This document affects your legal rights. Please read it before signing it. I, the below named person being eighteen (18) or older in age, or the parent or legal guardian of the person named below who is under eighteen (18), in consideration of the facilities, services, equipment, events, games, activities, and other opportunities offered, organized, or operated by WAR SPORT NW, LLC., its owners, members, managers, officers, partners, employees, volunteers, referees, game officials, contractors, representatives, successors, assigns, and agents (collectively, "Releasees"), hereby acknowledge, agree, promise and covenant on behalf of myself, the minor participant identified below, my heirs, assigns, personal representatives and estate as follows: ACKNOWLEDGMENT OF RISKS: I UNDERSTAND AND ACKNOWLEDGE that participation in Airsoft and related activities, attendance at WAR SPORT NW, LLC. events, and use of associated premises, facilities, equipment and services involve certain inherent, known and unknown, anticipated and unanticipated risks which could result in INJURY, DEATH, ILLNESS, PERMANENT OR TEMPORARY DISABILITY, PHYSICAL OR MENTAL INJURY, HEARING DAMAGE, OR LOSS OF OR DAMAGE TO PERSONAL PROPERTY belonging to myself or the minor participant identified below. I understand and acknowledge that these risks include, but are in no way limited to, the following: (1) Being struck by Airsoft BBs, projectiles, fragments, equipment, objects, or other participants, which may result in bruising, cuts, abrasions, bleeding, penetration injuries, eye injury, blindness, dental injury, broken teeth, facial injury, or other bodily injury; (2) The use, handling, transportation, discharge, malfunction, accidental discharge, failure, or misuse of Airsoft replicas, magazines, batteries, compressed gas systems, equipment, rental equipment, or other devices; (3) Close-quarters combat ("CQB"), room clearing, movement through buildings, structures, barricades, doorways, stairways, obstacles, uneven ground, vegetation, mud, gravel, debris, confined spaces, low-light areas, and other field conditions, which may result in slips, trips, falls, collisions, impacts, cuts, sprains, fractures, head injuries, or other injuries; (4) Contact or collision with other participants, spectators, referees, structures, vehicles, barriers, equipment, natural objects, artificial objects, or other hazards; (5) The acts, omissions, mistakes, carelessness, rule violations, or ordinary negligence of Releasees or other participants, spectators, or third parties, to the fullest extent permitted by applicable Oregon law; (6) Environmental and physical conditions including heat, cold, rain, wind, smoke, dust, poor visibility, darkness, dehydration, exhaustion, strenuous physical activity, insects, animals, vegetation, terrain, and other natural or artificial hazards; (7) Latent or apparent defects or conditions in equipment, property, structures, terrain, facilities, or other areas used in connection with an event; (8) My own physical or medical condition, physical limitations, actions, omissions, judgment, failure to follow rules or instructions, or use or misuse of equipment; (9) Rescue, first aid, emergency treatment, emergency transportation, evacuation or services rendered, attempted, delayed, or failed to be rendered by Releasees or other persons; (10) Damage to, destruction of, loss of, theft of, or disappearance of personal property, including but not limited to Airsoft replicas, optics, magazines, batteries, chargers, tactical equipment, protective equipment, clothing, footwear, electronic devices, phones, cameras, tools, bags, equipment cases, personal effects, vehicle contents, and other property brought to an event; (11) Property damage caused by Airsoft BBs, projectiles, collisions, impacts, equipment failure, weather, water, fire, smoke, pyrotechnics, Special Effects Devices, other participants, spectators, third parties, or other event-related conditions; (12) Damage to, loss of, theft of, or destruction of personal property occurring during active gameplay or outside of active gameplay, including before an event begins, during registration, during safety briefings, while preparing or repairing equipment, while in staging or designated safe areas, while observing activities, during breaks between games, after gameplay has ended, while entering or leaving an event, or while property is located in or around event or parking areas; and (13) Other risks, whether foreseeable or unforeseeable, known or unknown, anticipated or