Fishing with House of Fly – Destination fishing trips

General Terms and Conditions

These General Terms and Conditions (hereinafter “GTC”) apply to any style of destination fishing trip offered by CSWW, Inc., dba House of Fly. Please carefully read through this document in its entirety before booking your trip.

CSWW, Inc., dba House of Fly (its owners, employees, shareholders, affiliated entities, agents, representatives, officers, directors, associates, successors and assigns, individually or collectively, are hereinafter referred to as “House of Fly”, or “HOF” for short, or simply as “We”), periodically organizes and/or conducts two different styles of destination fishing trips for guests, customers, and other fishing enthusiasts. They are:

Fish Camp Style Trips: This is a straightforward and unassuming fishing-first style of trip, hosted by a handful of us with House of Fly. Our Fish Camp experience is a little bit different than the traditional hosted/lodge trip. With our Fish Camps, we are inviting you along to what would otherwise be a group of us planning our own trip somewhere. This keeps the trip simple, affordable, and approachable for anyone. To put it simply, it gets you to some fishy destinations at a lower rate. We will still hire the guides, find local accommodations to stay at, cover the meals, and organize the logistics around getting everyone there and having a good time.

Hosted Style Trips: Hosted trips include a lodge or outfitter who we have partnered with to pull off an incredible experience that begins the moment you arrive at your destination. All of the details and fishing experience are handled by the lodge/outfitter. We are involved in much of the planning, coordination, and camaraderie that you are expecting, and this is where the “host” comes in. As the trip host, HOF will attempt to ensure that every detail is attended to during your trip.

With either style of trip, HOF acts only as an agent or intermediary for the various independent contractors or suppliers that provide accommodations, meals, transportation, guides and guide services, sightseeing, or other activities or goods and services connected with your trip (referred to as “Supplier” or “Suppliers”). As a result, HOF assumes no responsibility for and cannot be held liable for any negligent or willful act or failure to act of any Supplier, or of any other person or entity. A Supplier’s services are subject to the Supplier’s own terms and conditions and the local laws and regulations of the relevant country, state, territory, etc. HOF will not provide any refund for a Supplier’s delay, cancellation, overbooking, strike, government restrictions or interventions, pandemics, force majeure, or the like, nor will HOF provide any refund for elements of the trip that you do not use but paid for.

Trip Deposits, Final Payment and Cancellations.

Deposits are required to secure your registration on any HOF trip. We will do our best to hold space based on your interest in a trip but cannot guarantee you a spot until a deposit is made.

Deposits will require a 50% down payment.

Final payment is due 60 days prior to the arrival/check-in date of the trip.

In the event of cancellation, we will always do our best to refund your deposit. Cancellations prior to 30 days from date of arrival/check-in may receive partial or full refund. Cancellations within 30 days of arrival/check-in are not eligible for refund. These are general cancellation and refund terms for all trips, but each trip may have a different cancellation and refund schedule.

Licenses.

Fishing license requirements may vary by state and/or country. In destinations where fishing licenses must be purchased and carried, it will be the ultimate responsibility of each individual to obtain the correct licenses and/or permits required.

Purchase your own trip/travel/interruption/cancellation/delay, etc., insurance.

Regardless of type of trip, you will be investing your time and money in the destination trip. HOF strongly encourages all participants to purchase an insurance package to protect that investment of your time and your money.

If you become ill or are injured on the trip; if your flight connections do not work out and you miss all or part of the trip; you had a last-minute personal or professional circumstance that requires you to cancel or return early, etc., are all things that the right insurance policy can assist you with and/or reimburse you for. It is worth your time to explore thoroughly these types of insurances and purchase what coverages best suit you and your investment in the Trip.

