WAIVER OF RIGHTS, ASSUMPTION OF RISK, INDEMNIFICATION, HOLD HARMLESS, AND RELEASE OF LIABILITY AGREEMENT Jesse’s e-Rides LLC, including its owners, directors, officers, agents, employees, contractors, volunteers, heirs, executors, and assigns (collectively, “Jesse’s e-Rides”), and the lessor/landlord of the premises used for the Activity, Koo Koo’s Coffee Roasters LLC, and its owners, directors, officers, agents, employees, contractors, volunteers, successors, and assigns (collectively, the “Landlord”) provide a basic electric-bicycle (“e-bike”) education and safety training program delivered by qualified instructors (“Instructor(s)”). This program is primarily classroom-based, but may include hands-on activities such as operating or riding an electric bike, trike, or scooter, and the handling of lithium-ion batteries or related components. Participation in the program does not guarantee rider safety and does not replace any licensing, certification, or training that may be administered or required by the New Jersey Motor Vehicle Commission or any other governmental authority. FOR AND IN CONSIDERATION OF Jesse’s e-Rides and the Landlord providing access and instruction (the “Activity”), the undersigned agrees to the terms below.
1) ACTIVITY AND ASSOCIATED RISKS At my request and with my full consent (or, if applicable, my consent as the parent or legal guardian of a minor participant), Jesse’s e-Rides will provide introductory instruction in the Activity, which may take place on property leased from the Landlord (“Premises”). By signing below, I knowingly and voluntarily elect to participate in, or permit the Minor Participant to participate in, the Activity. I understand the risks—known and unknown—including injury, bodily harm, negligence, and death. I will comply with all laws and any rules, standards, and directions given by the Instructor(s), Jesse’s e-Rides, or the Landlord while on the Premises. Participation requires sufficient health and capacity for safe operation. The Activity involves risks such as falls, collisions, fractures, equipment failures, exposure to lithium-ion batteries, and negligence that may result in property damage, serious injury, or death.
2) ASSUMPTION OF RISK I expressly and voluntarily assume all risks of participation, including those arising from the negligence of Jesse’s e-Rides, the Landlord, and all Released Parties. Any equipment provided or loaned is used at my own risk.
3) RELEASE OF LIABILITY AND WAIVER OF RIGHTS I irrevocably and forever release Jesse’s e-Rides, the Landlord, and each of their respective owners, directors, officers, agents, employees, contractors, volunteers, heirs, successors, and assigns (collectively, the “Released Parties”) from any and all claims, demands, or causes of action arising out of or related to the Activity or my presence on the Premises, including those based on negligence, to the fullest extent permitted by New Jersey law.
4) INDEMNIFICATION I agree to indemnify, defend, and hold harmless the Released Parties—including the Landlord—from any and all claims, losses, damages, or expenses (including attorney’s fees) arising out of or related to my (or the Minor Participant’s) participation or presence on the Premises, except as prohibited by law.
5) HOLD HARMLESS AND DEFENSE These obligations extend to claims asserted against the Landlord as owner or controller of the Premises. If the Participant dies or becomes disabled, these duties bind their estate, heirs, and successors.
6) INSURANCE Jesse’s e-Rides and the Landlord do not provide any insurance coverage. I am solely responsible for obtaining any desired insurance.
7) WARRANTIES All equipment or services are provided as is, without warranty, express or implied.
8) SEVERABILITY If any term is found invalid, the remaining provisions remain in effect.
9) GOVERNING LAW AND DISPUTE RESOLUTION This agreement is governed by New Jersey law. Disputes will first be mediated in Monmouth County and, if unresolved, brought exclusively in its state or federal courts. Disputes include those arising from use of the Premises. Prevailing party may recover reasonable attorney’s fees.
10) DISCLOSURES Medical facilities may be limited. Jesse’s e-Rides and the Landlord are not health-care providers. I am responsible for all medical costs.
11) SAFETY AND CONDUCT ACKNOWLEDGMENTS By participating, I agree to: - Wear a helmet and follow Instructor directions. - Operate safely and lawfully under New Jersey Title 39 and local ordinances. - Report any mechanical issues. - Follow all posted rules and any instructions from Jesse’s e-Rides or the Landlord while on the Premises. - Accept responsibility for any citations or enforcement actions resulting from my conduct.
12) ACKNOWLEDGEMENTS I am over 18, have read this agreement, and understand that I am waiving substantial legal rights, including the right to sue for ordinary negligence.
13) MEDIA RELEASE I acknowledge that Jesse’s e-Rides may photograph, video record, or otherwise capture images and audio of participants during the Activity, including during any riding or hands-on instruction. I grant Jesse’s e-Rides LLC and its affiliates the unrestricted right and permission to use, publish, reproduce, distribute, display, and create derivative works from such media in any form and in any medium now known or later developed, including but not limited to social media, promotional materials, advertising, news coverage, educational content, and internal documentation, without compensation. I waive any right to inspect or approve the finished product or any use of such media. I understand that Jesse’s e-Rides is under no obligation to use any media and that all rights granted are irrevocable and perpetual. If I am the parent or legal guardian of a Minor Participant, I grant this permission on their behalf.
