VERO BEACH CLAY SHOOTING SPORTS RULES & RELEASE

And associated entities/releases: Vero Beach Clay Shooting Sports LLC, 
Elite Shooting Sports LLC, Indian River Trap & Skeet, Inc.

Shooting rules will be strictly enforced. Anyone who shoots or is a spectator at Vero Beach Clay Shooting Sports must have on file a signed and witnessed copy of these rules and release. Shooting or spectating without having signed this agreement will be considered to consent to its terms and conditions with or without a signature. Shooters and spectators who have not previously used the facilities must identify the fact on their initial visit to the club. The following applies to all shooters and to those who are signing on behalf of minors, collectively, “participants”.

  1. The participant (whether MINOR by PARENT or GUARDIAN or ADULT) HEREBY ASSUME FULL RESPONSIBILITY FOR AND RISK OF BODILY INJURY, DEATH OR PROPERTY DAMAGE due to negligence of releases (as identified below) or otherwise, while in or on VBCSS property for any purpose. The undersigned recognize and understand that there are risks and dangers associated with participation or observation of shooting sports that could cause severe bodily injury, disability, and death. Further, the risks and dangers may be caused by the negligent failure to act of the releases’ and others. All the risks associated with participating in the event/and or entry into the property are assumed and notwithstanding.

The participant (whether MINOR or by PARENT or GUARDIAN or ADULT) release, waive, discharge and convent not to sue the releases’ associations, sanctioning organizations (or any affiliates thereof) range operators, range owners, officials, owners, lessees and lessees of the premises, and for each of them their officers, agents and employees (all for the purpose herein referred to as (“releasees’”), from all liability to ourselves, the undersigned’s, our personal representatives, assigns executors, heirs, and next of kin for any and all claims, demand losses or damages of the participant (whether MINOR or GUARDIAN or ADULT) on account of any injury, including, but not limited to death or injury of the participant (whether MINOR or GUARDIAN or ADULT), all of which is caused or alleged to be caused by negligence of the releasees or otherwise.

The participant (whether MINOR or GUARDIAN or ADULT) hereby agrees to indemnify release and ahold harmless, the releasees and each of them from any loss, liability, damage or cost they may occur due, in any manner or degree, to the presence of the parent/guardian or the participant (whether MINOR or GUARDIAN or ADULT), or related in any way to their participation in or presence premises and whether caused by negligence if of releasees or otherwise. The parent and/or guardian further recognize and agree they are executing this waiver and releases of liability and indemnity agreement on behalf of the participant.
  6. This release and waiver of liability, assumption of risk and indemnity agreement extends to all acts of negligence by the releasees. INCLUDING NEGLIGENT RESCUE OPERATIONS as is intended to be as broad and inclusive as permitted by the laws of Florida and that If any portion thereof is held invalid. It is agreed that the balance shall, notwithstanding, continue in full legal force and effect. The participant also agrees to follow all rules, as well any updated or changed rules which may be posted about the property. Think ‘SAFETY FIRST & ALWAYS’. There will be no loaded guns to and from shooting ranges/sporting clays course. Guns can only be loaded at the shooting station after the area is secure. Keep loaded guns always pointing in a safe direction. When not on a shooting station your gun must be carried unloaded and with the action open at all times. There will be no shooting at any other location at Vero Beach Clay Shooting Sports property other than sporting clays, trap, skeet & 5 stand ranges. Shooting of animals and birds is strictly forbidden whilst on Vero Beach Clay Shooting Sports property. Only one shooter in a station at one time. All other shooters and/or spectators must stay in safe areas behind shooting stations. All shooters and spectators must wear eye and ear protection at all times. A maximum of 2 shells in a shotgun at any one time. No shells larger than 12 gauge with 3 drams of powder and shot size larger than 7 ½. In case of a misfire, keep gun pointed down range for 30 seconds with the action closed before trying to correct the situation. There will be no alcoholic beverages or narcotics or other prohibited substances on any range at any time. Anyone appearing to be intoxicated will not be allowed on the course. Children must be supervised by adults at all times, children under 15will not be allowed to use golf carts. No one is allowed in restricted areas off the pathways at any time. Please no littering, place empty shells in the bins provided: empty hulls on the ground are property of the club. NEVER make an attempt to repair any machine or equipment, call -office at 772-978-0935, a member of staff will make the repair.

 Failure to follow these rules and any unsafe or un-sportsman like conduct will result in the shooters removal from the grounds.