unanticipated, which may result in injury, death, illness, disability, hearing injury, property damage, or other harm. I UNDERSTAND AND ACKNOWLEDGE that the above list is not complete or exhaustive and that other risks, known or unknown, identified or unidentified, anticipated or unanticipated, may also result in injury, death, illness, disability, property damage, or other harm to myself or the minor participant identified below. PYROTECHNIC, SPECIAL EFFECTS, SMOKE, BLAST AND NOISE RISKS: I UNDERSTAND AND ACKNOWLEDGE that WAR SPORT NW, LLC. Airsoft events may involve the authorized use or presence of pyrotechnic devices, smoke-producing devices, sound-producing devices, simulated grenades, gas-powered devices, explosive-simulation devices, blank-firing or simulation devices, and other event-approved special-effects devices (collectively, "Special Effects Devices"). I understand that Special Effects Devices may create or produce sudden and intense impulse noise, loud reports, blast pressure, heat, flame, sparks, smoke, gases, debris, fragments, hot surfaces, fire, reduced visibility, startling effects, or other hazardous conditions. I understand that such devices may activate unexpectedly, activate earlier or later than anticipated, malfunction, rupture, ignite surrounding material, move or roll after deployment, or activate closer to a participant or personal property than anticipated. I SPECIFICALLY UNDERSTAND AND ACKNOWLEDGE that exposure to Airsoft replicas, Special Effects Devices, pyrotechnic devices, sound-producing devices, blank-firing devices, or other sources of impulse noise may result in TEMPORARY OR PERMANENT HEARING LOSS, TINNITUS OR RINGING IN THE EARS, ACOUSTIC TRAUMA, EAR PAIN OR INJURY, BALANCE OR VESTIBULAR DISTURBANCES, OR OTHER TEMPORARY OR PERMANENT DAMAGE TO THE EAR OR HEARING. I understand that hearing injury may occur suddenly, without advance warning, and potentially from a single exposure to sufficiently intense sound. I further understand that Special Effects Devices may result in burns, eye injuries, respiratory irritation, skin injuries, impact injuries, fire, property damage, serious bodily injury, permanent disability, or death. I understand that hearing protection and other protective equipment may reduce certain risks but cannot eliminate all risk of injury. I agree to comply with all WAR SPORT NW, LLC. rules and instructions concerning Special Effects Devices and to maintain any minimum safety distances or other safety requirements established by WAR SPORT NW, LLC. I will not handle, move, retrieve, tamper with, deploy, relight, or attempt to reactivate any Special Effects Device except as expressly permitted by WAR SPORT NW, LLC. event rules. I KNOWINGLY AND VOLUNTARILY ASSUME THE RISKS associated with the authorized use and presence of Special Effects Devices, pyrotechnics, smoke, and sound-producing devices, including the risks of hearing injury, bodily injury, and property damage. Participant / Parent or Legal Guardian Initials: EYE, FACE AND SAFETY EQUIPMENT ACKNOWLEDGMENT: I UNDERSTAND AND ACKNOWLEDGE that Airsoft projectiles can cause serious and permanent eye or facial injuries. I agree to properly wear all eye protection, face protection, hearing protection, or other protective equipment required by WAR SPORT NW, LLC. while located in areas where such protection is required. I understand that protective equipment may reduce, but cannot eliminate, the risk of injury. I agree to inspect my personally owned protective equipment and other equipment and determine that it is suitable for my use before participating. PERSONAL PROPERTY ACKNOWLEDGMENT: I UNDERSTAND AND ACKNOWLEDGE that I remain responsible for securing, protecting, and monitoring my own personal property and the personal property of the minor participant identified below. Unless WAR SPORT NW, LLC. expressly accepts possession or responsibility for specific property in writing, I understand that WAR SPORT NW, LLC. does not undertake responsibility for the custody, safekeeping, security, storage, monitoring, or protection of personal property brought to an event. I knowingly assume the risks of LOSS, THEFT, DISAPPEARANCE, BREAKAGE, DAMAGE, DESTRUCTION, FIRE DAMAGE, SMOKE DAMAGE, WATER DAMAGE, IMPACT DAMAGE, PROJECTILE DAMAGE, PYROTECHNIC DAMAGE, OR OTHER DAMAGE to personal property associated with attendance at or participation in an event. This assumption of risk applies to property damage or loss occurring before, during, between, or after games and regardless of whether active