A.                             INDEMNIFICATION AND INSURANCE

1.  User shall assure, defend, and hold harmless Vision Sports and its employees, directors, officers and agents from any and all losses, costs, expenses, claims, liabilities, actions, or damages, including liability for injuries to any person or persons or damage to property arising at any time during and/or arising out of or in any way connected with User’s or Organization or its members use or occupancy of the Facility and adjoining property, howsoever caused by any of them.

2.  Users shall report any personal injuries or property damage arising at any time during and/or arising out of or in any way connected with User’s use or occupancy of the Facility and adjoining property to the main office in writing as soon as damage or injury occurs.

3.  User waives any right of recovery against Vision Sports and its employees for indemnification, contribution, or declaratory relief arising out of or in any way connected with User’s use or occupancy of the Facility and adjoining property, even if Vision Sports and its employees seek recovery against the User.

4.  User is solely responsible for supervising all their Participants at the Facility during the event and for having each member Participant properly complete and execute the Facility standard Participant Agreement and to provide all such executed Participant Agreements to Vision Sports.  Vision Sports Centre is not responsible for providing this supervision. However, Vision Sports Centre may evict Participants from the Facility during their event if a Participant’s or Organization’s conduct is considered not in the best interest of the Facility, public, or is deemed to be detrimental to the safety of patrons of the Facility in any way.

5.  Vision Sports Centre pays to rent out the parking lot to the west of the Facility on evenings and weekends for overflow parking. Users are to respect and adhere by the no parking signs. VEHICLES WILL BE TOWED IF IN FRONT OF NO PARKING ZONE.


B.                            MISCELLANEOUS

1.  Smoking is permitted at the Facility, but MUST SMOKE 5M AWAY FROM ANY OUTSIDE ENTRANCE OF THE BUILDING.

2.  Users are not permitted to bring animals inside the facility, with the exception of guide dogs.

3.  If User violates any part of this Agreement or reports false information to Vision Sports Centre, they may refuse User future use of the Facility and User shall forfeit a portion of or all of the Facility Use Fee and/or Deposit.

4.  User agrees to abide by all current rules and regulations of Vision Sports Centre and all amendments thereto immediately upon adoption and posting at www.visionsportscentre.com and that a copy of the current Rules and Regulations has been reviewed by User and Vision Sports Centre may impose additional requirements as deemed necessary to protect the health, safety, and/or welfare of the community and Facility.

5.  If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Parent(s) or Court-Appointed Legal Guardian(s) must sign for any participating minor (those under 18 years of age) and agree that they and the minor are subject to all the terms of this document, as set forth above.
