PINK PONY PEDAL PUB WAIVER


By Agreement below, I affirm that I have read, understand, and agree with all requirements of this waiver.

 

All participants must be at least 21 years old and present a valid photo ID when signing this agreement and boarding the ride.

The 16 passenger Pink Pony ™ Party Bikes are BYOB. Alcohol is optional and not required for participation in the tour. While Alcohol is allowed in accordance with local ordinance, “hard” liquor (Over 10% ABV) and Jell – O shots are prohibited.  Please only bring beverages in plastic or aluminum containers. Beverages brought in glass containers will not be allowed on board. Smoking is prohibited.

 

All riders are required to remain on board while the party bike is in motion. Riders, except for the assigned “bartender” located in the middle of the bike, are required to remain seated, and always facing forward, while the vehicle is in motion. Disembarkment is only allowed when the bike is not in motion, and only with the knowledge and express permission of the driver.

 

Riders are instructed to dispose of trash only in the designated receptacles provided on the bike. No trash may be disposed of in public or private areas which may be considered litter.

 

In the event of inappropriate behavior, as determined by the driver's sole discretion, riders may be asked to disembark. Examples of such behavior include extreme intoxication, excessive noise, public urination/vomiting, foul language, aggressive or violent actions, and sharing alcohol with non-passengers. Riders ordered to disembark must follow the driver's instructions, and their tour payment will be non-refundable.

 

Riders are responsible for adhering to local and state laws, ordinances, rules and regulations before, during, and after the tour. This includes rules regarding alcohol consumption and public intoxication. Illicit drugs are strictly prohibited. Riders indemnify Protozoa LLC, dba Pink Pony, and its employees from civil damages or criminal fines resulting from the actions of the tour participants, the public, and all Protozoa LLC representatives.

 

All riders must disembark within 5 minutes after the completion of the tour.

 

By participating in the Pink Pony Dream tour™, I acknowledge the risk of personal injury, whether caused by myself, another person, natural or manmade events. I accept this risk and release Protozoa LLC, dba Pink Pony Pedal Pub™, its employees, agents, and owners from any claims related to injury, damage, or loss of personal property, even if caused by negligence on the part of Pink Pony Pedal Pub and/or its employees.

 

I confirm that I have been offered a free helmet for use during the tour. I confirm that I have chosen not to wear one.

 

I confirm that I have been made aware of the seat belts and encouraged to always wear them on the bike. I confirm that I have chosen not to wear one.

 

I confirm that the cardholder which booked the tour MUST be present at the time of the tour and must display their ID and the credit card used to book the tour PRIOR to the tour start time. The cardholder does not need to join the tour, however, if the card and ID are not confirmed prior to the start of the tour the tour with either be rebooked with a card by a present tour attendee, or the tour will be cancelled and the full amount forfeited.

 

I grant Pink Pony™, its legal representatives, and assignees the irrevocable right to use and publish photographs, videos, or other media capturing the tour, guests, and attendees for advertising, stock, commercial purposes, or any other medium. I release Pink Pony and its representatives and assignees from any claims or liability associated with the mentioned media.