gameplay is occurring at the time, including while property is located in gameplay areas, staging areas, briefing areas, registration areas, designated safe areas, spectator areas, event-support areas, or parking areas, to the fullest extent permitted by Oregon law. ACCEPTANCE OF RISK AND RESPONSIBILITY: I VOLUNTARILY AGREE, COVENANT AND PROMISE TO ACCEPT AND ASSUME THE RISKS AND RESPONSIBILITIES associated with my participation, or the participation of the minor identified below, including the inherent and disclosed risks described in this Agreement. I understand that participation is voluntary and that I may choose not to participate or may discontinue participation if I believe an activity or condition is unsafe or unsuitable. RELEASE: TO THE FULLEST EXTENT PERMITTED BY OREGON LAW, I, FOR MYSELF AND, IF APPLICABLE, THE MINOR PARTICIPANT IDENTIFIED BELOW, VOLUNTARILY RELEASE, DISCHARGE AND COVENANT NOT TO SUE Releasees from claims arising from injury, death, illness, disability, hearing injury, property damage, or property loss resulting from the inherent or disclosed risks associated with participation in or attendance at WAR SPORT NW, LLC. Airsoft activities or events, including claims arising from the ORDINARY NEGLIGENCE OF RELEASEES. I specifically understand that this Release is intended to include claims arising from the ordinary negligence of Releasees in connection with the activities, events, facilities, equipment, services, administration, or operation of WAR SPORT NW, LLC. events. This Release applies only to the fullest extent permitted by applicable Oregon law and is not intended to release any claim that Oregon law prohibits from being released or waived. PROPERTY DAMAGE AND LOSS RELEASE: TO THE FULLEST EXTENT PERMITTED BY OREGON LAW, I voluntarily release and discharge Releasees from claims arising from loss of or damage to personal property belonging to myself or the minor participant identified below associated with attendance at or participation in a WAR SPORT NW, LLC. event. This includes property damage or loss occurring before, during, between, or after games, whether or not active gameplay is occurring at the time, including damage or loss occurring within gameplay areas, staging areas, briefing areas, registration areas, designated safe areas, spectator areas, event-support areas, or parking areas. I understand that this provision does not waive any claim that applicable Oregon law does not permit to be waived. INDEMNIFICATION: TO THE FULLEST EXTENT PERMITTED BY LAW, I agree to indemnify and hold harmless Releasees from reasonable claims, liabilities, damages, defense costs and attorney fees arising from claims brought by third parties as a result of my own wrongful acts, misconduct, violation of event or safety rules, unauthorized use of equipment or Special Effects Devices, or negligent or intentional injury or property damage caused by me, or, if applicable, by the minor participant identified below. This indemnification provision is not intended to require indemnification of a Releasee for any conduct for which indemnification is prohibited by applicable law. PHYSICAL CONDITION AND FITNESS TO PARTICIPATE: I FURTHER ACKNOWLEDGE that I am in the best position to determine my physical ability, or the physical ability of the minor participant identified below, to participate in the activities contemplated in this Agreement. I acknowledge that I, or the minor participant identified below, am physically and mentally capable of participating or that I have otherwise determined after appropriate consideration that participation is suitable. I understand that I am responsible for discontinuing participation, or causing the minor participant to discontinue participation, when injury, illness, exhaustion, physical limitation, or another condition makes continued participation inappropriate. MEDICAL TREATMENT AUTHORIZATION: In the event of injury, illness, or other medical emergency, I authorize WAR SPORT NW, LLC. personnel to provide or obtain reasonable first aid and emergency assistance and to contact emergency medical services when deemed appropriate. If the participant is a minor, I authorize WAR SPORT NW, LLC. to seek emergency medical treatment for the minor when I cannot reasonably be contacted in sufficient time to provide authorization. I understand that WAR SPORT NW, LLC. personnel may not be medical professionals and that this authorization does not guarantee the availability or outcome of any medical care. RULES AND PARTICIPANT CONDUCT: Myself or the minor