Medical Considerations: If you have any medical or psychological conditions, it is very important you let us know well before departure so that we can attempt to make extra arrangements if necessary. HOF trip leaders have the right to disqualify anyone at any time during the trip if they feel the trip participant is mentally or physically incapable to continue and/or if a trip participant's continued participation jeopardizes the groups or his/her own safety. Under these circumstances refunds are not given. HOF is not a medical facility and therefore has no responsibility regarding medical advice, medications, or inoculations that you or your doctor deem necessary for your safe participation. Hospital facilities for serious problems are often unavailable, and evacuation can be prolonged, difficult, and expensive.

Again, HOF strongly encourages you purchase trip/travel/interruption/cancellation/delay, etc., insurance package to deal with these types of problematic situations that could arise and negatively impact your trip. HOF assumes no liability regarding provision of medical care. You agree to be solely responsible for all costs of all your emergency evacuation and emergency medical care, with or without insurance.

Some of your Obligations as a Trip Participant: By participating in an HOF trip, you assume certain obligations to HOF and the other trip participants. It is your responsibility to:

• Select a trip that is appropriate to your interests and abilities and prepare for the trip by familiarizing yourself with the itinerary, and any changes to the itinerary that might occur. NOTE: We reserve the right to make reasonable changes in the itinerary we deem advisable for the comfort and/or well-being of trip participants.

• Bring appropriate equipment and clothing for the location, fishing, time of year, weather, etc., and all activities you will be undertaking.

• Follow considerate social behavior with other participants, guides, and the public in general.

• Respect the areas we visit by using environmentally safe products and practices, not littering, abiding by applicable rules and regulations, etc.

HOF not responsible for Suppliers, items not in its control or changes in Itinerary. HOF may contract with Suppliers to provide a variety of goods or services, including but not limited to: transportation, accommodations, meals, guide services and/or other related travel or trip goods or services. We assume no responsibility, however caused, for injury, loss or damage to your person or property in connection with any goods or services provided by any Supplier contracted by HOF. Similarly, you agree that HOF is neither responsible nor liable to you for injury, loss or damage to person or property in connection with or resulting from the following: Acts of God; Wars; government restrictions, regulations or actions; terrorism; civil disturbances; strikes; failure of any means of conveyance to arrive or depart as scheduled; discrepancies or change in transit or lodging services over which we have no control; and any other any event or circumstance considered force majeure in commercial or international law. Finally, we reserve the right to make reasonable changes in the itinerary if HOF deems it advisable for the comfort and/or well-being of trip participants. When you provide a deposit to HOF, you specifically agree to be bound by this condition.

Your Signature Required. To participate in a destination trip with HOF, you will be required to agree in writing to these General Terms and Conditions, as well as additional items set forth in a Sport Participant and Recreation Opportunity Liability Release Agreement and Publicity Release.

For valuable consideration, the receipt and legal sufficiency of which is acknowledged, I agree with CSWW, INC., d/b/a House of Fly (“HOF”) as a condition for allowing me, and the other persons identified below, to participate in recreational opportunities where those activities take place and are provided, to engage in a sporting or recreational activity, all as defined by Montana law, Mont. Code Ann. §§ 27-1-751 - 753, which is incorporated herein by reference.

All parts of this Agreement shall apply to me. This agreement is binding whenever HOF (hereafter sometimes called “Provider”) now or in the future, permits me to be engage in a recreational activity as defined herein with HOF. 

IT IS HEREBY AGREED AS FOLLOWS:

1. SPORT AND RECREATIONAL OPPORTUNITIES. I have requested to engage in a recreational activity that involves fishing and water activities, that could include, but not be limited to, fishing, boating (upon all types of waters with any means of motorized or non-motorized watercraft), hiking, river floating, whitewater rafting, canoeing, kayaking, boating, wading and the like where HOF provides a sporting or recreational opportunity.

