Waiver & Release Assumption of Risk & Indemnity Agreement
I, undersigned,hereby acknowledge that I have voluntarily applied to enter on to and to engage in or observe simulated shooting and other activities at the SIMULATOR Facility at Smoke and Barrel Gun Club. These activities include, but are not limited to, the use and discharge of CO2 Cartridges, the use and discharge of rental firearms with CO2 Cartridges provided by the Smoke and Barrel Gun Club and the services and training by employees of the SIMULATOR. I acknowledge and understand that shooting activities are inherently hazardous and involve both known and unanticipated risks which could result in damage or destruction of property and physical or emotional injury, including paralysis or death, of myself or of other persons. These risks include, but are not limited to: being shot by or shooting myself or others; partial or total loss of eyesight or hearing; inhalation or other harmful contact with lead or other contaminants; and being struck by flying or falling objects. I further acknowledge and understand that the SIMULATOR is an indoor simulated shooting facility which utilizes a CO2 cartridges and lasers. I represent that I have never been convicted of a felony in any of the SO United States. Texas law prohibits any person convicted of a felony to be present in any environment where firearms are present. I represent that I am experienced and skilled in the proper handling, loading, use and discharge of all firearms and ammunition I intend to use at the SIMULATOR. I understand that the SIMULATOR is specifically relying on the truth of my representations concerning my experience with firearms, in permitting me to make use of the SIMULATOR.
As lawful consideration for being permitted by Smoke and Barrel Gun Club to enter into the SIMULATOR ROOM, to use the SIMULATOR facilities or equipment and to engage in or observe simulated shooting and other activities at the as either a Member or a Guest, I agree as follows: I agree to assume full responsibility for any and all risks, injuries, or damages, known or unknown, of whatsoever any kind and nature, which I might incur as a result of entering into the SIMULATOR room and in using SIMULATOR facilities or equipment and in engaging in or observing shooting and other activities at the SIMULATOR. I agree to assume all responsibility and liability for any act or acts, even negligent, reckless, or criminal act or omission to act, of my Guests in the simulator room. (I understand that "my Guests" includes any and all persons who enter the simulator room, use the simulator facilities or engage in or observe simulated shooting and other activities in the simulator room as a result of my express invitation, permission or consent). I agree that I will ensure that each of my Guests read and sign a "Release, Assumption of Risk and Indemnity Agreement." Guests also include any MINORS under guardianship of the undersigned (MINOR is defined as any person under the age of 18 on the date the activities in the SIMULATOR room are to take place). Each MINOR participating in SIMULATOR activities must be included in the GUARDIANSHIP section at the bottom of this document and is therefore also bound by "Release, Assumption of Risk, and Indemnity Agreement''
I agree to abide by Smoke and Barrel Gun Club Code of Conduct and to ensure my Guests do so as well. I knowingly, voluntarily and expressly waive any and all claims I, my next of kin, heirs, guardians, representatives, assigns or any other person claiming under me completely and without reservation that I may have against Smoke and Barrel Gun Club, its agents, officers, members, employees, instructors, owners, volunteers, or representatives from any and all injuries or damages that I may sustain as a result of me entering in to the SIMULATOR room, using SIMULATOR facilities or equipment, or engaging in or observing shooting SIMULATOR activities. Also, I, my next of kin, heirs, guardians, representatives, assigns or any other person claiming under me, forever release, waive, discharge and covenant not to sue the Smoke and Barrel Gun Club, its agents, officers, members, employees, instructors, owners, volunteers, or representatives for any personal injury, death, disability, property damage, property theft or acts and/or omissions of whatsoever kind and nature including, but not limited to, those caused by its negligence or other acts including, but not limited to, those acts and/or omissions of other participants or persons in the SIMULATOR room.
I further acknowledge and agree that it is my understanding and intent that this Agreement, and any signed written amendments or modifications to it, shall remain in full force and effect from the date of execution and ever after shall be applicable to each and every occasion that I or my Guests enter in to the SIMULATOR room, use SIMULATOR facilities or equipment or engage in or observe simulated shooting and other activities. I further agree to accept all financial responsibility for the repair of any EQUIPMENT that I rent, borrow, or use that is owned by Smoke and Barrel Gun Club, in the event damages were directly caused by ME or my GUESTS' inappropriate use of said EQUIPMENT. I have carefully read this "Release, Assumption of Risk and Indemnity Agreement" and fully know its contents. I acknowledge that no other inducement, assurance or guarantee has been made to me in consideration of my signing this Agreement which I sign voluntarily and of my own free will. I further acknowledge and agree that this Agreement may be amended or modified only by a writing signed by me and by an authorized agent of Smoke and Barrel Gun Club.