participant identified below understand and agree that failure to follow the event, gameplay, equipment, pyrotechnic, Special Effects Device, chronograph, protective-equipment, conduct, and safety rules established and enforced by WAR SPORT NW, LLC., including reasonable instructions issued by referees or event staff, may result in temporary or permanent expulsion from a game or event. If such an expulsion occurs as a result of unsafe behavior, misconduct, violation of rules, or failure to follow reasonable instructions, I understand that I may forfeit any claim to a refund of monies paid for participation in the activity or event from which I or the minor participant was expelled. VOLUNTARY AGREEMENT: I ACKNOWLEDGE that I have carefully read this Agreement and understand its contents. I understand that this Agreement includes an ACKNOWLEDGMENT AND ASSUMPTION OF RISK, RELEASE OF LIABILITY, PROPERTY DAMAGE AND LOSS RELEASE, INDEMNIFICATION AGREEMENT, AND COVENANT NOT TO SUE. I acknowledge that I have had the opportunity to ask questions regarding this Agreement before signing it. I understand that participation is voluntary and that I may decline to sign this Agreement and decline to participate. I am signing this Agreement voluntarily and without coercion or undue pressure. SEVERABILITY: If any portion of this Agreement is determined to be invalid, unenforceable, or broader than permitted by applicable law, I intend that provision to be enforced to the maximum extent permitted by law and that the remaining provisions of this Agreement remain in full force and effect. GOVERNING LAW: This Agreement shall be governed by and interpreted in accordance with the laws of the State of Oregon. September 17, 2026 *****SECTION 2: FIELD WAIVER***** SPECIALTY INSURANCE LLC Industry Insurance Programs Buyserie Farms LLC dba Sniperzden = SNI Phone: (971) 235-0000 RELEASE OF LIABILITY, INDEMNITY AND ASSUMPTION OF RISK READ BEFORE SIGNING IN CONSIDERATION of being permitted to participate in any Paintball and/or Airsoft activities including, but not limited to, playing, using the premises of, renting and operating equipment leased, sanctioned and/or operated by the above named vendor, I acknowledge and agree that: I fully understand and acknowledge that; (a) risks and dangers exist in my use of Paintball and/or Airsoft equipment and my participation in Paintball and/or Airsoft activities; (b) my participation in such activities and/or use of such equipment may result in my injury or illness including but not limited to bodily injury, disease strains, fractures, partial and/or total paralysis, eye injury, blindness, heat stroke, heart attack, death or other ailments that could cause serious disability; (c) these risks and dangers may be caused by the negligence of the owners, employees, officers or agents of SNI; the negligence of the participants, the negligence of others, accidents, breaches of contract, the forces of nature or other causes. These risks and dangers may arise from foreseeable or unforeseeable causes; and (d) by my participation in these activities and/or use of equipment, I hereby assume all risks and dangers and all responsibility for any losses and/or damages, whether caused in whole or in part by the negligence or other conduct of the owners, agents, officers, employees of SNI, or by any other person. I, on behalf of myself, my personal representatives and my heirs, hereby voluntarily agree to release, waive, discharge, hold harmless, defend and indemnify SNI and it’s owners, agents, officers and employees from any and all claims, actions or losses for bodily injury, property damage, wrongful death, loss of services or otherwise which may arise out of my use of Paintball and/or Airsoft equipment or my participation in Paintball and/or Airsoft activities. I specifically understand that I am releasing, discharging and waiving any claims or actions that I may have presently or in the future for the negligent acts or other conduct by the owners, agents, officers or employees of SNI. MEDICAL PERMISSION AUTHORIZATION If the participant is of minority age, the undersigned parent or guardian hereby gives permission for SNI to authorize emergency medical treatment as may be deemed necessary for the child named below while participating in Paintball and/or Airsoft games. I HAVE READ THE ABOVE WAIVER AND RELEASE AND BY SIGNING IT AGREE IT IS MY INTENTION TO EXEMPT AND RELIEVE SNI FROM LIABILITY FOR PERSONAL INJURY, PROPERTY DAMAGE OR WRONGFUL DEATH CAUSED BY NEGLIGENCE OR ANY OTHER CAUSE.
