I hereby acknowledge and agree that participation in softball and baseball activities such as private lessons, group training sessions, camps and clinics, team practice, and other skills training activities and events at the training facility Extra Innings Training, LLC, located at 6100 Hanging Moss Road, Orlando, FL 32807, has inherent risks. In consideration of the services provided by Extra Innings Training, LLC, their coaches, employees, contractors, volunteers, agents, officers, members, participants and all persons or entities acting in any capacity on their behalf (hereinafter collectively referred to as “Extra Innings”) I now agree and certify as follows: 1) I acknowledge and fully understand that I, the participant, (if participant is 18 years of age or older), or otherwise, the parent/legal guardian of the named minor participant, will be engaging in activities that may involve risk of serious injury which might result not only from my own actions, inactions or negligence, but also from the actions, inactions or negligence of others, or from the conditions of the premises or of any equipment used. Further, I acknowledge that there may be other risks not known or not reasonably foreseeable at this time. Such risks may include, but are not limited to, the nature of the activity, latent or apparent defects of the equipment or property supplied by Extra Innings or by any other third party; acts of other participants in this activity; acts of Extra Inning’s employees, contractors, volunteers or agents; for rentals, acts of the third-parties leading the activities and the other participants; my own physical condition; acts of omissions; the conditions of the Extra Innings facility and surrounding grounds or terrain and accidents connected with their use; and the performance of emergency first aid treatment or other services. 2) I expressly agree and promise to accept and assume all the risks existing in this activity. My participation in this activity is purely voluntary and I elect, despite the risks, to participate. I assume all the foregoing risks and accept personal responsibility for any and all damages associated with any such injury. 3) On behalf of myself, my children, my parents, my heirs, assigns, and personal representative, I hereby voluntarily release, waive, forever discharge and agree to indemnify and hold harmless Extra Innings; each of their respective officers, directors, members, agents, employees, contractors, and volunteers; any corporate parents, subsidiaries, affiliates, distributors and agents; other activity participants; and if applicable, any third-party operators, affiliates or associates on the premises conducting an event or activity, from any and all liability for any and all claims, demands of causes of action which are in any way connected with my participation in this activity or my use of Extra Innings’ equipment or facilities. 4) I hereby certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating in activities or, alternatively, I agree to fully bear the cost of such injury or damage myself. I further certify that I have no medical, physical or mental conditions which could interfere with my ability to safely participate in this activity, or else, that I am willing to assume and bear the costs of all risk that may be created, directly or indirectly, by any such condition. 5) I hereby certify that I am at least 18 years old, or the parent or legal guardian of the minor participant under the age of 18 named below, and I agree I will wear a batting helmet at all times while in the batting cages. I hereby grant Extra Innings permission to administer basic first aid and I authorize Extra Innings or its coaches, employees, contractors, volunteers, and agents, to contact 911 or other emergency personnel as needed. 6) I hereby certify that I have been given the Facility Rules & Safety Guidelines and the Facility Code of Conduct and that I have reviewed them and will adhere to them. I understand that these rules are for the safety of myself and the other participants in an activity and that Extra Innings may refuse service to anyone who is unwilling or unable to follow them. The video-only feed (CCTV/no audio) displays on the viewing monitor in the waiting room. I understand that my presence and participation in events at the facility constitutes my consent to video surveillance and the use of cameras. 8) I do hereby give Extra Innings, its assigns, licensees, and legal representatives the irrevocable right to take and use photographs or video in all forms and media and in all manners, including in composite form, in relation to my participation in activities with Extra Innings, for advertising or marketing for both print and/or digital publication or any other lawful purposes, and I waive any right to inspect or approve the finished product, including written copy, internet etc., which may be created in connection therewith. By signing this document, I acknowledge that if any bodily injury or property damage occurs during my participation in activities and events with or at Extra Innings a court of law may find me to have waived my right to maintain a lawsuit against Extra Innings and each of the parties listed in Item 3 above on the basis of any claim from which I have released them herein. I have had sufficient time to read this entire document. I have read it and understood it and I agree to be bound by its terms. |
