The Game Show Experience Waiver

ASSUMPTION OF RISK, WAIVER, AND RELEASE OF LIABILITY

In exchange for participation in the interactive entertainment activities organized by The Game Show Experience LLC (hereinafter referred to as “GSE”) and use of its property, facilities, and services.

I agree to the following:

1. I agree to use GSE facilities in a safe and responsible manner. I agree to abide by GSE posted rules, warnings and instructions, and to follow any oral instructions or directions given by GSE employees, representatives or agents. I acknowledge that those rules, instructions, warnings and directions are intended to promote the safety of myself and others. My failure or refusal to abide by those rules, instructions, and directions can lead to the immediate revocation of my right to use GSE and its facilities, without any right to refund of any payments made. In the event of sickness, accident, or injury, I will immediately report my injury to the GSE staff and I will cease all participation in GSE activities at that time of sickness, accident or injury. I authorize the GSE employees and representatives to obtain and secure, on my behalf, emergency medical treatment and transportation, when deemed appropriate by GSE and representatives, and I agree to assume, at my expense, all costs of emergency medical care and transportation. I further declare that I am physically fit, sound, and suffering from no condition, impairment, disability, disease, infirmity, or illness that should prevent my participation in any activity offered by GSE. 

2. I authorize GSE, and its successors to capture my image, likeness, and sounds in photographs, videotapes, recordings or other forms of media (“Images”). I acknowledge that GSE will own such Images and I grant permission, without compensation, for GSE, or any affiliated party of the GSE brand, to copyright, display, publish, distribute, use, modify and print such Images in any lawful manner, including without limitation, in publications, advertisements, brochures, web sites, social media, and other electronic displays and transmissions thereof.

3. I recognize and understand that my participation in the interactive entertainment activities organized by GSE includes varying degrees of risk, and I willingly assume full responsibility for any and all risks that I am exposing myself to as a result of my participation in these experiences. I accept full responsibility for any injury to myself that may result from participation in any activity offered by GSE. By participating in any activity offered by GSE, I do so entirely at my own risk, and I release and discharge GSE and its owners, employees, representatives, agents, and any third parties from any liability for any injuries I may sustain, and further release GSE for any loss to others or third parties. 

4. I agree and acknowledge that GSE may host some events and activities which employ the use of reduced and/or altered theatrical lighting, flashing lights, strobe lights, colors, smoke and other special effects. I recognize that some individuals have an increased sensitivity to such special effects which can induce seizures, migraines or other ailments leading to serious physical or emotional injury. If I am pregnant, have a heart condition or am aware of health concerns relating to my exposure to such special effects, I will not participate in the activity. If I am not pregnant, do not have a heart condition or am not aware of any health concerns relating to my exposure to such special effects, I choose to voluntarily participate in the event, solely and exclusively, at my own risk, and that by participating, I waive the right to seek damages for any injuries that occur.  

5. I agree to pay full damages to the facilities of GSE caused by my negligent, reckless or willful conduct and actions.

6. I understand that I can be removed from GSE if I am causing a disturbance, and will not receive a refund.

7. I understand that if I arrive over 15 minutes or more late past my scheduled booked show time, that my show can be canceled with no refund. 

8. I understand I will not be on a television show. I also understand GSE has no affiliation or endorsement with any other company including televised game shows.


WAIVER AND RELEASE OF LIABILITY


In full consideration of the above mentioned risks and hazards and in full consideration of the fact that I am willingly and voluntarily participating in the experience provided by GSE, and with my full understanding of all of the above, I hereby waive, release, and discharge GSE and its agents, principals, employees, and volunteers, of any and all liability, claims, demands, actions or rights of action, or damages of any kind related to, arising from, or in any way connected with, my participation in GSE activities, including those allegedly attributed to the negligent acts or omissions of GSE.


Should GSE, or anyone acting on its behalf, be required to incur attorney’s fees and costs to enforce this agreement, I agree to reimburse them for such fees and costs. I further agree to indemnify and hold harmless GSE, their principals, agents, employees, and volunteers from liability for the injury or death of any person(s) and damage to property that may result from my negligent or intentional act or omission while participating in activities offered by GSE.


ACKNOWLEDGEMENT


I acknowledge that I have carefully read this waiver and release. This agreement shall be binding upon me, my successors, representatives, heirs, executors, assigns, or transferees. If any portion of this agreement is held invalid, I agree that the remainder of the agreement shall remain in full force and effect. By signing this release, I acknowledge that I understand its content and that this release cannot be modified orally. This agreement shall be governed by the laws of the State of Texas. The parties agree that any and all disputes shall be subject only to the jurisdiction of Courts located in Collin County, Texas.

I understand and agree that this Waiver, Release and Assumption of Risk gives up important legal rights and that I am giving up these important legal rights voluntarily, freely, under no threat of duress, without inducement, promise, or guarantee being communicated to me. The signature below is proof of my intention to execute a complete and unconditional WAIVER AND RELEASE of all liability to the full extent of the law.

I have read and understand the terms of this WAIVER, RELEASE AND ASSUMPTION OF RISK AGREEMENT and unconditionally agree to its full terms, statements, warranties, notices, representations, waivers and releases on behalf of both myself and marital community, if any, and my child or ward. All such terms, statements, warranties, notices, representations, waivers, and releases fully apply to my child or ward as if I was the participant. I understand that, by signing this Consent, I am giving up important legal rights both on behalf of myself and my child or ward regarding potential rights and claims against GSE. I have had sufficient opportunity to read this entire document. I have read and understood it, and I agree to be bound by its terms.
