WAIVER OF LIABILITY

PLEASE READ CAREFULLY AND COMPLETELY BEFORE SIGNING.

After consideration of and being permitted to participate in any way in the martial arts programs indicated below, the participant (18+ years old), parent(s) and/or legal guardian(s) of the minor participant named agree:

1. The participant or the parent(s) and/or legal guardian(s) of the participant fully understand and acknowledge that:

  (a) Velocity Grappling LLC it's successors assigns, owners, officers, directors, employees, landlords, volunteers, patrons and agents (“Releasees”) teach reality-based martial arts. These martial arts include grappling, jiu-jitsu, wrestling and striking. Training and classes in these martial arts may include an instructional portion, practicing with other participants, and live sparring. Injuries to bones, joints, muscles, and internal organs are not uncommon during training.

  (b) There are many risks and dangers associated with participation in martial arts events and activities, which could result in bodily injury, partial or total disability, paralysis, and death.

  (c) The social and economic losses and damages, which could result from these risks and dangers described above, could be severe.

  (d) These risks and dangers may be caused by the action, inaction, or negligence of the participant or the action, inaction or negligence of others, including, but not limited to, other participants or the Releasees.

  (e) There may be other risks not known to the Releasees and that the Releasees are not responsible for.

2. The participant or the parent(s) and/or legal guardian(s) of the participant will instruct the participant that, prior to participating in the below martial arts activities or events, he or she should inspect the facilities and equipment to be used, and if he or she believes anything or any activity is unsafe, the participant should immediately advise the Releasees of such condition and refuse to participate. The participant or the parent(s) and/or legal guardian(s) of the participant understand and agreed that, if at any time, they feel anything to be unsafe, they will immediately take all precautions to avoid the unsafe area or activity and refuse to participate further.

3. The participant or the parent(s) and/or legal guardian(s) of the participant accept and assume such risks and responsibility for the losses and/or damages following any and all injuries, both physical and mental, to include: disability, paralysis or death, however caused and whether caused in whole or in part by the negligence of the Releasees.

4. The participant or the parent(s) and/or legal guardian(s) of the participant hereby release, waive, discharge, covenant not to sue, and indemnify the Releasees from all liability to the undersigned, and the undersigned’s personal representatives, assigns, executors, heirs and next to kin for any and all claims, demands, losses, or damages, and any claims or demands therefore on account of any injury, including but not limited to the death of the participant or damage to property, arising out of or relating to the martial arts activities caused or alleged to be caused in whole or in part by the negligence of the Releasees or otherwise.

5. The participant or the parent(s) and/or legal guardian(s) of the participant acknowledge that the martial arts activities are very dangerous and involve the risk of property damage, serious injury, and death. The undersigned also expressly acknowledges that injuries received during martial arts activities may be compounded or increased by negligent rescue operations or procedures of the Releasees, and hereby indemnifies the Releasees against any legal expenses or claims brought by the participant or the parent(s) and/or legal guardian(s) of the participant.

6. EACH OF THE UNDERSIGNED further expressly agrees that the foregoing release, waiver, and indemnity agreement intended to be as broad and inclusive as is permitted by the law of the State in which the martial arts programs are conducted. If any portion is held invalid, It is agreed that the balance shall, notwithstanding continue in full legal force and effect.

7. The participant or parent(s) and/or legal guardian(s) for the minor participant executes this Waiver and Release of Liability and Indemnity Agreement. If despite this agreement, the participant or the parent(s) and/or legal guardian(s) on behalf of the participant, makes a claim against any of the Releasees, the participant and/or the participant’s parent(s) and/or legal guardian(s) will indemnify Releasees and reimburse the Releasees for any legal and non-legal expenses related to the claim, including any money which the Releasees pay as a result of the claim, and hold the Releasees harmless.

8. The participant or the parent(s) and/or legal guardian(s) of the participant hereby acknowledges and understands that martial arts are physical activities and learning self-defense skills involves physical contact. The Releasees are not to be held liable or responsible for any risks and/or injuries as a result of training in martial arts. The undersigned consents to the participant participating in the classes and training and are aware of the risks involved in such use.

9. The people stated in this contract hereby hold the Releasees harmless from all claims which may be brought against them by the people stated in this contract, student or on the student's behalf for any such injuries or claims and do hereby forever release and discharge the Releasees from all claims, demands, injuries, damages, actions, losses and expenses.

Photo/Video release: Any and all photos and videos taken are for training and promotional use, to be used and owned by Velocity Grappling LLC. 

I HAVE READ THIS RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND HAVE SIGNED IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT, ASSURANCE, OR GUARANTEE BEING MADE TO ME AND INTEND MY SIGNATURE TO BE COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW, AND AGREE TO INDEMNIFY THE RELEASEES AND REIMBURSE THE RELEASEES FOR ANY LEGAL EXPENSES OF THE RELEASEES BASED ON CLAIMS I BRING OR ARE BROUGHT ON MY BEHALF.
