RIGHT OF ENTRY AGREEMENT AND RELEASE AND WAIVER OF LIABILITY


EACH AND EVERY PERSON ENTERING THE PROPERTY MUST SIGN AND ACCEPT THE TERMS OF THIS AGREEMENT PRIOR TO ENTERING THE PROPERTY


In consideration of being granted the right to access the property of Backyard Wildflower Patch LLC located at 728 Bedford Street, Chesapeake, VA 23322 and in consideration of my voluntary decision to enter the property, I agree and warrant as follows:


1. I hereby assume all risk of accidents, personal injury, death and property loss or damage sustained or incurred as a result of my presence at the property (including, but not limited to, during my participation of photography), including those caused as a result of negligence on the part of the Backyard Wildflower Patch LLC including the property owners.

2. I further agree to release, discharge, waive, indemnify and hold harmless from and against all liabilities, actions, causes of actions, suits, damages, losses, judgments, claims and demands whatsoever, in law or in equity, including legal fees and disbursements, which I, any company or business entity that I represent, or my heirs, executors, administrators, legal representatives, successors, or assigns may now or hereafter have against the Backyard Wildflower Patch LLC including the property owners for any personal injury, death or property damage.

3. I acknowledge that it is my sole responsibility to evaluate carefully the risks inherent in visiting the Backyard Wildflower Patch LLC and that I have fully considered those risks, including, without limitation, dangers posed in nature and by willful or negligent conduct of myself and/or by others.

4. I acknowledge and agree that I will not cause damage to the property, including any buildings, structures, plants, flowers, props, or other items belonging to Backyard Wildflower Patch LLC. If I or anyone in my party causes damage, I agree to be fully responsible for any costs and expenses required to repair or replace the damaged property. I also agree to notify the owners immediately of any damage that occurs during my visit.

5. Instructions: I acknowledge that each space has specific instructions and agree to read and follow the instructions for the space I have rented. I also agree to read any signs on the property, which may include important rules that I agree to follow.

6. Spaces: I understand that the property includes separate spaces and sets that must be specifically reserved in order to be used. I agree not to enter, use, photograph in, use as a backdrop, or allow children to play in any space or set that I have not reserved, including:

The Sun Porch, Vintage Trucking, Horse Trailer, Wildflower Fields, & Individual Holiday Sets.

I understand I must reserve each space separately in order to have access to them. If I am found using spaces I did not reserve, I understand I will not be permitted back on the property.

7. Parking & Payment: I acknowledge that I have been given full parking and payment instructions. I understand there is no on-street parking whatsoever and agree to follow the designated parking pattern in the driveway and use extreme caution when entering and exiting. I understand how payment is made and agree to follow the provided payment instructions.

8. Pets: I understand all pets must remain leashed and under my full control at all times, and I am responsible for cleaning up after them. I agree to prevent pets from charging or approaching other people or animals and from urinating on furniture or décor. Pets are not permitted on furniture unless I provide my own blanket or protective covering. I agree to notify the owners immediately of any accidents or damage and understand that a $50 cleaning fee may apply for accidents, muddy paw prints, or scratches, with additional charges possible for damaged property.

9. Jet Noise: I understand that Backyard Wildflower Patch LLC is located near Fentress Airfield and understand that it is possible that jets may be flying during my session. (Weekends are typically quiet, weeknights are unpredictable and we just want to give fair warning).

10. Weather Policy: Weather decisions are determined the day of by Backyard Wildflower Patch based on conditions at the property. Forecasts are not grounds for cancellation. We monitor conditions closely and allow for changing weather, with decisions being made within the designated timeframe, no later than 4 hours before the scheduled session time. Travel distance, convenience, cloudy skies, and the possibility of rain in another location are not factors we take into consideration. If you choose not to attend after a decision has been made to continue sessions, the session fee remains due.

11. Cancellations/No-Shows: I agree to the cancellation/no-show policy that has been provided to me in the instructions. I understand they may be updated from time to time and can always be accessed on the website at: https://backyardwildflowerpatch.godaddysites.com/cancellation-policy

12. 2026 Waiver Acknowledgment: I have read this entire waiver, understand it, and agree to follow all rules, policies, and instructions outlined in it and the instructions for the entire 2026 season. I understand that this acknowledgment applies to all current and future bookings I make with Backyard Wildflower Patch during the 2026 season.

By signing this Right of Entry Agreement and Release and Waiver of Liability, I certify that I have read this Release and fully understand it and that I am not relying on any statements or representations made by the owners of Backyard Wildflower Patch LLC. The undersigned represents and warrants that he/she is at least 18 years of age, and voluntarily agrees to all of the terms of this Release.