SMOKE AND BARREL GUN CLUB SIMULATOR RULES All users of the Smoke and Barrel Gun Club Simulator Room must fill out and sign a Liability Waiver. Members must have a current and signed liability waiver on file before using the SIMULATOR. 1. At no time will firearms, regardless of whether they are loaded or not, be pointed at or in the direction of any person. 2. Loaded firearms are allowed on Smoke and Barrel Gun Club property if properly holstered and not removed until in the Simulator Room. 3. Consuming alcoholic beverages or drugs (including prescription and over-the-counter medications) that will affect his/her ability to participate with a maximum state of awareness and in a completely safe manner, before or during simulator activities is STRICTLY PROHIBITED. The Simulator instructor (SI) will deny access to anyone that is or appears to be in violation. 4. Phones will be placed on SILENT. Disruptive activities, such as loud music or children that are not supervised properly on the simulator may result in the SI asking your party to leave the property. Photos and videos may be taken as long as they are done safely. 5. The minimum age to utilize the simulator by oneself is eighteen. All participants under eighteen years of age must be accompanied by a responsible adult. 6. Members will keep their fingers off the triggers and outside the trigger guard until the firearm is pointed at the simulator screen.
TI Shooting Simulator 1. Absolutely no real firearms in this room. Firearms must be secured in your vehicle prior or in our locker to engaging in any scenario-based training. 2. No food or drinks in the simulator room. 3. Treat all training firearms as if they are real firearms. The simulator is designed for real-world training and absolutely no horseplay is allowed. 4. Any trainee under the age of eighteen must be accompanied by an adult.
Childrenon the SIMULATOR 1. Children under eighteen years of age will not be allowed in the simulator room without supervision from an adult member, parent, or guardian. 2. Children ages five and below will not be allowed in the simulator room, or to be left unsupervised by a parent or guardian. 3. Children ages 14 and under must be accompanied one-on-one by an adult parent or guardian with 100 percent eyes-on supervision. 4. Children will not be left unsupervised in the simulator room or in the store at any time. Children found unsupervised will be escorted to the adult, parent, or guardian and asked to leave the property for the safety of the children and others using the facility.
FirearmsCarry & Handling 1. Procedures for transporting firearms while entering and leaving the Smoke and Barrel Gun Club facility. 2. Firearms that are concealed or open carried in a holster must remain in a holster, as well as firearms in a bag or case must remain in the bag or case when transporting them between the parking lot, store, and SIMULATOR.
Cease Fire Procedure 1. When a verbal "CEASE FIRE" is heard all simulations must stop immediately. 2. Place the firearm on its display and step away. 3. Only when the instructor verbally states” ALL CLEAR” can simulations resume.
Emergenciesand Incident Reporting 1. In the event of an emergency please follow these procedures. 2. Cease Simulator use Immediately 3. Notify the Simulator Instructor. (SI) 4. Follow all the instructions given by the SI. 5. Take charge of the situation. Determine the seriousness of the injury. 6. Render aid if able. The first-aid kit is located behind the front counter. • Call the duty manager, as well as 911 or delegate someone to call 911. 7. Direct help to location. Delegate someone to be at the entrance to further assist emergency medical personnel.
First Aid Procedures 1. All personnel rendering first aid should be aware of the precautions surrounding blood-borne pathogens in an accident. The following guidelines should be followed if someone is injured : if you encounter biohazardous materials including but not limited to: blood, secretions, cerebrospinal fluid, synovial fluid, pleural fluid, pericardia! fluid, peritoneal fluid, amniotic fluid, anybody visibly contaminated with blood, any un-affixed organ or tissue from a human, living or dead, and the disposal of cleaning items and first aid dressings. Universal precautions should be used; all blood and body fluids listed above must be treated as potentially infectious. 2.Government guidelines can be found at www.OSHA.gov, search for OSHA Occupational Exposure to Blood borne Pathogens.
Smoke and Barrel Gun Club Hygiene Guidelines 1. All users of Smoke and Barrel Gun Club facilities are strongly encouraged to follow these guidelines to ensure minimal exposure to lead particulate. 2. Refrain from eating, drinking, smoking, or otherwise placing hands in proximity to the mouth or nose while on using the simulator equipment. 3. Wash your hands with soap and water after leaving the Simulator room or cleaning area before eating or drinking.
