REGISTRATION & DOCKAGE AGREEMENT

For the rental and other payments hereinafter expressed and in consideration of the Owner’s compliance with all of the rules and regulations set forth herein, Marina Jack, LLC (the "Company") hereby leases to the Owner the above-designated slip located at Marina Jack Marina in the City of Sarasota, Florida for the period of time and the monthly rental stated.

Owner agrees to comply with all posted rules and regulations promulgated by the Dockmaster, as fully as though they were set forth herein, and should breach of this agreement or violation of posted rules and regulations occur, this rental agreement shall terminate immediately, and Company may remove the boat from her mooring space at the Owner’s risk and expense and retake possession of the mooring space.

The parties agree that the Company shall have a lien against the above described boat her appurtenances and contents for unpaid rent or other services or for damage caused or contributed to by the boat or by its owner, occupants, or operator to any docks or property of the Company or any other person or property at Marina Jack. In the event any lien is place on the boat her appurtenances and contents a notice of lien shall be affixed to the boat in a prominent place. The boat shall then not be removed from the Company’s dock without the written consent of the Company. Should the boat be removed from the premises with or without the Owner’s consent, the Owner hereby agrees that the lien granted by this paragraph against the boat shall continue in full force and effect. Unpaid dock rental shall bear interest at the highest rate permissible under the laws of the State of Florida. In the event the Owner fails to comply with the terms of this agreement, the Owner agrees to pay all costs and expenses, including a reasonable attorney’s fee for any trial or appellate proceeding or otherwise incurred by the Company.

The parties agree that this is a nonresidential tenancy and notwithstanding any court decision to the contrary ordinary landlord and tenant law shall apply. The legal relationship between the parties shall be controlled by Fla Stat. Cpt. 83 Part 1 NONRESIDENTIAL TENANCY as in effect on January 1, 1983.

Attention: This agreement is for the use of pier space only, and such space is to be used at the sole risk of the Owner. Company shall not be liable for the care or protection of the boat (including her contents, gear, or equipment) whether due to the sole negligence of Company. Owner indemnifies and holds Company harmless against any loss, costs, suit or claim arising out of the use of pier space or any handling of the boat in connection therewith whether or not such loss, costs, suit or claim is based upon the sole negligence of Company.

Hurricanes: In the event of a tropical storm watch or warning, the yacht basin, marina, and docks may be cleared of all vessels. The Dockmaster in his sole discretion shall determine when this will be necessary. 

This agreement shall be in effect until terminated in accordance with the following conditions to-wit:

a) By destruction of the anchorage facilities by fire, storm, or other calamity.

b) By breach or default as provided in Paragraph 1 above. 

RULES & REGULATIONS GOVERNING DOCKAGE

To provide an inviting atmosphere for boat owners docking at Marina Jack, the following rules and regulations are provided for your protection. Your cooperation in observing the following rules will be appreciated.

  1. When a boat enters the marina, it immediately comes under the jurisdiction of the Company.
  2. Dockage day starts at 7:00am. Any vessel docked prior to 7:00am will be charged dockage for the previous night. Check- out time shall be 11:00am. Any vessel that occupies a berth after 11:00am will be charged for the following night.
  3. Boat owners leaving for an extended time will so notify marina office. The marina reserves the right to rent all boat slips when so vacant.
  4. The marina is a no wake zone. Speed limit is 6 mph.
  5. Walkways, piers, and docks shall be kept clear of objects, trash, supplies, and materials.
  6. Boat owners may not sublease or permit boats owned by others in their slip.
  7. Boats must be kept in a safe, clean, and attractive condition
  8. Cords and Hoses may not run across dock areas and walkways
  9. No charcoal fires are permitted on boats or Marina dock areas. Liquid or gas fueled units are permitted only if properly secured to the vessel and equipped with fire extinguisher.
  10. All repair work and/or outside contracted service must be approved by Dockmaster.
  11. No fuel will be pumped/transferred from containers on dock areas. Boats must receive fuel from the fuel dock.
  12. Pets must always be kept on a leash and picked-up after.
  13. Laundry shall not be hung on boats.
  14. Disorderly conduct, excessive noise, etc. is prohibited inside the marina.
  15. All owners are responsible for the proper docking of their boat at the marina. The Company assumes no responsibility for the safety of any boat while tied up at the marina.
  16. Payment of all accounts is required each 30 days or upon leaving marina. Failure to do so will constitute a contractual lien on the property of the boat owner and subject to levy without notice.
  17. The company reserves the right to evict a boat, its owner and guest when, in the sole discretion of the Company, any rule is being violated.

Waiver of any conditions hereunder by Company shall not be deemed to be a continuing waiver. Rates subject to change on 30 days prior notice.

OFAC Compliance. Company is obligated to comply with U.S. economic sanctions laws and regulations enforced by the Office of Foreign Assets Control (“OFAC”) of the U.S. Department of the Treasury. Owner hereby certifies and represents that neither it, nor any of its owners, members of its governing body, management, employees or agents is on the List of Specially Designated Nationals and Blocked Persons maintained by OFAC (the “List”), or is acting for, or on behalf of any person or entity on the List or any country or territory that is the subject of sanctions by OFAC. Owner further acknowledges its obligation to remain in compliance with existing and future regulations promulgated by OFAC throughout the Term of the Agreement, including all restrictions on vessels that have recently transited Cuba. Notwithstanding anything to the contrary herein contained, Owner shall not permit the premises or any portion thereof to be used, occupied or operated by or for the benefit of any person or entity that is on the List. Owner shall provide documentary and other evidence of Owner ’s identity and ownership as may be reasonably requested by Company at any time to enable Company to verify Owner’s identity or to comply with any legal requirement. 

SLIP ASSIGNMENTS ARE TEMPORARY AND MAY BE CHANGED AT MANAGEMENT'S DISCRETION. 

PLEASE RETURN YOUR KEY FOB TO AVOID BEING CHARGED. $100 REPLACEMENT FEE PER FOB. 

CHECK-OUT TIME IS 11:00AM. VESSELS REMAINING IN SLIP PAST 11:00 AM WILL BE CHARGED FOR AN ADDITIONAL OF TRANSIENT DOCKAGE AT THE CURRENTLY PUBLISHED PRICE. 

VESSEL HAS 7 DAYS TO CONVERT TO LONG-TERM CONTRACT.
