WARNING
Under Kansas law, there is no liability for an injury to or the death of a participant in domestic animal activities resulting from the inherent risks of domestic animal activities, pursuant to K.S.A. 60-4001 through 60-4004. You are assuming the risk of participating in this domestic animal activity. Inherent risks of domestic animal activities include, but shall not be limited to:
The propensity of a domestic animal to behave in ways i.e., running, bucking, biting, kicking, shying, stumbling, rearing, falling or stepping on, that may result in an injury, harm or death to persons on or around them;
the unpredictability of a domestic animal's reaction to such things as sounds, sudden movement and unfamiliar objects, persons or other animals;
certain hazards such as surface and subsurface conditions;
collisions with other domestic animals or objects; and
the potential of a participant to act in a negligent manner that may contribute to injury to the participant or others, such as failing to maintain control over the domestic animal or not acting within such participant's ability. The undersigned voluntarily requests to be permitted on the property of Eagle View Equestrian, LLC, 13030 East Stampede Street, Wichita, Kansas 67230, herein referred to as the Property Owners, for the purpose of participating in or watching equine activities. This agreement shall be in effect upon signing below and automatically renews annually. The undersigned, for and behalf of myself or my child and legal ward, acknowledge that I have been fully advised by Eagle View Equestrian, LLC, that I or my child or legal ward should purchase and wear a properly fitted and secured ASTM/SEI-Certified equestrian riding helmet while riding, driving, or near horses in order to reduce the severity of some head injuries and possibly prevent death from happening as the result of a fall or other occurrences. RISKS INVOLVED IN EQUINE ACTIVITIES: - I am fully aware and understand that ALL riders under 18 are required to wear and use safety equipment (helmet, gloves, riding boots) at all times. Helmets are highly encouraged for adults.
- I understand that children under the age of 18 must be supervised at all times and are not permitted to ride alone. I further understand that riders are not permitted to jump their horse outside of a supervised lesson, or they must be under the direct supervision of their parent/guardian if their trainer has approved in advance.
- I understand that children under the age of 18 who are not riding must be supervised at all times. They are not allowed to climb on hay bales, equipment, etc, nor are they allowed to wander the property alone.
- I am fully aware and understand that horses are unpredictable by nature; and when frightened, angry, or under stress, it is a horse’s natural instinct to jump forward and/or sideways, to run away from danger at a trot or gallop, to kick, to buck, to rear up, or to bite, and that horses are extremely powerful. I understand that I could be injured as a result of any of these or other actions of a horse. I understand these risks, and I voluntarily assume these risks and dangers.
- I further understand that upon mounting a horse, driving a carriage, and/or taking up the reins, the rider/driver is in primary control of the horse, and that the Property Owners are not responsible for the results of the rider’s/driver’s actions or inactions, or for the action of the horse or faulty equipment.
- All common areas (indoor and outdoor arenas, wash racks, hallway, surrounding property) must be kept clean and free of trash, manure, mud, and/or hoof pickings. Failure to pick up after yourself and your horse in any of the common areas will result in being assessed a $20 fine per occurrence.
- Barn and arenas may be closed at any time with or without notice by STABLE. Participant agrees not to disrupt any activity/work ongoing in this case.
- No firearms are allowed on the property unless authorized (Law Enforcement Officer (LEO) or you have a concealed carry permit issued by the state of Kansas or other state with Kansas reciprocity). This specifically serves as notice excluding Constitutional Carry on the property. The purpose is to ensure permitted individuals have received training in the laws and practical use of firearms.
- Proper attire and footwear are required at all times.
- Notify STABLE if something is in need of repair. Turn off lights, fans, radios, etc., when not in use. Please do not use equipment which does not belong to you unless you have been granted permission to use it.
- SMOKING, DRUG USE and DRUG POSSESSION are NOT allowed on the property. Consumption of alcohol is discouraged. At no time should any OWNER, trainer, or guest be intoxicated or under the influence of drugs.
- The speed limit on property is 10 mph, and pedestrians, riders, horses, and farm equipment have the right-of-way. Do NOT drive or park on the grass. Park only in designated spaces.
- Report any unsafe situation immediately to the Property Owners.
- I fully understand and agree that I alone am to be responsible for any bodily injury which I should sustain on the grounds of the Property Owners while engaged in general recreation, riding, driving, viewing, caring for a horse, or for any time and/or money I should lose from employment or activity or for the medical expenses or any other expenses incurred because of such bodily injury or property damage.
- In acknowledgment of the above, I hereby, for myself and my heirs, HOLD HARMLESS the Property Owners, and their respective servants, agents, employees, officers, and all other participants of and from all claims, demands, actions, and causes of action for such injuries sustained to my person or property whether or not such injury or property damage resulted from the negligence or gross negligence of the Property Owners, or their servants, agents, employees or officers, or resulted from any defect in tack or equipment that might be used on or around the property.
- I understand and agree that in exchange for being permitted to participate in general recreational activities and/or the boarding, viewing, caring for, riding or driving of horses on the property of the Property Owners, I am voluntarily assuming the risks of agreement that I may not bring a lawsuit or a claim of any kind against the Property Owners, their servants, agents, employees or officers for such injuries and/or property damage. If I should bring such claim or lawsuit in violation of this agreement, I agree that I shall be liable to the Property Owners for any and all reasonable attorney’s fees and expenses that may be incurred by the Property Owners in defending such claims.
- I further agree to indemnify and reimburse the Property Owners, their servants, agents, employees or officers for any injury and/or property damage to any third person as a result of any action or inaction on my part. This indemnification included the reasonable cost of attorney’s fees and expenses incurred by the Property Owners in defending against and such suit.
I testify that I have read and fully understand and agree to the above.
