EQUIPMENT RENTAL, CYLINDER FILL AND NITROX RESPONSIBILITY AGREEMENT

I understand that scuba equipment requires training, proper assembly, inspection, and use. I certify that I am a certified diver or under the direct supervision of a qualified instructor.

I accept full responsibility for inspecting all equipment issued to me, including regulators, buoyancy compensators, cylinders, weights, exposure suits, dive computers, and underwater propulsion vehicles (DPVs), prior to use. I will notify Discovery Dive World immediately if I find any defect, improper function, or missing component.

I understand that compressed breathing gas is hazardous if misused. I agree to analyze any Nitrox or enriched air cylinder personally before diving and to set my dive computer and depth limits accordingly. I understand that failure to properly analyze and set my computer may result in serious injury or death.

I accept full responsibility for:

• verifying oxygen percentage

• confirming MOD (Maximum Operating Depth)

• setting my dive computer correctly

• monitoring my own gas supply and pressure

I acknowledge that Discovery Dive World LLC does not supervise my dive unless I am directly enrolled in a training course. I am solely responsible for dive planning, gas management, ascent rate, decompression obligation, and buddy procedures.

I agree to return all rented equipment in the same condition as issued, normal wear excepted. I accept financial responsibility for loss, theft, neglect, or damage including saltwater flooding of dive computers, lights, cameras, scooters, or regulators due to improper care.

I acknowledge that underwater propulsion vehicles (DPVs) may cause rapid ascents or descents if misused and agree to operate them only within my training and certification limits.

I release and hold harmless Discovery Dive World LLC, its owners, employees, instructors, and contractors from any and all liability arising from the rental, filling, servicing, or use of equipment or breathing gas, including negligence to the fullest extent allowed by Florida law.

I have read and understand this agreement and sign it voluntarily.

EQUIPMENT LOSS OR DAMAGE VALUATION

I agree that I am financially responsible for loss, theft, or damage to rented equipment beyond normal wear and tear.

I agree that the value of lost or irreparably damaged equipment shall be the current retail replacement cost necessary for Discovery Dive World LLC to replace the equipment with a new or equivalent functioning unit.

I authorize Discovery Dive World LLC to charge the credit card provided at check-in for repair costs or replacement value as applicable.

I understand that exposure to saltwater, sand intrusion, impact damage, flooding due to improper assembly, failure to secure equipment, or failure to follow provided instructions constitutes damage beyond normal wear and tear.

I understand that rental equipment is revenue-producing commercial equipment and that depreciation does not apply to replacement responsibility.

 

SPEARFISHING AND SPEARGUN USE ACKNOWLEDGMENT AND LIABILITY RELEASE

I acknowledge that a speargun is a projectile weapon capable of causing serious bodily injury, paralysis, or death. I understand that the use of a speargun in the water and aboard a vessel presents additional hazards beyond normal scuba diving activities.

I certify that I am experienced in the safe handling of spearfishing equipment and agree to follow all safe handling procedures, including:

• Never loading a speargun out of the water

• Never aiming a speargun at any person, whether loaded or unloaded

• Engaging the safety mechanism whenever the speargun is not actively in use

• Keeping the speargun pointed away from my body and others at all times

• Approaching the boat with the speargun unloaded and bands relaxed

• Handing the speargun to the crew butt-first or as directed by crew members

• Maintaining full control of my catch and stringer to avoid entanglement hazards

I understand that marine life may struggle violently when speared and may cause sudden movement, entanglement, or loss of buoyancy control. I accept all risks associated with the pursuit, capture, and handling of marine life, including injury from fish spines, teeth, barbs, or defensive behavior.

I acknowledge that Discovery Dive World LLC and its crew do not supervise my hunting decisions, shot selection, range judgment, fish identification, or safe distance from other divers. I am solely responsible for maintaining safe separation from other divers and for compliance with all Florida Fish and Wildlife Conservation Commission (FWC) regulations and federal regulations regarding seasons, size limits, and protected species.

I accept full responsibility for any injury or damage caused by my use, discharge, handling, transport, or storage of a speargun, whether occurring underwater, at the surface, or aboard the vessel.

I agree to inspect all spearfishing equipment prior to use and will not use any equipment I believe to be unsafe. I assume responsibility for proper loading, unloading, band tension, shaft retention, and line routing.

I release and hold harmless Discovery Dive World LLC, its owners, employees, instructors, divemasters, captains, and contractors from any and all claims arising from the rental or use of spearfishing equipment, including negligent entrustment, equipment malfunction, or user error, to the fullest extent permitted by Florida law and federal maritime law.


FISHING LICENSE AND REGULATORY COMPLIANCE ACKNOWLEDGMENT

I understand that spearfishing and the harvest of marine life in Florida waters may require a valid Florida Saltwater Fishing License and may be subject to additional federal permits depending on the location of the dive.

I certify that I am solely responsible for determining whether I am required to possess a fishing license or permit and for obtaining and carrying all required licenses, permits, and identification while participating in any spearfishing activity.

I acknowledge that Discovery Dive World LLC, its captains, crew, instructors, and employees are not acting as fishing guides, enforcement officers, or regulatory advisors and do not verify licenses, bag limits, size limits, seasons, or protected species identification.

I agree to comply with all applicable Florida Fish and Wildlife Conservation Commission (FWC) regulations, federal regulations, and local regulations governing spearfishing, possession limits, size limits, gear restrictions, and protected species.

I accept full legal responsibility for any citation, fine, seizure, or penalty arising from my harvesting, possession, or attempted harvest of marine life.

I release and hold harmless Discovery Dive World LLC from any claims, damages, penalties, or legal consequences arising from my failure to possess required licenses or to comply with applicable fishing regulations.

STATE VS FEDERAL WATERS ACKNOWLEDGMENT

I understand that many Discovery Dive World spearfishing trips occur in federal waters offshore. I acknowledge that fishing and spearfishing regulations in federal waters may differ from Florida state waters, including species restrictions, seasons, bag limits, and gear limitations.

I agree that I am solely responsible for knowing and complying with the regulations that apply at the specific dive location and distance offshore. I understand that a fish legal to harvest in state waters may be illegal to harvest in federal waters.

I acknowledge that Discovery Dive World LLC does not provide regulatory instruction or species identification verification and that I am responsible for confirming the legality of any marine life before taking a shot.

I understand that violation of safety rules or unsafe conduct may result in termination of my participation in the charter without refund.

I have read and fully understand this Spearfishing and Speargun Use Acknowledgment and sign it voluntarily.
