Thank you for your purchase from Sigwarth Glass! This document fully explains how Sigwarth Glass supports its Wall-Mounted Art Glass Installations (“Art Installation”). It is important that you read the terms of this Limited Warranty, as it lists the terms of coverage and the period of time for which our Art Installation, and related services, are covered. Sigwarth Glass, LLC (hereinafter referred to as “Sigwarth”) is a studio specializing in the manufacture, sale, and installation of artisan glass and glass artwork. Its Art Installations come with a LIMITED TWO-YEAR WARRANTY against defects in materials or workmanship, subject to the terms and conditions set forth below. This Limited Warranty shall cover, at Sigwarth’s sole option, the repair or replacement, or the cost thereof, of all or any portion of the Art Installation sold, but shall in no event exceed the cost of the original Art Installation. No refunds shall occur without the prior written authorization of Sigwarth. Sigwarth reserves the right to require Purchaser to provide written or photographic evidence or delivery of the defective Art Installation for inspection. Sigwarth’s inspection and determination for whether the Art Installation is defective, and whether replacement and/or repair is authorized under the limited warranty shall be final. Sigwarth also reserves the right to authorize or to make all warranty repairs or replacements at its studio or at other locations designated by Sigwarth. The limited warranty applies only to Art Installations which have been manufactured and sold by Sigwarth. This Limited Warranty shall be void and unenforceable in the following circumstances: 1. The Art Installation is not installed pursuant to Sigwarth’s instructions or by an authorized representative; 2. The Art Installation is installed on defective or damaged surfaces or inadequate structures, or other installation error; 3. The Art Installation has not been properly maintained and preserved, including but not limited to following written instructions; 4. The Art Installation is damaged or destroyed by fire, flood, earthquake, ground shift, building shift, casualty event, vandalism, outdoor conditions, accident, misuse, abuse, neglect, or improper transportation, handling or storage; 5. Normal wear and tear; 6. The Art Installation is used for a purpose or in any way in which it was not designed to be used (i.e. as glass artwork); 7. Ownership of the Art Installation is transferred to any individual or group other than the original Purchaser; 8. Sigwarth fails to receive written notice of any claim to be asserted under this Limited Warranty within two (2) years of the date of purchase; 9. Alterations to the Art Installation were made by anyone other than Sigwarth; and 10. Any other cause not a result of a manufacturing defect in the Art Installation. This Limited Warranty does not cover, and Sigwarth hereby expressly assumes no responsibility and liability for: (i) any labor charges or other expenses in connection with the removal, transportation, delivery, repair or installation of the Art Installation or related materials, (ii) damages to any other property of Purchaser, (iii) damages and/or injury, including death, to Purchaser or any third party, (iv) defects in the Art Installation caused by incorrect measurements or information or by the improper selection of models based upon information provided by Purchaser or third parties, or (v) claims for loss of profits or revenue, loss of use, claims of residents, employees, licensees, or similar special, incidental, consequential damages or claims, or punitive damages arising out of or in any way connected with the Art Installation or performance of Sigwarth’s installation services hereunder and whether arising out of Sigwarth’s negligence or breach of warranty or otherwise. All Art Installations created, manufactured, and sold by Sigwarth are unique. Sigwarth, to the best of its ability, will provide a similar piece or component of the Art Installation of comparable quality or price range for approved repairs and/or replacements. Sigwarth