2. INHERENT RISKS. I understand that anyone fishing and/or participating in water activities as explained above, can suffer bodily and other injuries and that there are inherent risks in recreational activities, which include but are not limited to the following:

a. Such hazards, dangers and failures of equipment or negligence of others include, but are not limited to, drowning, bodily injury, sunburn, dehydration, insect, mammal and/or amphibian bites, encounters with all sorts and kinds of wildlife; cuts, exposure to different foods and diets, etc.;

b. the unpredictability of weather, water conditions, rough terrain along, in or upon oceans, lakes, rivers and streams or other waters;

c. hazards such as surface or subsurface conditions;

d. collisions with other boating equipment or objects;

e. the potential of another participant who engages in a recreational opportunity to not maintain control over his or her acts or to not act within the person’s ability.

f. the fact that equipment used for recreational activities can be dangerous, which include but are not limited to, fishing equipment, hooks, fishing lines, all motorized and non-motorized boats and watercraft of any kind, including kayaks, canoes, rafts, float tubes, and other similar equipment and apparatus even if used in the manner intended by the original manufacture of the same, and which can result in harm, injury or death to a participant.

3. DEFINITION OF TERMS:

• The term “Inherent risks” means those dangers or conditions that are characteristic of, intrinsic to, or an integral part of any sport or recreational activity and that cannot be prevented by the use of reasonable care.

• The term “Provider” means a person, corporation, partnership, or other business entity, including a governmental entity as defined in Mont. Code Ann. §2-9-111, that promotes, offers, or conducts a sport or recreational opportunity for profit or otherwise.

• The term “Sport or recreational opportunity” means any sporting activity, whether undertaken with or without permission, including but not limited to bicycling, hiking, swimming, boating, mountain climbing, river floating, whitewater rafting, canoeing, kayaking, hunting, fishing, backcountry trips, horseback riding and other equine activity, off-highway vehicle use, and any similar recreational activity.

• The term “Participant” herein shall refer to the individual who participates in the sport or recreational opportunity.

4. ACCEPTANCE OF INHERENT RISKS:

A person who participates in any sport or recreational opportunity assumes the inherent risks in that sport or recreational opportunity, whether those risks are known or unknown, and is legally responsible for all injury or death to the person and for all damage to the person’s property that result from the inherent risks in that sport or recreational opportunity. I understand these and other dangers or conditions that are an integral part of recreational opportunity activities are risks inherent in engaging in said activity and assume all risks in connection therewith, and expressly waive any claims for any injury, loss or damages arising therefrom.

I understand that a Provider is not required to eliminate, alter, or control the inherent risks within the particular sport or recreational opportunity that is provided. All sport or recreational activities can be extremely dangerous; accidents involving recreational opportunities can be frequent; and SERIOUS PERMANENT INJURY and/or DEATH may result from participation in recreational opportunities, despite all reasonable safety precautions.

I understand that the dangers inherent in sport or recreational activities are increased by:

• The condition of the oceans, lakes, rivers and streams and the like, as well as lands and trails and the like, because surface and subsurface conditions of any body of water are not always known or apparent, and because one’s footing is not perfect.

• The elements, acts and occurrences of nature which can make the activity unsafe.

• The presence of other people, wild creatures and animals of all types in the waters, on land, and in the air, including but not limited to fish, sharks, whales, other marine or amphibious species, reptiles, bears, bobcats, mountain lions, wolves, coyotes and dogs.

5. PARTICIPANT RESPONSIBILITIES:

I understand that:

• Upon participating in the recreational opportunity, I, as the participant am in primary and ultimate control of my actions and that the participant’s safety depends upon his/her ability to maintain control his/her actions.

• FAILURE TO FOLLOW THE DIRECTIONS OF THE PROVIDER AT ANY TIME WILL RESULT IN THE IMMEDIATE TERMINATION OF THE OPPORTUNITY AND THE FORFEITURE OF ALL FEES AND EXPENSES.


6. INSURANCE(S):

I represent that I am and will be at all times while on the recreational opportunity with CSWW, Inc., d/b/a House of Fly, covered by accident, and/or medical insurance or I have sufficient funds to cover my medical expenses. I further represent and warrant that HOF has no responsibility to provide insurance coverage for me or my guests.

7. PARTICIPANT WILL ACT SAFE AND REASONABLE:

I shall act in a safe and responsible manner at all times to avoid injury to myself and others and to be aware of risks inherent in recreational opportunity activities.

