Uplands Golf & Ski Club (HEREINAFTER REFERRED TO AS THE “RELEASE AGREEMENT”) BY SIGNING THIS DOCUMENT YOU WILL WAIVE OR GIVE UP CERTAIN LEGAL RIGHTS,INCLUDING THE RIGHT TO SUE FOR NEGLIGENCE, BREACH OF CONTRACT OR BREACH OF THE OCCUPIERS’LIABILITY ACT OR CLAIM COMPENSATION FOLLOWING AN ACCIDENT RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISKS AND INDEMNITY AGREEMENT PARTICIPANT INFORMATION


TO: UPLANDS GOLF & SKI CLUB and its directors, officers, employees, instructors, agents, representatives, volunteers independent contractors, subcontractors, sponsors, successors and assigns (hereinafter referred to as the “Releasees”).


SECTION 1: ACKNOWLEDGEMENT OF RISKS – PLEASE READ CAREFULLY!

I am aware that skiing, snowboarding and participating in snow school lessons, clinics and sessions (collectively referred to as the “Activity”) involve many risks, dangers and hazards including, but not limited to: boarding, riding and disembarking ski lifts; changing weather conditions; exposed rock, earth, ice, and other natural objects; trees, tree wells, tree stumps and forest deadfall; the condition of snow or ice on or beneath the surface; negligent first aid; failure to act safely or within one’s own ability or to stay within designated areas; negligence of other persons; and RISKS RESULTING FROM THE NEGLIGENCE, BREACH OF CONTRACT, OR BREACH OF ANY STATUTORY DUTY OF CARE ON THE PART OF THE RELEASEES. I UNDERSTAND THAT NEGLIGENCE INCLUDES FAILURE ON THE PART OF THE RELEASEES TO TAKE REASONABLE STEPS TO SAFEGUARD OR PROTECT ME FROM, OR WARN ME OF, THE RISKS, DANGERS AND HAZARDS. I also understand that other risks include variations in the terrain which may create blind spots or areas of reduced visibility; variations in the surface or sub-surface, including changes due to man-made or artificial snow; variable and difficult conditions; cliffs; crevasses; snowcat roads, road-banks or cut-banks; collision with lift towers, fences, snow making equipment, snow grooming equipment, snowcats, snowmobiles or other vehicles, equipment or structures; encounters with domestic and wild animals including dogs and bears; exposure to INFECTIOUS DISEASE CONTRACTED THROUGH VIRUSES, BACTERIA, PARASITES, AND FUNGI WHICH MAY BE TRANSMITTED THROUGH DIRECT OR INDIRECT CONTACT; collision with other persons; loss of balance or control; slips, trips and falls; and accidents during participation in the Activity. I am also aware that the risks, dangers and hazards referred to above exist throughout and beyond the ski area and that many hazards are unmarked.

SECTION 2: ASSUMPTION OF RISKS – PLEASE READ CAREFULLY!

THE NEGLIGENCE, BREACH OF CONTRACT, OR BREACH OF ANY STATUTORY DUTY OF CARE ON THE PART OF THE RELEASEES. I UNDERSTAND THAT NEGLIGENCE INCLUDES FAILURE ON THE PART OF THE RELEASEES TO TAKE REASONABLE STEPS TO SAFEGUARD OR PROTECT ME FROM, OR WARN ME OF, THE RISKS, DANGERS AND HAZARDS.


SECTION 3: RELEASE OF LIABILITY, WAIVER OF CLAIMS AND INDEMNITY AGREEMENT. THESE CONDITIONS WILL AFFECT YOUR LEGAL RIGHTS – PLEASE READ CAREFULLY!

IN CONSIDERATION OF the Releasees accepting my application for a Season Pass and permitting my use of the lifts, ski runs, trails, terrain parks, race courses, restaurants, day lodge, parking, access roads and other ski area facilities (hereinafter “the premises”), I hereby agree as follows:

1. I AM GIVING UP CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE, that arise or result from in whole or in part, participating in the Activity and, without limitation, claims arising out of or resulting from THE NEGLIGENCE, BREACH OF CONTRACT, BREACH OF ANY DUTY OF CARE OWED BY THE RELEASEES UNDER THE OCCUPIERS’ LIABILITY ACT;

2. WAIVE ANY AND ALL CLAIMS THAT I HAVE OR MAY HAVE IN THE FUTURE against the Releasees;

3. RELEASE THE RELEASEES FROM ANY AND ALL LIABILITY FOR ANY LOSS, DAMAGE, EXPENSE, INJURY AND DEATH, INCLUDING ANY CLAIM FOR CONTRIBUTION AND INDEMNITY, that I may suffer from my participation in the Activity DUE TO ANY CAUSE WHATSOEVER, INCLUDING NEGLIGENCE, BREACH OF CONTRACT AND ANY DUTY OF CARE OWED TO ME BY THE RELEASEES UNDER THE OCCUPIERS’ LIABILITY ACT. I UNDERSTAND THAT NEGLIGENCE INCLUDES THE FAILURE ON PART OF THE RELEASEES TO TAKE REASONABLE STEPS TO SAFEGUARD OR PROTECT ME FROM OR WARN ME OF THE RISKS, DANGERS AND HAZARDS REFERRED TO ABOVE; and

4. INDEMNIFY AND HOLD HARMLESS the Releasees from any and all liability, including claims for contribution and indemnity, for any damage to property of or personal injury to, any third party, resulting from my, or my family member or next of kin, use of the Releasees’ property or participation in the Activity.


