IMPORTANT – READ CAREFULLY BEFORE SIGNING This is a legally binding agreement that includes a release of liability and indemnification clause. By signing, you agree to waive certain legal rights and to hold Sip & Anchor Luxury Tours and Boat Charters and its representatives harmless from all claims arising from your use of the rented boat. Please read all sections thoroughly. Release and Waiver of Claims In consideration for being allowed to rent and operate a boat from Sip & Anchor Luxury Tours and Boat Charters, the undersigned ("Renter") hereby releases, waives, and forever discharges Sip & Anchor Luxury Tours and Boat Charters, its owners, employees, agents, affiliates, successors, and assigns, from any and all claims, liabilities, demands, damages, actions, or causes of action, known or unknown, arising out of or in connection with the rental and/or use (or misuse) of any boat or related equipment. This release applies to all injuries, losses, or damages sustained by the Renter or any passengers, whether caused by negligence or otherwise. Indemnification The Renter agrees to indemnify, defend, and hold harmless Sip & Anchor Luxury Tours and Boat Charters and its representatives from any and all claims, damages, losses, or expenses (including legal fees) arising out of or resulting from the Renter’s operation, misuse, or negligence during the use of the watercraft. Terms and Conditions of Rental 1. Assumption of Risk - The Renter understands and accepts that boating involves inherent risks, including the potential for injury, death, or property damage. By signing this agreement, the Renter assumes full responsibility for these risks.
2. Proper and Safe Use
- The Renter agrees to operate the boat in a safe, responsible, and lawful manner. The Renter will be the sole operator unless otherwise approved in writing and agrees to follow all instructions provided by Sip & Anchor staff, as well as all local and federal boating laws.
3. Prohibited Activities - Do not exceed the number of passengers allowed on board.
- No smoking is permitted aboard any Sip & Anchor vessel.
- Alcohol and drugs are strictly prohibited. Coolers and bags may be inspected for compliance.
- No animals are permitted on the boat unless pre-approved in writing.
4. Children On Board
- All children under the age of 12 must wear a properly fitted life jacket at all times while on board.
5. Hazardous or Unsafe Use
- Sip & Anchor reserves the right to terminate the rental without refund if the Renter is deemed to be operating the boat unsafely or in violation of any terms. Determination of unsafe use is at the sole discretion of Sip & Anchor personnel.
6. Boat Condition Upon Return
- The Renter agrees to return the boat clean and in the same condition as it was at the start of the rental. The Renter will be held responsible for any damage beyond normal wear and tear, and Sip & Anchor may withhold some or all of the security deposit to cover such costs. Damages exceeding the deposit will be billed to the Renter.
Rental Boat Safety Checklist (Transport Canada Requirement) This checklist must be reviewed and co-signed at the time of rental. It serves as proof of competency and must remain on board for the duration of the rental. You will get a copy of the Rental Boat Safety Checklist on site once your have completed the rental boat safety briefing. Your signature confirms your understanding and compliance of all the Rental Boat Safety Checklist items below: ☐ I confirm there are properly fitted life jackets for every passenger on board. ☐ I understand it is illegal to operate a boat under the influence of drugs or alcohol. ☐ Only individuals with proof of competency may operate the boat. ☐ I have been shown the required safety equipment and its location. ☐ I understand how to safely interact with non-powered vessels and am responsible for my wake. ☐ I agree to stop and offer assistance in case of an accident. ☐ I will operate the boat courteously and responsibly on shared waterways. ☐ I will not exceed the boat's maximum passenger or weight capacity. ☐ I understand how to start and shut off the engine safely. ☐ I know how to operate the throttle and gear shift. ☐ I know how to use the ignition cut-off (kill) switch. ☐ I understand how to safely depart from and return to the dock. ☐ I have been briefed on what to do in the event of grounding or capsizing. ☐ I am familiar with local hazards, navigational markers, and relevant regulations. ☐ I will maintain awareness of weather conditions and hazards. ☐ I understand that towing (including tubes, boards, or assisting another vessel) requires a spotter over age 19. ☐ I agree to have a working cell phone on board for emergencies. Policies and Requirements 1. Age and License Requirements
- Renters must be at least 21 years old with a valid government-issued driver’s license.
2. Zero Tolerance for Substances
- Use of alcohol or drugs while operating the vessel is strictly prohibited.
3. Damage Deposit
- A refundable pre-authorization of $2,000 is required at the time of rental. Damages assessed upon return may be deducted. Excess damages will be invoiced.
4. Boating License & Checklist
- A pleasure craft license is not required; however, the Transport Canada Rental Boat Safety Checklist must be completed on-site.
5. Rescue Charges
- If rescue or towing is required due to Renter error or negligence, a $500 fee will apply.
6. Cancellations Due to Safety or Mechanical Issues
- Sip & Anchor reserves the right to cancel a booking for mechanical issues or unsafe weather conditions without penalty.
7. Late Arrival Fees
- A $50 fee will apply for every 15 minutes past the scheduled arrival time.
8. Fuel Policy - Fuel is not included in the rental rate.
- Fuel usage will be calculated after the rental and charged at the posted fuel rate plus a 25% service fee.
- Marina fuel prices are typically higher than roadside prices.
9. Propeller Damage Charges - Runabout/Pontoon boats: Minimum $500 for prop damage, based on severity.
- Surf boats: Minimum $1,500 for any damage to the propeller.
