Tots to Teens Furniture & Rainbow Play of NC Release of Liability Waiver

This Liability Waiver and Release Agreement ("Agreement") is entered into by the undersigned ("Participant") in favor of Person & Person Enterprise, Inc., doing business as Tots to Teens Furniture and Rainbow Play of NC, including its directors, officers, employees, agents, affiliates, successors, and assigns (collectively referred to as the "Company").

  1. Assumption of Risk: The Participant acknowledges and understands that participation in activities at the Company's facilities, including but not limited to laser tag, use of play equipment in the Rainbow Party Room, and any other available structures or activities, involves inherent risks. These risks include, but are not limited to, injury, disability, death, and property damage. The facilities are designed to encourage active play and creativity, offering various features and equipment for participants to enjoy. The Participant voluntarily assumes all such risks, whether known or unknown, and accepts full responsibility for their participation.
  2. Age Verification for Laser Tag: The Participant affirms that all individuals participating in laser tag are 6 years of age or older. This age requirement is in place to ensure the safety and enjoyment of all participants. The Participant is responsible for verifying and providing accurate age information for any minors involved in laser tag activities.
  3. Age Guidelines for Play Equipment: For the use of play equipment in the Rainbow Party Room, it is suggested that participants be 3 years of age or older. The play area includes features suitable for various age groups, with specific equipment designed for toddler play, ensuring a safe and engaging environment for younger children. The Participant must ensure that all minors are using age-appropriate equipment and activities.
  4. Parental Responsibility and Supervision: If the Participant is a parent or legal guardian of a minor, they agree to supervise and remain with the minor at all times during participation in activities. The Participant must ensure the minor's compliance with all safety rules and instructions. The Participant agrees to indemnify the Company against any claims arising from the minor's actions.
  5. Physical Fitness Certification: The Participant certifies that they, and any minors under their supervision, are physically fit to participate in the activities offered by the Company and have not been advised otherwise by a medical professional.
  6. Release and Discharge: The Participant, on behalf of themselves and their heirs, executors, successors, and assigns, hereby releases, discharges, and holds harmless the Company from any and all claims, liabilities, or demands arising from or related to participation in activities at the Company's facilities, including but not limited to claims arising from negligence or other acts.
  7. Compliance with Rules: The Participant agrees to adhere to all rules and conditions of participation as communicated by the Company, whether verbally or in writing. The Participant agrees to report any observed hazards to Company staff immediately.
  8. Acknowledgment of Use: The Participant acknowledges that this Agreement will be relied upon by the Company and that it governs the Participant's actions and rights. The Participant agrees that this Agreement is intended to be as broad and inclusive as permitted by the laws of the state in which the Company operates.

By signing below, the Participant acknowledges that they have read, understood, and voluntarily agree to the terms of this Agreement, intending to be legally bound.