5. AGREEMENT BINDING — This Release Agreement shall be effective and binding upon my heirs, next of kin, executors, administrators, assigns and representatives, in the event of my death or incapacity;

6. JURISDICTION — This Release Agreement and any rights, duties and obligations as between the parties to this Release Agreement shall be governed by and interpreted solely in accordance with the laws of Ontario and no other jurisdiction. Any litigation involving the parties to this Release Agreement shall be brought solely within Ontario, and shall be within the exclusive jurisdiction of the Courts of Ontario; and

7. SEVERABILITY — If any provision of this Agreement is determined by a court of competent jurisdiction to be invalid, illegal or unenforceable in any respect, such determination shall not impair or affect the validity, legality or enforceability of the remaining provisions hereof, and each provision is hereby declared to be separate, severable and distinct. In entering into this Release Agreement, I am not relying upon any oral or written representations or statements made by the Releasees with respect to the safety of skiing or snowboarding other than what is set forth in this Agreement. The Season Pass issued to the Passholder is the property of Uplands Golf & Ski Club, is not transferable, not for resale and is revocable for misconduct or breach of the Alpine Responsibility Code. I HAVE READ AND UNDERSTAND THIS RELEASE AGREEMENT AND I AM AWARE THAT BY SIGNING THIS AGREEMENT I AM WAIVING CERTAIN LEGAL RIGHTS WHICH I OR MY HEIRS, NEXT OF KIN, EXECUTORS, ADMINISTRATORS, ASSIGNS AND REPRESENTATIVES MAY HAVE AGAINST THE RELEASEES.


SECTION 4: PROPERTY'S TERMS & CONDITIONS – PLEASE READ CAREFULLY!

1. LIFT — All participants and accompanying adults must have a valid lift ticket to access the designated hill area, including the learning area, magic carpet, chairlift, lift lines, and related access areas. All participants must display either a valid program card or current lift ticket at all times, which Uplands staff may verify at any time. Report lost program cards immediately to the office. Replacement cards will be issued only with proof of original purchase. All forms and waivers must be signed prior to the first lesson by a parent or guardian over the age of 18.

Adults must purchase the appropriate lift ticket to gain access to the hill, magic carpet, and chairlift. Parent passes and season passes are available for purchase and are recommended if your child is in a 3-week program.

All individuals accessing the designated hill area must have the appropriate valid lift ticket or pass, regardless of whether they are participating in a lesson. Those who have a lift ticket will also be required to have proper ski/snowboard equipment to go onto the lift or magic carpet unless specified by ski patrol.

2. PARTICIPANT SAFETY & ADULT SUPERVISION — All individuals under 18 years of age must wear a recognized alpine helmet at all times while on the hill, using the chairlift, or using the magic carpet.

Adult Supervision: All participants who are 3.5 feet (42 inches / 106 centimetres) or shorter, are required to be accompanied by an adult or guardian at all times when using the chairlift or magic carpet outside of their scheduled lesson. This requirement applies whenever the participant chooses to continue using these facilities beyond the duration of their scheduled lesson. 

Uplands is only responsible for the participant during the scheduled lesson; outside that time, responsibility goes back to the parent/guardian. 

Additional lift tickets and rental packages may be purchased for parents, guardians, or other adults who wish to remain on the hill before or after the participant’s supervised lesson.

3. LESSONS — Uplands Staff supervision is provided only during the participant’s scheduled lesson time. Uplands staff do not supervise participants before or after their scheduled lesson. 

Participants who have forgotten or lost their program cards must check in at the office before their class begins to obtain a temporary card or pass.

Program participants should arrive for their lesson at least 45 minutes before their scheduled class time. Missed lesson time due to late arrival will not be added to the end of the lesson or rescheduled.

4. EQUIPMENT RENTAL — All those wishing to rent equipment will be required to read, understand and sign a release. A parent’s signature will be required if the individual is under 18 years of age. Helmets are provided as part of the rental package; however, we do not provide goggles or facial coverings. 

Equipment must be returned to the rental office after each lesson. Equipment returned late may be subject to a late charge of $25.00 per hour or part thereof. All participants enrolled in an Uplands program must wear a recognized alpine helmet.

5. PARTICIPANT'S AGE— All program and rate categories are based on the age of the participant as of December 31st, 2026; proof of age may be required.

