Vista Gun Lake Pontoon Rentals LLC

Please read all information carefully and fill in ALL require

For good and valuable consideration, the sufficiency of which is acknowledged by the undersigned parties, Vista Gun Lake Pontoon Rentals LLC agrees to rent the Boat listed below to Renter (identified above) for the time specified and subject to all terms and conditions set forth below.


1.      Life Jackets & all safety equipment are provided for ages 12 and up

2.      All renters will be charged additional for gas if not replaced before checking out

3.      The rented boat shall not be used to carry passengers or property for hire

4.      Driver of rented craft must have valid drivers license and/or boater safety certificate

5.      The rented boat shall not be used to carry passengers or property in excess of the rated weight capacity listed on the boat

6.      Only person that is to be driving the boat is the LESSEE above or any other LESSEE who signed a copy of this agreement

7.      The rented boat shall not be used to tow or propel any other boat, barge or thing without owner’s written consent 8. All Michigan boating laws must be followed at all times

9.      Renter is not to use the boat (or motor) in any race or competition 

10.   There is to be no wake after dark

11.   Renter is not to operate boat (or motor) in a negligent manner

12.   The rented boat shall not tow any tubes, skiers, or wakeboarders at any time without written permission from owner

13.   Renter is not to operate rented boat outside of Gun Lake without written permission from owner

14.   All children under the age of 12 must wear a life jacket at all times

15.   Renter is not to permit the boat to be operated by any other persons without written permission 

16.   Rented boat must be docked at all times when not in use (DO NOT BEACH THE BOAT FOR ANY REASON)

17.   Renter is not to remove the motor from the boat for any use whatsoever

18.   When boating/docking in shallow waters make sure motor is at the proper depth with trim on shifter with the propeller in the water at all times as to not burn up the motor

19.   The rented boat must be tied off in the front and rear at all times when parked at the dock

20 . When boating the rented boat must be 100ft from any otherboat, dock, shoreline, or loon nest at all times

I further agree (continued from the first page of this agreement):

1.       The LESSEE acknowledges he/she is responsible for carefully examining the rented craft/pontoon boat upon arrival and the if they do not find it suitable for the purpose for which it is leased, and that other accessory equipment is in suitable and acceptable condition that they contact management right away on the first day of their rental period and that they also will maintain both craft and equipment in a safe, dependable condition while in his/her custody.

2.       LESSEE hereby agrees to be responsible for and pay for all loss or damage to the leased equipment caused by LESSEE and others during the time the equipment was leased to the LESSEE and LESSOR may withhold security damage deposit and/or charge credit card given below if damage amount exceeds the amount of the security damage deposit.

3.       LESSEE agrees that he/she with return said craft/equipment to LESSOR in the same conditions received, ordinary wear and tear accepted.

4.       Cash, Security deposit (as provided in the statement of charges) shall be retained by LESSOR as partial compensation for failing to return said rental craft in as good condition, with ordinary wear and tear excluded, as when received; for reimbursement of articles damaged, missing, or broken; or to be applied to the rental charges upon return of the craft by LESSEE.

5.       LESSEE agrees not to use, nor permit the use:

a.       of rental craft for any unlawful purpose

b.       of the rental craft in a careless and negligent manner

c.        of the rental craft while under the influence of liquor and/or narcotics

d.       by any other person not to have signed a copy of this agreement

6.       LESSEE acknowledges his/her responsibility for the safe and proper operation of the craft: and for the safety and welfare of other boaters and persons. It is AGREED AND UNDERSTOOD BY LESSEE that LESSOR shall not be held liable for damages, inconvenience or time lost caused by accident, breakdown or malfunction of the rental craft. LESSEE FURTHER AGREES to indemnify and hold harmless the LESSOR from, and against any and all claims for loss of or damage to property or injury to persons (including death) resulting through the use, operation and possession of said rental craft. LESSEE further agrees to hold the LESSOR harmless should loss or damage occur to any of the LESSEE’S personal property while carried in, or on, the rental craft, including loss or damage caused by fire, water, theft of any other cause whatsoever.

7.       LESSEE expressly agrees to indemnify and hold LESSOR harmless of, from and against any and all loss, cost, damages, attorney fees and/or liability in connection with the enforcing of the foregoing rental contract by LESSOR, including expenses incurred in collection or attempting to collect delinquent rent and in the event of suit by LESSOR to recover possessions of said rented property and/or enforce any of the terms, conditions and/or provisions hereof. It is understood and agreed that venue of any action here under shall be in the county of the LESSOR.

8.       In the event of malfunction, breakdown, or if any defect is discovered after acceptance of the rental craft that LESSEE will be provided with another (spare) rental craft/pontoon boat that LESSOR has on standby for just these types of situations. LESSOR understands that if for any reason the (spare) rental craft is not available or cannot be used by LESSEE then the LESSEE will receive a prorated portion of their rental amount based off the time of the breakdown during their stay.

9.       The rules and regulations contained herein and as posted in the office, on the craft and/or the grounds by LESSOR are for the safety and welfare of all who use the facilities. The LESSEE certifies that he/she has read and understands said rules and regulations, and further assumes the responsibility to see that his/her family and/or guest(s) will obey the rules. LESSEE will also operate the rental craft/pontoon boat in accordance with all rules, regulations and laws of any municipality, state, county, or federal or other authority. 

10.    Should any term or condition of the rental agreement be held void or unenforceable, then that term shall be deemed severed from this agreement and the enforceability to the remainder shall not be affected and will remain in full force effect.

11.    THE TERMS AND CONDITIONS ON BOTH PAGES OF THIS CONTRACT CONTAINS THE ENTIRE UNDERSTANDING BETWEEN LESSEE AND LESSOR AND THAT NO OTHER REPRESENTATION OR INCRUDMENT, VERBAL OR WRITTEN, HAS BEEN MADE WHICH IS NOT INCLUDED IN THIS RENTAL AGREEMENT.