may elect to discontinue or make changes in design, materials, installation of the Art Installation or its instruction manuals without obligation to Purchaser to provide the exact same Art Installation as initially purchased. If elected by Purchaser, Sigwarth represents and warrants that all installation services (“Services”) provided shall be performed in a workmanlike and professional manner consistent with current industry standards, and that such Services shall for a period of two (2) years following completion conform to the standard specifications; provided that Purchaser provides adequate legal access and releases and holds Sigwarth harmless from any and all damages, claims or causes of action that arise out of the performance of such Services, except as expressly provided in this Limited Warranty. In the event Purchaser finds any of the Services hereunder to be defective or nonconforming during the warranty period, subject to the limitations set forth herein, Sigwarth shall promptly correct such Services to the reasonable satisfaction of Purchaser in accordance with the foregoing warranty. In the event such corrected Services fail to comply with the express warranties stated above, then at Purchaser’s option, Sigwarth shall again promptly correct such Services or shall reimburse to Purchaser the payments made to Sigwarth. Notice of any claim under this Limited Warranty shall be sent to Sigwarth in writing by email or mail addressed to 586 Wyngate Dr, River Falls, WI 54022, or at such other address as Sigwarth shall subsequently designate in writing. Sigwarth disclaims any warranty, expressed or implied, as to the nature, quality, merchantability, or fitness for any particular purpose of the Art Installation, including any metal support structures used therein, sold to Purchaser; and shall not have any liability with regard to the design, structural security, or installation or failure of these structures. THIS DOCUMENT CONSTITUTES THE EXCLUSIVE WARRANTIES AND REMEDIES PROVIDED BY SIGWARTH. THE WARRANTIES AND REMEDIES CONTAINED IN THIS DOCUMENT ARE EXPRESSLY IN LIEU OF ANY AND ALL OTHER OBLIGATIONS, GUARANTEES AND WARRANTIES, WHETHER WRITTEN, ORAL OR IMPLIED BY STATUTE OR AT LAW. THERE ARE NO OTHER WARRANTIES EXPRESSED OR IMPLIED WHICH EXTEND BEYOND THAT LISTED ABOVE WHICH ARE CREATED BY ANY MEANS, INCLUDING ORAL OR WRITTEN REPRESENTATIONS, AFFIRMATIONS, PROMISE, COURSE OF DEALING, DESCRIPTION OR USAGE OF TRADE, SPECIFIFICALLY INCLUDING MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. STATE LAW WILL DETERMINE THE PERIOD OF TIME FOLLOWING THE SALE THAT A PURCHASER MAY SEEK A REMEDY UNDER THE IMPLIED WARRANTY OF MERCHANTABILITY FOR FITNESS FOR A PARTICULAR PURPOSE. SIGWARTH’S OBLIGATIONS, RESPONSIBILITIES AND LIABILITY SHALL BE LIMITED TO REPAIRING OR REPLACING THE DEFECTIVE ART INSTALLATION AS SET FORTH IN THIS LIMITED WARRANTY. IN NO EVENT SHALL SIGWARTH BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING ANY DAMAGE TO THE ART INSTALLATION, PURCHASER’S REAL PROPERTY, OR ITS CONTENTS, OR FOR INJURY TO ANY PERSONS, THAT MAY OCCUR AS A RESULT OF THE USE OF SIGWARTH’S ART INSTALLATION OR AS A RESULT OF THE BREACH OF THIS WARRANTY. IF YOUR STATE DOES NOT ALLOW EXCLUSION OR LIMITATIONS OF SPECIAL, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES, THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. IN NO EVENT SHALL SIGWWARTH BE LIABLE TO YOU OR ANY OTHER PARTY FOR LOSS, DAMAGE, OR INJURY OF ANY KIND OR NATURE ARISING OUT OF OR IN CONNECTION WITH THESE TERMS AND CONDITIONS IN EXCESS OF THE NET PURCHASE PRICE OF THE ART INSTALLATION ACTUALLY DELIVERED TO AND PAID FOR BY YOU HEREUNDER. YOUR SOLE REMEDY AGAINST SIGWARTH IN ANY DISPUTE UNDER THIS AGREEMENT SHALL BE TO SEEK RECOVERY OF THE AMOUNTS YOU HAVE PAID, AND UPON THE PAYMENT OF WHICH THEY SHALL BE RELEASED FROM AND DISCHARGED OF ALL FURTHER OBLIGATIONS AND LIABILITY TO YOU. This Limited Warranty may not be modified, altered or expanded by anyone. This Limited Warranty gives you specific legal rights, and you may also have other rights which vary from State to State.
