SOUTH CAROLINA EQUINE ACTIVITY WARNING

Under South Carolina law, an equine activity sponsor or equine professional is not liable for an injury to or the death of a participant resulting from the inherent risks of equine activity, pursuant to Article 7, Chapter 9 of Title 47, Code of Laws of South Carolina, 1976.

1.    Assumption of Risk

I acknowledge and fully understand that participation in equine activities, including but not limited to equestrian trail rides, fox hunting, clinics, horse showing, trail clearing, and/or social gatherings (collectively, the “Equine Activities”) involves inherent risks of injury, death, and property damage.

These risks include, but are not limited to:

  • Unpredictable behavior of horses, hounds, and other animals.
  • Riding over rough, steep, or wet terrain, including fences, ditches, and obstacles.
  • Environmental hazards, such as uneven ground, weather conditions, and natural obstacles. I knowingly and voluntarily assume all risks associated with participation in the Equine Activities.

2.    Release of Liability

In consideration of being permitted to participate in the Equine Activities, I, the undersigned, for myself, my personal representatives, heirs, next of kin, and assigns, hereby release, waive, and discharge Wateree Hounds, its masters, directors, officers, shareholders, employees, independent contractors, volunteers, agents, members, guests, and the owners, heirs, representatives, and families of any private or public properties where the Equine Activities take place (collectively, the “Releasees”), from and for any and all liability, claims, demands, actions, or causes of action arising out of or related to any injury, death, or damage to myself, my horse, or my property, whether caused by the negligence of the Releasees or otherwise.

3.    Indemnification and Hold Harmless

I further agree to indemnify, hold harmless, and defend the Releasees from any claims, liabilities, damages, costs, or expenses, including reasonable attorney’s fees, arising out of or related to my participation in the Equine Activities. This indemnification extends to any claims made by third parties resulting from my actions during participation in the Equine Activities.

4.    Participant Representations

By signing this agreement, I represent and warrant that:

·        I am physically and mentally fit to participate in the Equine Activities.

·        I am experienced and comfortable handling and riding horses in various environments.

·        I will follow all rules, instructions, and safety guidelines provided by Wateree Hounds and its representatives.

5.    Agreement Scope and Severability

This agreement is intended to be broad and inclusive as permitted by the laws of the State of South Carolina and any other applicable jurisdictions. If any part of this agreement is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect. This agreement applies to all Equine Activities conducted during the 2024-2025 season.

6.    Acknowledgment and Acceptance

By signing below, I confirm that I have read, understood, and voluntarily agreed to this release and waiver of liability, assumption of risk, and indemnity agreement. I understand that I am giving up substantial rights by signing it, and I sign it freely and voluntarily without inducement or assurance of any kind.
