Please read this document carefully and in its entirety. It is a binding agreement between myself and the Trustees of Boston University (BU). This agreement contains important information for and your obligations in relation to engaging in rock climbing. In consideration of being allowed to use BU’s rock wall or otherwise participate, I acknowledge and agree to the following: Use of the rock wall and rock climbing can be dangerous and involve the inherent risk of serious injury or death. The inherent risks of using the rock wall and participating in rock climbing activity include, but are not limited to: (1) misuse of the climbing walls, equipment or facilities; (2) falls and abrupt and possibly harmful contact with persons, structures and objects (fixed and moveable), including rock wall and rock features, volumes, holds, ropes, equipment (including dropped equipment during route setting or otherwise), flooring, mats and other surfaces; (3) failures of the rock wall structure, climbing equipment, mats, holds, harnesses, auto belays and exercise equipment; (4) injuries and health problems, including exhaustion, heart attack, sprains, strains, scrapes, contusions, cuts, abrasions, fractures, back injuries, paralysis and death; (5) transmission of disease; and (6) lack of training and conditioning. Participants (climbers and belayers) have the responsibility for managing all such risks, supervised or not. Participant is fully responsible for his/her own expertise. While BU offers orientation and training for use of the rock wall, participants bear the responsibility for duly seeking out and completing and understanding training materials before using the rock wall or belaying. Participants also agree to seek out and complete any retraining or refresher courses should they consider it necessary at any time. Participant understands that floor padding/mats cannot eliminate or even completely mitigate the risk of serious injury or death. Participants agree that the climbing floor padding and other protections may only partially mitigate and do not eliminate all risk of serious injury or death. I understand that a fall from any height can cause injury. I understand that it is my responsibility to practice landing and to be aware of my landing zone at all times while climbing. These and other risks are inherent to the activities and cannot entirely be disassociated from participating in rock climbing activities. To the maximum extent permissible under the law, I hereby acknowledge and assume, expressly and through this Agreement, the risks described above and their inherency, and that other risks, known and unknown, inherent and otherwise, may be encountered. I have read and understood the rules and regulations of the BU rock wall and I acknowledge and agree to the following: • I have received a demonstration of and will use proper landing technique. • I understand that I must pass a belay certification test prior to belaying a climber, and that I must not top rope belay without a valid BU Rock Wall belay certification. • I have consulted with my physician and I am physically able to participate in rock climbing. • I am not pregnant, nor do I have a history of high blood pressure or a heart condition. • I have or will perform a safety check on all the equipment prior to the use of such equipment. • When climbing, I will tie in using the rewoven figure eight knot and if the tail is longer than 6” in length (about two fists) I will tie the tail with a double overhand knot. • When belaying, I will belay from an UIAA-approved harness using a belay loop and not from a fixed anchor point. • I will not sit or lie down while belaying. • I am 18 or older. • Route setting shall be performed only by BU employees. To the maximum extent permissible under the law, I agree to indemnify the Trustees of Boston University and its employees from any claim and from any liability, loss, damages or expenses (including attorneys’ fees) resulting from my breach of this agreement and any failure to comply with rules of the facility or instruction given by employees of BU. |
