This Waiver and Release of Liability ('Waiver') is entered into by the undersigned participant ('Rider') in favor of NEXT MX, its owners, operators, employees, volunteers, and affiliated parties.

1. Assumption of Risk

I acknowledge that participating in motocross riding and related activities at NEXT MX is inherently dangerous. I voluntarily assume all risks associated with riding, including but not limited to: crashes, collisions, terrain hazards, weather conditions, mechanical failures, and acts of other riders.

2. Waiver and Release

In consideration of being allowed to ride at NEXT MX, I hereby release and hold harmless NEXT MX and all associated parties from any and all claims, liabilities, demands, damages, and causes of action that may arise from any injury, loss, or damage sustained by me while on the property.

3. Rider Responsibility and Conduct

I agree to ride within my skill level and only on tracks suited to my ability. I will not ride on the Intermediate/Pro or Supercross tracks unless I have confirmed with NEXT MX staff that I meet the appropriate skill level. I will walk any track before riding it and will not jump on my first lap. I will never ride backwards on the track. I agree to follow all posted rules, staff instructions, and safety guidelines.

4. Gear Requirements

I agree to wear full protective motocross gear at all times, including a helmet, goggles, gloves, boots, and appropriate riding apparel.

5. Property and Behavior

I will respect the property, equipment, and other riders. I will not engage in reckless behavior, aggressive riding, or unsafe conduct. I understand that violation of these terms may result in being asked to leave the premises without refund or further invitation.

6. Acknowledgment

By signing below, I confirm that I have read, understood, and agree to abide by the terms outlined in this Waiver. I certify that I am physically fit to participate in motocross activities and assume full responsibility for my actions while at NEXT MX.

7. Medical Authorization

In the event of an injury or medical emergency, I authorize NEXT MX staff or representatives to seek medical assistance on my behalf if I am unable to do so. I understand that I am solely responsible for any medical costs or expenses that may result.

8. Photo and Video Release

I grant permission to NEXT MX to capture and use photographs or video footage of me for promotional purposes, including social media, marketing, and website use. I waive any right to inspect or approve the use of such media or to receive compensation.

9. Indemnification

I agree to indemnify and hold harmless NEXT MX and its associated parties from any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities, including legal fees, arising out of or resulting from my participation in activities at the facility. I agree to reimburse NEXT MX for any such expenses incurred as a result of my actions.

10. Governing Law

This Waiver shall be governed by and interpreted in accordance with the laws of the Province of Ontario. Any legal action or proceeding arising from this Waiver shall be brought exclusively in the courts located in Ontario, and I consent to the jurisdiction of such courts.
