LIMITLESS RC LIABILITY WAIVER RELEASE OF ALL CLAIMS, WAIVER OF LIABILITY, ASSUMPTION OF RISK, INDEMNIFICATION AGREEMENT & MINOR RELEASE 

LIMITLESS RC LIABILITY WAIVER

WARNING: THIS AGREEMENT IS LEGALLY BINDING. BY SIGNING IT, YOU GIVE UP YOUR RIGHT TO RECOVER COMPENSATION THROUGH THE COURTS OR OTHERWISE FOR ANY PERSONAL INJURIES, DAMAGE TO PROPERTY, OR DEATH ARISING FROM YOUR PARTICIPATION IN ACTIVITIES AT LIMITLESS RC. THIS INCLUDES, BUT IS NOT LIMITED TO, THE USE OF R/C TRACKS, OPERATING R/C VEHICLES, TURN MARSHALING, OR PARTICIPATING IN CLASSES OR EVENTS SPONSORED BY LIMITLESS RC OR ANY AFFILIATES.

YOU ALSO WAIVE ANY CLAIMS AGAINST THE LANDLORD OF LIMITLESS RC AND ANY INDIVIDUALS OR COMPANIES WHO HAVE DESIGNED, MANUFACTURED, OR INSTALLED THE FACILITIES. THIS AGREEMENT BINDS YOU, YOUR HEIRS, NEXT OF KIN, ASSIGNS, AND PERSONAL REPRESENTATIVES. ADDITIONALLY, YOU AGREE TO INDEMNIFY AND HOLD HARMLESS THE RELEASED PARTIES FROM ANY LOSSES, LIABILITIES, DAMAGES, OR COSTS, INCLUDING ATTORNEY FEES.



ASSUMPTION OF RISK & WAIVER OF LIABILITY

In consideration of being permitted to participate in any Limitless RC-sponsored activities, I, for myself, my personal representatives, assigns, heirs, and next of kin:

  1. Acknowledgment of Risk
  • I acknowledge that I understand the nature of R/C racing and related activities.
  • I confirm that I am in good health, physically capable, and properly prepared to participate.
  • I recognize that the event takes place in a public environment where inherent racing hazards exist.
  • If I determine conditions to be unsafe, I agree to cease participation immediately.
  1. Understanding of Risks
  • I fully understand that R/C racing involves significant risks, including but not limited to:
  • Serious bodily injury, permanent disability, paralysis, and death.
  • Risks caused by my own actions, the actions of others, environmental conditions, or NEGLIGENCE of the “RELEASEES.”
  • Other unforeseen risks and potential economic or social losses.
  • Pit Area Risks: I acknowledge that injuries may occur in the pit area due to the presence of electrical equipment, improper handling of tools, lighting conditions, or structural hazards. I accept full responsibility for my safety while in the pit area.
  • Spectator Risks: I understand that spectators are also at risk from stray vehicles, debris, or collisions. I assume all risks associated with being near the track, whether as a participant or spectator.
  • I fully accept and assume all such risks and responsibility for any associated losses, costs, or damages.
  1. Waiver and Release of Liability
  • I release, discharge, and agree not to sue Limitless RC, its owners, employees, sponsors, volunteers, advertisers, and property owners from all liability, claims, demands, or damages caused in whole or part by their negligence.
  • This includes, but is not limited to, claims related to negligent rescue operations or other failures to act.
  • Personal Property Disclaimer: I acknowledge that Limitless RC is not responsible for the loss, theft, or damage of any personal items left unattended on the premises, including but not limited to, R/C vehicles, tools, equipment, and personal belongings. I assume full responsibility for securing my own property.
  • Parking Lot Disclaimer: I understand and agree that Limitless RC is not responsible for any loss, theft, vandalism, or damage to vehicles or property while parked on or near the premises. I accept full responsibility for my vehicle and any items left inside it.
  • Driver Stand Disclaimer: I acknowledge that the driver stands at Limitless RC, including the wheelchair-accessible stand, may not be compliant with standard building codes due to visibility constraints. By choosing to use any driver stand, I accept any risks associated with its design and agree that Limitless RC is not liable for any injuries, falls, or other incidents that may occur while using them.
  1. Media Release & Consent
  • I understand that Limitless RC regularly captures photographs and videos during races, events, and activities.
  • I grant Limitless RC permission to use my likeness, name, image, voice, and performance in photographs, videos, livestreams, and other promotional materials.
  • I understand that these materials may be used on social media, websites, advertisements, and other promotional platforms without compensation or notification.
  • I waive any rights to inspect or approve any materials featuring my likeness.
  • If I do not wish to be photographed or recorded, I agree to notify Limitless RC in writing before participation and understand that avoiding all media exposure may not be guaranteed.
  1. Indemnification Agreement
  • If I or anyone on my behalf makes a claim against any of the “RELEASEES,” I agree to indemnify, defend, and hold harmless each of them from any litigation expenses, attorney fees, loss, liability, or damages incurred.



AGREEMENT & ENFORCEABILITY

  • Severability Clause: If any portion of this agreement is found invalid, the remainder shall continue in full force and effect.
  • Binding Effect: This agreement applies for the entire calendar year and remains in effect for all participation at Limitless RC during that period.

By signing, I confirm that I have read and understood this waiver, and I agree to its terms freely and voluntarily, without inducement or coercion.
