, you agree to do so peaceably and immediately.

 

5. Use by Family Members and Guests:  You, as the Primary Member, and/or your Spouse, are allowed to use the Permitted Areas so long as one of you who is present has your ID Card. You may bring non-member guests provided they are accompanied at all times by you (the Primary Member) or your Spouse, and one of you has the ID Card and a current Vehicle Decal, but such non-member guest(s) may not use the Permitted Areas more than 4 days per calendar year (per guest). Your Member Children who are able to legally drive themselves may, with your permission and if they have their own ID Card and a current Vehicle Decal, also use the Permitted Areas without you or your Spouse present, but are not allowed to bring non-member guests unless you or your Spouse is present. Your Member Children who are not able to legally drive themselves may only use the Usage Areas if you or your Spouse is present.

 

6. Property and Risk of Loss:  You agree that the risk of loss of your personal property (including but not limited to vehicles and firearms), and any risk of injury or death, involving you, your Spouse, your Member Children, and your guests, occurring as a result of or in any way connected with your use of Ranch property or facilities, is yours alone, and you agree to and hereby do waive all claims, release and indemnify the Ranch, the John Zink Foundation, its trustees, employees, representatives (including affiliates, heirs, successors or assigns of each of the foregoing), from any liability arising therefrom, regardless of the nature or cause of any loss or damage, including the partial or sole negligence of the Ranch, the John Zink Foundation, its trustees, employees, and representatives (including the affiliates, heirs, successors or assigns of each of the foregoing).

 

7. Training and Orientation:  These rules apply to all users of the Gun Club, including you as the Primary Member, your Spouse, your Member Children, and your Guests. It is your responsibility, and you agree, to ensure that all such persons understand and abide by these rules. Any incident involving your Membership is ultimately your responsibility.

I have read the information and rules on both sides of this paper. On behalf of myself, my Spouse, my Member Children, and any guests, I understand and agree to abide by them. Further, I acknowledge that I am responsible for ensuring compliance with these rules on the part of my Spouse, my Member Children, and any guests. My use at any time of the Usage Areas or the Ranch will be deemed to be a re-affirmation of my agreement with these rules.
