LITTLE HEARTS ON THE PRAIRIE FARM LLC

RELEASE OF LIABILITY, ASSUMPTION OF RISK, INDEMNITY, AND PHOTO RELEASE

In consideration of being allowed to enter, visit, participate in activities, or attend events at Little Hearts on the Prairie Farm LLC, including farm tours, petting zoo activities, animal interactions, playground use, baseball games, sports activities, walking trails, fields, parking areas, and any other farm or recreational activities, I agree as follows:

AGREEMENT AND WARNING

I UNDERSTAND AND ACKNOWLEDGE THAT AN AGRITOURISM ENTITY IS NOT LIABLE FOR ANY INJURY TO OR DEATH OF AN AGRITOURISM PARTICIPANT RESULTING FROM AGRITOURISM ACTIVITIES. I UNDERSTAND THAT I HAVE ACCEPTED ALL RISK OF INJURY, DEATH, PROPERTY DAMAGE, AND OTHER LOSS THAT MAY RESULT FROM AGRITOURISM ACTIVITIES.

FARM ANIMAL WARNING

WARNING: UNDER TEXAS LAW, CHAPTER 87, CIVIL PRACTICE AND REMEDIES CODE, A FARM ANIMAL PROFESSIONAL OR FARM OWNER OR LESSEE IS NOT LIABLE FOR AN INJURY TO OR THE DEATH OF A PARTICIPANT IN FARM ANIMAL ACTIVITIES, INCLUDING AN EMPLOYEE OR INDEPENDENT CONTRACTOR, RESULTING FROM THE INHERENT RISKS OF FARM ANIMAL ACTIVITIES.

Assumption of Risk

I understand that farm, animal, sports, and outdoor recreational activities involve inherent risks, including but not limited to: bites, kicks, scratches, allergic reactions, disease exposure, uneven ground, holes, mud, insects, weather, heat, playground injuries, falls, collisions, baseballs, bats, sports equipment, fences, gates, vehicles, farm equipment, and the unpredictable actions of animals, children, guests, or other participants.

I voluntarily choose for myself and/or my minor child to enter the property and participate in these activities. I accept all risks of injury, illness, death, property damage, or loss, whether known or unknown.

Release of Liability

To the fullest extent allowed by Texas law, I release and agree not to sue Little Hearts on the Prairie Farm LLC, its owners, members, managers, employees, volunteers, contractors, event organizers, coaches, agents, affiliates, and property owners from any and all claims, demands, damages, losses, injuries, illnesses, death, or expenses arising out of or related to my or my minor child’s visit, participation, or presence on the property, including claims based on ordinary negligence.

This release does not apply to claims that cannot legally be released under Texas law.

Minor Children

I am the parent, legal guardian, or authorized adult responsible for the minor child or children listed above. I accept full responsibility for supervising them at all times. I understand that children must not enter animal enclosures, touch animals, climb fences, use equipment, or participate in activities unless permitted by Little Hearts on the Prairie Farm LLC staff or posted rules.

I agree that this waiver applies to all minor children listed above.

Indemnity

I agree to defend, indemnify, and hold harmless Little Hearts on the Prairie Farm LLC and the released parties from any claim, cost, attorney’s fees, medical expense, or liability caused by or related to my actions, my child’s actions, my guests’ actions, or any failure to follow posted rules or staff instructions.

Medical Authorization

In the event of an emergency, I authorize Little Hearts on the Prairie Farm LLC to seek emergency medical care for me or my minor child if I am unable to do so. I understand I am responsible for all medical costs.

Rules and Safety

I agree to follow all posted rules and verbal instructions. I understand that failure to follow rules may result in removal from the property without refund. I agree not to feed animals unless authorized, not to run near animals, not to enter restricted areas, and not to handle equipment, gates, vehicles, or farm tools unless permitted.

Photo and Video Release

I give Little Hearts on the Prairie Farm LLC permission to use photos or videos taken during visits or events for marketing, social media, website, promotional, or business purposes, without compensation.


Acknowledgment

I have read this document carefully. I understand that I am giving up legal rights, including the right to sue for certain injuries or damages. I sign this voluntarily.
