RENTAL AGREEMENT THIS RENTAL AGREEMENT (“Agreement”) is made by and between LWPR, LLC, a Wisconsin limited liability company (“Company”) and the individual(s) named below, whether one or more, as “Customer”. 1. Equipment. Customer is renting the following from Company: 2021 Sylvan, 20-foot, pontoon with a Yamaha 40-horse outboard motor that seats ten (10) people (“Pontoon”), one fire extinguisher, safety throwing float, and ten (10) adult life jackets, anchors and tie downs, blue tooth radio/stereo, changing room, depth finder, awning, and swim ladder, one (1) tank of fuel, and any other items rented from Company (with the Pontoon and all other items collectively referred to as the “Equipment”). Company also provides Customer with a map of Lake Wissota notated with points of interest. Customer may purchase gas from The Edge Pub and Eatery on Lake Wissota. 2. Rental Date(s) and Time(s). The Equipment is leased to Customer for the following date(s) and time(s): . Rentals for more than one (1) day must have suitable docking or lift for the Pontoon, as determined by the Company in its discretion. 3. Authorized Operator(s). The following individual(s) will be the only person(s) who will operate the Pontoon: 4. Rental Fee; Payment; Damage Deposit; Late Fee. The Rental Fee is based on the date(s) and time(s) the Equipment is being rented to Customer as set forth on Company’s current rate sheet. The Company’s cancellation policy is also on its current rate sheet. At the time the Equipment is picked up by Customer or delivered by Company to an agreed-upon location, Customer will pay Company a deposit in the amount set forth on the Company’s current rate sheet (“Damage Deposit”). The Damage Deposit will be refunded by Company if there is no damage to the Equipment at the time it is returned. Customer will also pay a late fee in accordance with the Company’s current rate sheet (“Late Fee”). 5. Customer Representations and Warranties. Customer represents and warrants to Company all of the following: A. Each Customer and each Authorized Operator is twenty-five (25) years or older and shall operate and use the Equipment in an appropriate and safe manner at all times. B. Each Authorized Operator is licensed by the appropriate governmental authorities to operate the Pontoon and such license is not revoked, suspended, or otherwise not effective. C. There shall be NO smoking, NO pets, NO grills or other cooking equipment of any kind on the Pontoon, NO towing (tubing or skiing), NO tying up with other boats, NO fishing from the Pontoon, and NO docking or locating the Pontoon on any rocky shores while using the Equipment. D. While operating the Pontoon, the Authorized Operator will be the designated driver of the Pontoon. E. If needed, Customer will fill the gas tank with non-ethanol fuel ONLY. F. Customer will abide by all rules and regulations provided by Company whether in one or more separate documents in addition to this Agreement. 6. Indemnification and Hold Harmless. Customer agrees to indemnify, defend, protect and hold harmless Company from and against any and all liabilities, obligations, claims, damages, costs and expenses (including reasonable attorney’s fees, accountant’s fees, and court costs and expenses) incurred by or asserted against Company by reason of: (a) any injury to or death of persons or loss of or damage to property occurring as a result of Customer’s use or rental of the Equipment, (b) any injury to or death of persons or loss of or damage to property occurring as a result of any Authorized Operator’s use or rental of the Equipment, and (c) any failure on the part of Customer to perform or comply with any of the terms of this Agreement. 7. Construction of Agreement. This Agreement shall be binding upon and shall inure to the benefit of the Company and its assigns and successors. Customer shall not assign or in any manner transfer Customer’s rights or obligations under this Agreement without the prior, written consent of Company. This Agreement supersedes any and all prior agreements and understandings, whether written or oral, between the parties with respect to the subject matter hereof. No change, amendment, or modification shall become effective unless in writing and signed by all of the parties hereto. This Agreement may be signed and electronically transmitted in counterparts (i.e., .pdf) and each counterpart shall be one and the same document. This Agreement shall be governed by, construed, and enforced in accordance with the laws of the State of Wisconsin.
