IMPORTANT: READ CAREFULLY — THIS WAIVER AFFECTS YOUR LEGAL RIGHTS. BY SIGNING THIS AGREEMENT, YOU ARE INTENTIONALLY RELINQUISHING CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO RECOVER DAMAGES FOR PERSONAL INJURY, DEATH, OR PROPERTY DAMAGE.

SECTION 1 - INTRODUCTION & ACKNOWLEDGMENT OF RISK

I (“Renter”), the undersigned adult (18+) or parent/legal guardian of a minor participant, acknowledge that the use of boats, personal watercraft, and related equipment involves inherent and significant risks, including serious injury, death, or property damage.

Equipment includes boats, personal watercraft, and all related accessories (“Equipment”). Recreational Use includes boating, towing, swimming, trailering, transport, and all related activities.

Use occurs in environments not controlled by EDGE MARINE (SALTY SQUAD RENTALS), including lakes, marinas, ramps, roads, highways, parking lots, transport environments and surrounding areas (“Use Locations”), and involves risks including but not limited to water conditions, weather, terrain, docks, other vessels, and submerged hazards.

SECTION 2 - BAREBOAT RENTAL ACKNOWLEDGEMENT

This rental is a bareboat (demise) charter. Renter has exclusive possession, command, and control of the Equipment during the rental period. EDGE MARINE (SALTY SQUAD RENTALS) provides equipment only and does not provide a captain or crew. Renter is solely responsible for operation, navigation, and safety of the vessel and all passengers.

SECTION 3 - OPERATOR QUALIFICATIONS & RESPONSIBILITY

For boats, including surf boats and pontoons:

  • passengers of all ages are permitted onboard
  • all operators must be at least twenty-four (24) years of age
  • all operators must possess a valid driver’s license

For personal watercraft (“PWC”), including waverunners and jet skis:

  • operators under fourteen (14) years of age are not permitted to operate the Equipment under any circumstances
  • operators between fourteen (14) and seventeen (17) years of age must comply with all applicable Utah, Arizona, federal, and National Park Service boating laws, supervision requirements, and boating education requirements
  • operators eighteen (18) years of age or older may operate the Equipment unless otherwise prohibited by applicable law

For Utah waters, operators between fourteen (14) and seventeen (17) years of age may be required to complete a Utah State Parks approved boating education course and operate under required supervision. Approved Utah boating education courses are available at: Utah Boating Education Courses. Arizona boating laws and education requirements may also apply on Lake Powell depending on location and operation.

EDGE MARINE (SALTY SQUAD RENTALS) reserves the right to prohibit operation by any minor operator regardless of state minimum legal requirements. Renter acknowledges that operation of the Equipment requires understanding and compliance with applicable federal, state, local, and National Park Service boating laws and regulations.

EDGE MARINE (SALTY SQUAD RENTALS) reserves the right to refuse service to any person who:

  • does not demonstrate adequate boating knowledge or experience
  • appears incapable of safely operating the Equipment
  • is unwilling or unable to comply with boating laws or operational instructions

Renter confirms all operators are experienced with similar vessels and capable of safely operating, docking, maneuvering, and loading/unloading the Equipment. EDGE MARINE (SALTY SQUAD RENTALS) provides only basic operational orientation. Lack of experience does not reduce liability. Renter and/or operators are solely responsible for any citations, fines, penalties, impound fees, or legal violations incurred during the rental period. If opting to tow, trailer and transport, Renter further confirms any person towing is experienced and capable of safely trailering and transporting the Equipment.

SECTION 4 - LAUNCH & RETRIEVAL RESPONSIBILITY

Launch and retrieval may occur through:

  • Antelope Point Marina Valet Services
  • or other public launch ramps within Lake Powell

Renter/operator is solely responsible for:

  • driving the boat off the trailer at launch
  • driving the boat onto the trailer at retrieval
  • safely maneuvering near ramps, docks, trailers, and other vessels

No third party, including valet personnel or EDGE MARINE (SALTY SQUAD RENTALS), will operate or assist in operating the boat. Renter assumes full responsibility for any damage resulting from improper loading, unloading, misalignment, or collision. Any assistance provided by Edge Marine (Salty Squad Rentals) or third parties is incidental and does not transfer or reduce Renter responsibility. Renter acknowledges that launch and retrieval involve tight maneuvering, variable water conditions, and inherent risks.

Valet services at Antelope Point are subject to a $50 per launch/retrieval fee. One (1) launch/retrieval is included with each rental. Additional launches or retrievals are the responsibility of the Renter and paid directly to valet. Renter acknowledges that launch and retrieval involve tight maneuvering, varying water conditions, wind, and other inherent risks.

SECTION 5 - TRAILER TOWING & TRANSPORT RESPONSIBILITY

If Renter elects to tow the Equipment using their own vehicle, Renter acknowledges and agrees that:

  • Renter is solely responsible for towing, transporting, backing, parking, launching, and retrieving the trailer and Equipment
  • Renter is responsible for ensuring their tow vehicle is properly rated, equipped, insured, and capable of safely towing the Equipment
  • Renter assumes all risks associated with towing and transport, including road hazards, backing incidents, trailer sway, tire failure, collisions, loading errors, and damage occurring during transport

Renter is fully responsible for:

  • damage to the trailer or Equipment during towing or transport
  • damage caused to other vehicles, property, or persons
  • citations, towing violations, impound fees, or traffic violations
  • proper connection and operation of trailer lights, safety chains, straps, winches, and tie-down equipment

EDGE MARINE (SALTY SQUAD RENTALS) does not guarantee the suitability of the Renter’s tow vehicle or towing experience and provides no warranty regarding towing safety or compatibility. Any assistance or guidance provided by EDGE MARINE (SALTY SQUAD RENTALS) regarding towing or trailer hookup is incidental only and does not transfer responsibility to EDGE MARINE (SALTY SQUAD RENTALS).

