RIGHT OF ENTRY AGREEMENT AND RELEASE AND WAIVER OF LIABILITY


EACH AND EVERY PERSON ENTERING THE PROPERTY MUST SIGN AND ACCEPT THE TERMS OF THIS AGREEMENT PRIOR TO ENTERING THE PROPERTY


In consideration of being granted the right to access the property of Backyard Wildflower Patch LLC located at 728 Bedford Street, Chesapeake, VA 23322 and in consideration of my voluntary decision to enter the property, I agree and warrant as follows:


1. I hereby assume all risk of accidents, personal injury, death and property loss or damage sustained or incurred as a result of my presence at the property (including, but not limited to, during my participation of photography), including those caused as a result of negligence on the part of the Backyard Wildflower Patch LLC including the property owners.

2. I further agree to release, discharge, waive, indemnify and hold harmless from and against all liabilities, actions, causes of actions, suits, damages, losses, judgments, claims and demands whatsoever, in law or in equity, including legal fees and disbursements, which I, any company or business entity that I represent, or my heirs, executors, administrators, legal representatives, successors, or assigns may now or hereafter have against the Backyard Wildflower Patch LLC including the property owners for any personal injury, death or property damage.

3. I acknowledge that it is my sole responsibility to evaluate carefully the risks inherent in visiting the Backyard Wildflower Patch LLC and that I have fully considered those risks, including, without limitation, dangers posed by willful or negligent conduct of myself and/or by others.

4. I acknowledge and agree that I will follow instructions and shall not cause damage to the property or I shall bear full responsibility, including costs and expenses, to repair any damage as a result of my entry upon the property of the Backyard Wildflower Patch LLC.

5. I understand that Backyard Wildflower Patch LLC is located near Fentress Airfield and understand that it is possible that jets may be flying during my session. (Weekends are typically quiet, weeknights are unpredictable and we just want to give fair warning).

6. Rules for all guests utilizing the Sun Porch: Rental time must include setup and take down time needed for any additional props or styling time. No food or drink allowed, unless approved. Please refrain from touching the windows. Children and pets must be monitored at all times, no throwing objects or running in the Sun Porch. Pets must be watched closely the entire time and kept under your control, so there is no risk of them urinating inside. Guests agree to use the swing at their own risk. Renter must exit the Sun Porch promptly upon ending rental time to allow for the next renters sessions. Renter agrees to leave the Sun Porch in the original state of cleanliness so that the space is ready for the next renter. Renter agrees to pay for any repair and/or full replacement costs of equipment or damages caused during the rental time. If renter does not leave the Sun Porch in the clean and orderly condition it was found, there may be an additional charge. Should the renter arrive on site and find any damaged, dirty or otherwise not functional items, it is the renter’s responsibility to immediately contact BWP to report said damages, safety concerns or other issues.

7. Pets: I understand all pets must be kept on a leash while on the property and I must keep full control of them to prevent urinating on furniture or decor. If an accident happens, I will notify the owners immediately and understand that I will be required to pay a $50 cleaning fee along with other possible fees to replace damaged property.

8. Parking: I have been given full parking instructions. I understand there is no on street parking whatsoever and I will follow the parking pattern in the driveway.

9. Renter: I acknowledge that I must give as much notice as possible if I need to cancel my session. I understand that no-shows will not be tolerated and that I will be responsible to pay for my missed session in full before I am able to rebook.

10. I understand that I must reserve separate areas to be able to have access to them. I understand the Sun Porch, wildflowers and outdoor sets are all separate, and will not use any of the spaces unless I have reserved them and have permission.

11. I have read this entire waiver and agree to all of the instructions.

By signing this Right of Entry Agreement and Release and Waiver of Liability, I certify that I have read this Release and fully understand it and that I am not relying on any statements or representations made by the owners of Backyard Wildflower Patch LLC. The undersigned represents and warrants that he/she is at least 18 years of age, and voluntarily agrees to all of the terms of this Release.
