NOTICE TO THE MINOR CHILD’S NATURAL GUARDIAN

BY SIGNING THIS FORM, YOU ARE GIVING UP YOUR CHILD’S AND YOUR RIGHT TO RECOVER DAMAGES FROM Kingdom Splash Fest FOR INJURIES, DEATH, OR PROPERTY DAMAGE RESULTING FROM THE RISKS OF THIS ACTIVITY. YOU MAY REFUSE TO SIGN THIS FORM, AND Kingdom Splash Fest HAS THE RIGHT TO DENY PARTICIPATION IF YOU DO NOT SIGN.

1. DEFINITIONS

  • The “Participant” refers to the individual engaging in the activity.
  • The “Undersigned” refers to the Participant (if 18 or older) or the Participant’s parent or legal guardian (if under 18).
  • The “Released Parties” refer to Kingdom Splash Fest, its owners, affiliates, employees, agents, officers, directors, members, insurers, and any successors in interest.
  • The “Activity” refers to participation in Kingdom Splash Fest’s Water Park activities.

2. RISKS OF ACTIVITY

The Undersigned understands and agrees that participation in water park activities carries inherent risks, including but not limited to:

  • Drowning
  • Collisions with other participants, watercraft, or structures
  • Slip and fall injuries
  • Unpredictable weather conditions
  • Marine life encounters
  • Equipment failure
  • Physical or emotional injury, including mental distress

The Undersigned acknowledges that this is not an exhaustive list and that unforeseen risks may also be present.

3. RELEASE, INDEMNIFICATION, AND ASSUMPTION OF RISK

(a) RELEASE OF LIABILITY

The Undersigned voluntarily releases, forever discharges, and agrees not to sue Kingdom Splash Fest or any Released Parties for any injury, death, or property damage arising from participation in the Activity, including claims based on negligence.

(b) INDEMNIFICATION

The Undersigned agrees to defend, indemnify, and hold harmless the Released Parties from any liability, costs, or claims arising from the Participant’s participation in the Activity.

(c) ASSUMPTION OF RISK

By signing this agreement, the Undersigned understands and accepts full responsibility for all known and unknown risks associated with the Activity.

4. ACKNOWLEDGEMENT FOR MINORS

For participants under 18, the parent or legal guardian acknowledges that they are signing on behalf of the minor and that the minor is bound by this Agreement. The parent or guardian waives any rights the minor may otherwise have had.

5. MEDICAL CARE

The Undersigned authorizes the Released Parties to seek emergency medical treatment if deemed necessary and agrees to cover all associated costs.

6. MISCELLANEOUS TERMS

  • Participants must comply with all applicable laws and regulations.
  • This Agreement is governed by Florida state law, with exclusive jurisdiction in Bay County, Florida.
  • If any portion of this Agreement is found to be unenforceable, the remaining terms shall remain in effect.

ACKNOWLEDGMENT & AGREEMENT

I HAVE CAREFULLY READ AND UNDERSTOOD THIS RELEASE OF LIABILITY & INDEMNIFICATION AGREEMENT. I UNDERSTAND THAT I AM WAIVING IMPORTANT LEGAL RIGHTS AND ACCEPT ALL RISKS ASSOCIATED WITH PARTICIPATION IN KINGDOM SPLASH FEST.

By signing, I confirm that I have read, understand, and voluntarily agree to this waiver.
