A waiver must be completed by every guest, including drivers and passengers. A parent or guardian must complete a waiver for each minor in their party.

In consideration of the services of GettyPeds LLC their officers, agents, employees, and stockholders, and all other persons or entities associated with those businesses (hereinafter collectively referred to as “GettyPeds”) I (herein after referred to as “Lessee”) agree as follows:

Although GettyPeds LLC has taken reasonable steps to provide me with appropriate equipment and skilled guides so I can enjoy an activity for which I may not be skilled, GettyPeds LLC has informed me this activity is not without risk. Certain risks are inherent in each activity and cannot be eliminated without destroying the unique character of the activity. These inherent risks are some of the same elements that contribute to the unique character of this activity and can be the cause of loss or damage to my equipment, or accidental injury, illness, or in extreme cases, permanent trauma or death. GettyPeds LLC does not want to frighten me or reduce my enthusiasm for this activity, but believes it is important for me to know in advance what to expect and to be informed of the inherent risks. The following describes the activity and/or rental equipment and some, but not all, of those risks.

Hourly rentals and guided tours in which the vehicle(s): Scoot Coupe, Electric Car, Olde School antique bus, and/or Electric Bicycle are operated on public roads as well as National Park roads and property. Each operator is required to follow the state and federal laws at all times pertaining to the operation of a vehicle on their roadways as well as laws pertaining to public or federal lands.

(a) Lessee shall be responsible for any parking or traffic infringement and will supply relevant details as required by the police and/or the lessor relating to any such parking or traffic infringement just as they would be in their privately owned vehicle.

(b) If the rental vehicle is damaged or requires repair or salvage, whether due to an accident or breakdown, Lessee shall immediately notify GettyPeds LLC of the full circumstances by phone as soon as possible.

(c) Lessee shall not arrange for or undertake any repairs to the rental vehicle without the authority of GettyPeds LLC.

(d) Lessee, in addition to payment of the rental as herein provided, will assume payment for any and all costs associated with a late return of the rental vehicle, as well as any damages occurring to the rental vehicle during the rental period as a result of Lessee negligence. GettyPeds LLC assumes full responsibility for mechanical or equipment failures during the rental period. However, if an investigation by a certified person(s) is conducted and it is determined the cause of the failure is due to Lessee negligence, the Lessee will assume responsibility.

(e) Lessee shall ensure that no person shall interfere or tamper with the speedometer or any part of the engine, transmission, braking, or other mechanical components of the rental vehicle.

(f) Lessee shall not rent or loan the rental vehicle to another person or permit the vehicle to be operated by any other person who has not signed this visitor acknowledgement of risk(s).

(g) Lessee shall not operate the rental vehicle in a race, speed test, rally or other type of contest.

(h) Lessee shall not use the rental vehicle to tow any other vehicle or person or allow it to exceed its rated number of passengers or weight

restrictions.

(i) Should Lessee not return the rental vehicle by termination of the rental period, Lessee shall be charged additional rent of $20.00 for each 15 minutes of late return or fraction thereof. A relocation fee of $100.00 will be charged for any rental vehicle left in any location other than the GettyPeds LLC rental office. Further, if the rental vehicle is not returned to GettyPeds LLC because it is lost or stolen due to Lessee’s neglect and/or wrongdoing, Lessee will be charged the sum of $6500.00 for replacement of the scoot coupe, $10,500.00 for replacement of the six-passenger neighborhood electric vehicle, and $13,500.00 for the replacement of the Polaris Gem electric vehicle.

(j) Lessee shall not operate the rental vehicle outside of the boundaries/limits of the National Battlefield or town of Gettysburg, as instructed by a GettyPeds LLC representative. If Lessee fails to adhere to this regulation, GettyPeds LLC is authorized to terminate the rental immediately and the Lessee will incur a relocation fee of $100 and will not receive a refund for their rental.

(k) Lessee shall not operate the rental vehicle in a disrespectful manner while on the National Park Service property. This includes but is not limited to: excessive horn use, weaving from side to side of the roadway, racing or attempting to pass other rental party, lewd gestures or language, and/or operating the rental vehicle in the grass or anywhere it is not legally allowed to be. Any activity described above will result in the immediate termination of the rental and will not result in a refund.

(l) Lessee shall not operate any rental vehicle within National Cemetery boundaries or Evergreen Cemetery boundaries.

(m) Photo Release. You give us, free of any compensation, unlimited permission to use, publish, and republish, in any media, now in existence, or that may later be developed, for any lawful purpose, as it may determine, information and reproductions of your likeness, and your voice related to any aspect of the activities. You hear by wave your right to first review the use of your likeness or voice before any use or publication.

I am aware that GettyPeds LLC rentals entails risks of injury or death to any participant. I understand the description of these inherent risks is not complete and that other unknown or unanticipated inherent risks may result in injury or death. I agree to assume and accept full responsibility for the inherent risks identified herein and those inherent risks not specifically identified. My participation in this activity is purely voluntary, no one is forcing me to participate, and I elect to participate in spite of and with full knowledge of the inherent risks.

I acknowledge that engaging in this activity may require a degree of skill and knowledge different than other activities and that I have responsibilities as a participant. I acknowledge that the staff of GettyPeds LLC has been available to more fully explain to me the nature and physical demands of this activity and the inherent risks, hazards, and dangers associated with this activity.

I certify that I am fully capable of participating in this activity. Therefore, I assume and accept full responsibility for myself, including all minor children in my care, custody, and control, for bodily injury, death or loss of personal property and expenses as a result of those inherent risks and dangers identified herein and those inherent risks and dangers not specifically identified, and as a result of my negligence in participating in this activity.

I have carefully read, clearly understood and accepted the terms and conditions stated herein and acknowledge that this agreement shall be effective and binding upon myself, my heirs, assigns, personal representative and estate and for all members of my family, including minor children.
