EQUINE RULES, RELEASE, AND ASSUMPTION OF RISK AGREEMENT
Please read and comply with these safety rules while you enjoy your stay at Black Horse Resort Ranch, and sign below for yourself and any minors in your care. This agreement shall be governed by the laws of the State of Florida, and any legal action shall be brought in Marion County, Florida. If any portion of this agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect.
Stable Name: Black Horse Resort Ranch (hereinafter referred to as “THIS STABLE”)
Location: 22651 SE Highway 42, Umatilla, FL 32784 The terms “RIDER” and “OWNER” refer to the owner, part-owner, borrower or lessee of the animal(s) brought onto the property. The terms “BOARD” and “BOARDING” refer to the occupation of physical space at THIS STABLE for equines by any party who owns, leases, borrows, maintains, or otherwise has access to equines on the property. The term “RIDER” refers to any person who rides, handles, or approaches a horse, whether mounted or unmounted. The terms “I,” “ME,” or “MY” refer to the participant and, in the case of a minor, the participant’s parent(s) or legal guardian(s). By signing this document I agree to all signage posted at facility and these listed Safety Rules:- A Negative Coggins test is required upon arrival and before unloading any horse from a trailer.
- All horses entering the premises must be free of transmissible diseases, effectively dewormed, and current on vaccinations for tetanus and rabies.
- A Health Certificate is required for any horse that has crossed state lines prior to arrival.
- No horse should ever be loose. All horses must be tied, in a stall, or in a paddock at all times.
- Riders under age 16 are required by Florida law to wear an ASTM-standard equestrian helmet.
- Horse care is the responsibility of owner. Please bring your own feed, hay, bedding, buckets.
EVENT RELEASE, WAIVER OF LIABILITY, AND INDEMNITY AGREEMENTWARNING: UNDER FLORIDA LAW, AN EQUINE ACTIVITY SPONSOR OR EQUINE PROFESSIONAL IS NOT LIABLE FOR AN INJURY TO OR THE DEATH OF A PARTICIPANT IN EQUINE ACTIVITIES RESULTING FROM THE INHERENT RISKS OF EQUINE ACTIVITIES. (Florida Statute § 773.01-773.06) I understand and acknowledge that horseback riding, handling, and being around horses involve inherent risks, including but not limited to the risk of being bitten, kicked, thrown, stepped on, or otherwise injured. These risks exist regardless of a horse’s age, training, temperament, or history. I voluntarily assume all risks associated with my participation in any equine-related activities on the premises of Black Horse Resort Ranch LLC, both for myself and for any minor(s) in my care or supervision. I further understand that all participation or observation of activities on this property is done at my own risk. I agree not to hold Black Horse Resort Ranch LLC, its owners, officers, employees, landowners, agents, or representatives liable for any injury, death, property damage, or other loss that may occur while on the premises or participating in any equine activity. In consideration of being permitted to participate in or observe equine activities on this property, I hereby fully and forever release and discharge Black Horse Resort Ranch LLC, Danielle Cosgrove, and all associated parties from any and all claims, demands, actions, or liabilities of any kind—known or unknown—that may arise from or relate to such participation