6. DISCIPLINARY POLICY — Management reserves the right to make any changes to all resort operations, schedules, magic carpet chairlift schedules, terrain, runs, operating times, class times, prices, lessons, and programs. Any violation of the Alpine Responsibility Code, as established by the Ontario Ski Resorts Association (OSRA), constitutes grounds for immediate removal from the ski hill and termination of the individual’s access to Uplands Golf & Ski Club premises.

Where a violation occurs, Uplands Golf & Ski Club reserves the right to immediately revoke the individual’s lift ticket and require the individual to leave the property without refund or compensation. The individual will be advised of the violation(s), and a written record of the incident will be documented and retained on file. 

Uplands Golf & Ski Club reserves the right to review any incident, at its sole discretion, with the General Manager. Any individual under the age of 18 who is found to have violated the Alpine Responsibility Code or any applicable Uplands Golf & Ski Club rules may be required to remain under the supervision of a member of the Club’s management staff until a parent or legal guardian is present and has been advised of the violation.

The General Manager of Uplands Golf & Ski Club, or their designate, shall have the authority to determine the appropriate disciplinary action and the duration of any restriction, suspension, or removal from the ski hill or Club premises, having regard to the nature and severity of the offence. All decisions made pursuant to this policy shall be final, subject to any applicable Club policies or procedures.


SECTION 5: PROPERTY'S CANCELLATION, ILLNESS & WEATHER POLICY — PLEASE READ CAREFULLY!

1. CANCELLATION — Uplands understands that circumstances can arise that may prevent a participant from attending a scheduled lesson. To ensure consistency and fairness for all participants, the following policy applies to all Winter Programs. 

If a participant is unable to attend their scheduled lesson due to illness/injury:

  • A credit equal to the pro-rated value of their remaining outings will be provided as long as a doctor's note is submitted to Uplands within 48 hours of the missed lesson.

Participants are asked to notify Uplands as soon as possible if they are unable to attend due to illness/injury. Credits have no cash value.

Uplands reserves the right to cancel any scheduled group of lessons due to insufficient registration. Participants already registered will be given the option of:

  • Transfer to another class of acceptable date and time.
  • A refund of fees paid.

2. WINTER WEATHER — Winter weather is an inherent part of skiing and snowboarding, and lessons may operate in a variety of winter conditions.

  • If Uplands cancels a scheduled lesson or program due to unsafe weather or operating conditions: Participants will be notified by Uplands and will be eligible for a refund of the cancelled lesson/program.
  • If Uplands remains open and lessons are operating: Lessons will proceed as scheduled, including during snowfall, cold temperatures, wind, rain, or other inclement weather conditions.
  • If a participant chooses not to attend because of the weather, this will not qualify for a refund.
  • If a participant provides notice that they are unable to attend a scheduled lesson due to weather conditions, the maximum accommodation available will be a credit equal to the value of the missed lesson.
  • A credit will only be issued where the recorded temperature at Uplands Golf & Ski Club on the date of the scheduled lesson is −30°C or colder. Eligible credits will be applied to the participant’s Uplands profile and may be used toward eligible future winter programs, lessons, rentals, or other winter-related services offered by Uplands Golf & Ski Club.
  • No refunds or alternative accommodations will be provided for weather-related absences where the temperature does not meet the −30°C threshold.
  • If no notice is provided and the participant does not attend their scheduled lesson, the lesson will be considered a no-show and no refund or credit will be provided.
  • Missed lessons will not be made up.

Under the rare circumstance that Uplands cancels a lesson, we will provide as much notice as possible. Registration forms will require a contact number or email to be used in these circumstances.

3. RESCHEDULING — To ensure consistency and fairness for all participants across all Uplands Golf & Ski Club applies the following procedures in regards to cancellations and rescheduling:

  • More than 14 days notice: Lessons may be cancelled or rescheduled without an administration fee.
  • Within 14 days of the scheduled lesson: Cancellations are subject to a $35.00 + HST administration fee, regardless of whether the lesson was previously rescheduled.
  • All rescheduled lessons are subject to a $35.00 + HST administration fee if cancelled within the 14-day window.
  • Same-day cancellation or no-show: The lesson fee and rental package are non-refundable and non-reschedulable, unless otherwise specified under the Illness or Weather policies above; no credit will be issued.
  • Late arrival: Lessons will end at their scheduled time. Missed lesson time due to late arrival will not be added to the end of the lesson or rescheduled.

4. CANCELLATION DETERMINATION— The decision to cancel a lesson or program due to weather, hill conditions, or operational circumstances rests solely with Uplands and/or the resort. If Uplands has determined that the program can safely operate, the lesson will proceed as scheduled. A participant’s decision not to attend does not constitute an Uplands cancellation. If Uplands cancels the program, the participant will be eligible for a refund. If Uplands continues to operate the program and the participant chooses not to attend, they will not receive refunds or credits for classes or tickets. 

Uplands reserves the right to review exceptional circumstances on a case-by-case basis.