8. ABILITY TO PARTICIPATE IN RECREATIONAL OPPORTUNITY and AUTHORIZATION FOR EMERGENCY MEDICAL CARE:

I am physically, mentally, and emotionally able to engage in the recreational opportunity activity(ies), and I have presented the HOF with a medical statement indicating physician’s approval if any medical condition(s) do exist. I am solely responsible for any medical, allergy or dietary condition which I might have and will guard against any adverse consequences of he such condition(s) throughout the recreational opportunity. I hereby authorize any medical treatment deemed necessary, and I give HOF permission but not the obligation to hospitalize and secure treatment, including injections and surgeries.

9. HOF GENERAL TERMS AND CONDITIONS INCORPORATED HEREIN:

I have previously reviewed HOF’s General Terms and Conditions for destination fly trips and agree to all the terms and conditions therein.

10. PUBLICITY RELEASE:

By participating in the recreational opportunity with HOF, I consent to the use by HOF or it’s assigns of any photographs, pictures, video, film, audio or other imagery of me for publicity, promotion, television, websites or other promotional/commercial use to be made of the same by HOF or it’s assigns, and expressly waive any rights of privacy, compensation, ownership of or copywrite claims thereto or therein.

11. MONTANA LAW:

Montana law shall govern this agreement. Should any clause conflict with state law, that clause will be null and void and the remainder of this Agreement and Liability Release shall remain in effect.

12. STATEMENT OF UNDERSTANDING:

I, THE UNDERSIGNED, HAVE CAREFULLY READ THIS FOUR PAGE DOCUMENT AND UNDERSTAND ITS CONTENTS ENTIRELY. I AGREE NOT TO MAKE ANY CLAIMS, FILE ANY LAWSUITS, INITIATE ANY LEGAL ACTIONS AGAINST HOF OR ANY OF ITS SUPPLIERS FOR ANY PERSONAL INJURY, DEATH OR PROPERTY DAMAGE ARISING FROM OR AS A RESULT OF MY RECREATIONAL OPPORTUNITY ACTIVITIES. I AGREE TO RELEASE, INDEMNIFY AND HOLD HARMLESS HOF FROM ALL LOSSES, DAMAGES, ACTIONS, CLAIMS, DEMANDS AND LIABILITY FOR INJURY, DEATH OR PROPERTY DAMAGE ARISING FROM OR AS A RESULT OF MY RECREATIONAL ACTIVITES. I AGREE TO DEFEND HOF AGAINST ANY AND ALL CLAIMS, DEMANDS, LIABLITIES, ACTIONS, LAWSUITS, OR PROCEEDINGS OF ANY KIND, INCUDING THE COSTS AND EXPENSES THEREOF, ARISING FROM OR AS A RESULT OF MY RECREATIONAL OPPORTUNITY ACTIVITIES, WHETHER SUCH CLAIMS OR ACTIONS ARE RIGHTFULLY OR WRONGFULLY BROUGHT OR FILED. I AGREE THAT HOF MAY EMPLOY AN ATTORNEY OF ITS OWN SELECTION TO APPEAR AND DEFEND ITSELF AT MY EXPENSE. I AGREE THAT THIS DOCUMENT SHALL BE BINDING UPON ME (THE PARENT/LEGAL GUARDIAN THEREOF IF THE PARTICIPANT IS A MINOR) MY HEIRS, ASSIGNS, DISTRIBUTEES, GUARDIANS AND LEGAL REPRESENTATIVES AND THAT THIS AGREEMENT MAY BE PLEAD AS A BAR TO ANY LEGAL ACTION CONTRARY TO THE TERMS HEREIN. 

By signing this document, you may be waiving your legal right to a jury trial to hold the Provider legally responsible for any injuries or damages resulting from risks inherent in the sport or recreational opportunity or for any injuries or damages you may suffer due to the Provider’s ordinary negligence that are the result of the Provider’s failure to exercise reasonable care.