SECTION 6 - CONDITION & INSPECTION

Renter agrees to inspect Equipment prior to use. Use constitutes acceptance of condition.


SECTION 7 - DAMAGE, LOSS & INSURANCE RESPONSIBILITY

EDGE MARINE (SALTY SQUAD RENTALS) maintains commercial insurance coverage on each watercraft during the rental period, subject to a deductible.

Renter is financially responsible for all damage or loss occurring during the rental period.

  • Damages less than or equal to the security deposit will be deducted from the deposit
  • For damages exceeding the deposit, the deposit will be applied toward the insurance deductible
  • Insurance may be used for covered losses beyond the deductible

Renter remains financially responsible for any costs not covered by insurance, including but not limited to:

  • amounts exceeding policy limits
  • excluded damages
  • additional repair, recovery, or associated costs

If total costs exceed the deposit and applicable insurance coverage, Renter authorizes EDGE MARINE (SALTY SQUAD RENTALS) to charge the remaining balance to the card on file or pursue collection as permitted by law.

SECTION 8 - SECURITY DEPOSIT

A security deposit is required at the time of booking to secure the reservation and is not applied toward the rental fee.

The deposit is held throughout the rental period and released after the Equipment is returned, inspected, and all applicable services are completed.

The deposit may be applied to:

  • damage to the Equipment
  • insurance deductible obligations
  • excessive cleaning charges
  • fuel charges
  • late return fees
  • lost or missing equipment
  • other costs incurred during the rental period

Charges incurred during the rental period may exceed the amount of the security deposit.

If the deposit is insufficient to cover all charges, Renter authorizes EDGE MARINE (SALTY SQUAD RENTALS) to charge the remaining balance to the card on file.

SECTION 9 - CLEANING, FUEL & ADDITIONAL FEES

Standard cleaning is included with each rental. Additional charges apply only for excessive cleaning, including trash, spills, stains, or abnormal wear.

Fuel Policy. The boat is provided with a full tank and must be returned full. Renter may: 

  • Refuel at the marina, or
  • Request EDGE MARINE (SALTY SQUAD RENTALS) to refuel in town

If EDGE MARINE (SALTY SQUAD RENTALS) refuels the boat:

  • Fuel cost will be deducted from the deposit, or
  • Reimbursed via an agreed payment method (e.g., Venmo)

Additional Fees:

  • Cleaning: $60/hour (max $240)
  • Late return: $60/hour
  • Replacement items: at cost

SECTION 10 - CANCELLATION POLICY

Direct Bookings through EDGE MARINE (SALTY SQUAD RENTALS):

  • 30+ days before rental: Full refund of deposit and any rental payments collected.
  • 15–29 days before rental: Deposit is non-refundable. If the total rental amount is less than the deposit, forfeiture will be limited to the total rental amount.
  • 14 days or less before rental: 100% of the total rental amount is non-refundable. Any security deposit collected may be applied toward the outstanding rental balance, and Renter authorizes EDGE MARINE (SALTY SQUAD RENTALS) to charge the remaining balance owed to the card on file.

Renter authorizes EDGE MARINE (SALTY SQUAD RENTALS) to charge the card on file for cancellation amounts owed under this Agreement, regardless of whether payment was previously collected.


Third-Party Bookings

Reservations made through third-party platforms, including but not limited to Boatsetter or Getmyboat, are subject to the cancellation, refund, payment, and dispute policies of the applicable platform, which supersede any conflicting provisions in this Agreement.


Weather, Mechanical Issues & Early Returns

For day rentals only, if cancellation or early termination is caused solely by:

  • unsafe weather conditions, as determined by EDGE MARINE (SALTY SQUAD RENTALS), or
  • a verified mechanical failure not caused by the Renter or passengers,

then rental payments may:

  • be applied toward a future rental date, or
  • be prorated based on time used, at the sole discretion of EDGE MARINE (SALTY SQUAD RENTALS).

No refunds, credits, or prorated adjustments will be issued for:

  • late arrivals
  • early returns
  • weather conditions deemed safe for operation
  • renter inexperience or discomfort operating the vessel
  • renter-caused damage or misuse
  • grounding, propeller damage, water ingestion, towing incidents, collision, improper operation, or other operator-caused issues

Determination of whether damage or mechanical failure was caused by renter misuse or operator error shall be made solely by EDGE MARINE (SALTY SQUAD RENTALS).

SECTION 11 - DECONTAMINATION REQUIREMENT

Required only if the boat leaves Lake Powell and is used in another body of water during the rental period.


SECTION 12 - PROHIBITED ACTIVITIES

Prohibited activities include but are not limited to:

  • operating under the influence
  • reckless or unsafe operation
  • operating after sunset
  • exceeding capacity limits
  • beaching the boat
  • smoking onboard
  • towing with improperly rated vehicle
  • unsafe towing
  • towing by unauthorized drivers 

Violation may result in termination and forfeiture of rental fees.


SECTION 13 - SAFETY & LEGAL COMPLIANCE

Renter must comply with all laws and safety requirements, including life jacket regulations.

SECTION 14 - RELEASE, WAIVER & INDEMNIFICATION

Renter releases EDGE MARINE (SALTY SQUAD RENTALS) from all liability, including negligence. Renter agrees not to sue and agrees to indemnify and hold harmless EDGE MARINE (SALTY SQUAD RENTALS) from any claims arising from use of the Equipment.
