MEGA DUDES PERMISSION FORM, ASSUMPTION OF RISK, WAIVER, RELEASE, AND HOLD HARMLESS AGREEMENT 

I am the parent and/or legally authorized guardian of the individual participating in athletic activities through Mega Dudes LLC and JGSG Investments LLC (the “Organizations”). On behalf of myself, my spouse, my child/ward (the “Participant”), and my/our heirs, personal representatives, and assigns, and in consideration for the Participant being allowed to take part in the Activity, as defined below, I make the following representations.

If I am the Participant and 18 years of age or older, I make these representations for myself.

  1. Assumption of Risks: I agree and understand that participation in the Organizations’ trainings, workouts, use of equipment, gym equipment and facilities, practices, competitions, games and related travel, events, and activities (collectively, the “Activity”) is entirely voluntary and that participation in the Activity involves risks of injury due to inherent dangers that cannot be eliminated regardless of the care taken to avoid them. These injuries include, but are not limited to, those caused by: athletic exertion; physical contact with other individuals; contact with the ground, surfaces, fixtures, equipment, and strenuous activity, quick movements, lifting, pulling, or pushing of equipment, and changes of speed all of which place a stress on the cardiovascular, muscular, and skeletal systems. The specific injury risks vary from (1) minor injuries such as scratches, bruises, strains, and sprains, to (2) major injuries such as torn muscles, broken bones, dislocation of joints, eye injuries, joint injuries, back injuries, heart attacks, and concussions, to (3) catastrophic injuries including coma, brain damage, paralysis, disability, and death. I agree on behalf of the Participant assumes these risks. I understand that if I or the Participant have any questions about possible hazards, it is our responsibilities to seek additional information from the Organization prior to signing this Agreement. I also understand that, despite safety precautions, the Organization cannot guarantee the Participant will not be injured or harmed.
  2. Waiver, Release and Authorization: I hereby release, waive, and discharge, hold harmless, indemnify, and defend the Organization, as well as their perspective parent companies, subsidiaries, affiliated companies, owners, directors, officers, employees, staff, volunteers, officials, agents, sponsors, representatives, and the owners or lessors of the premises used for the Activity (collectively the “Releasees”) from any and all liability, losses, damages, claims, actions, and cause of action of every nature, whether claimed by Participant, myself, Participant’s family and assigns, or any third party, for any and all known or unknown, foreseen or unforeseen, bodily or personal injuries, property damage, or any other loss or damages relating in any way to the Participant’s involvement in the Activity, including but not limited to associated travel.
  3. Medical Release and Authorization: I am unaware of any significant health issue or restriction that would affect the Participant’s involvement in the Activity. The Participant has had a recent medical evaluation and is fully fit for the Activity. In the event of an emergency, I authorize the Organizations to act for me in their best judgement in rendering any medical attention to the Participant. I further understand that I will be responsible for any medical expenses relating to the Participant’s involvement in the Activity. Furthermore, I release and forever discharge and hold harmless the Organizations and the Releasees from all liability, claims and damages arising from any first aid, treatment, or medical service rendered to Participant in connection with Participant’s participation in the Activity.
  4. Insurance: I understand that none of the Organizations nor the Releasees provide, assume any responsibility for, or have any obligation to provide, insurance, financial assistance or other assistance including, but not limited to, health or disability insurance for Participant’s recovery of losses, costs, or damages in the event of personal injury, illness, death or property damage in any way connected to the Activity. I understand that the Organizations and Releasees do not maintain health or disability insurance coverage for Participants and that Participant is expected and encouraged to maintain Participant’s own coverages.
  5. Compliance with Instruction and Observation of Risks: I will direct the Participant to follow all instructions and guidelines provided by the Organizations’ coaches, staff, employees, volunteers, and personnel during the Activity. I also understand the Participant is fully responsible for complying with any stated or customary terms and conditions for participation in the Activity. If, however, Participant observes any unusually significant hazard during Participant’s presence at or participation in the Activity, or if Participant observes any concern in his/her readiness for participation in the Activity, Participant will immediately bring such matters to the attention of the nearest Organizations representative and remove him/herself from participation in the Activity.
  6. Media Release: I understand that the Organizations may take photographs, film footage, digital content, and capture other electronic media as part of the Activity, some of which may contain the name, image, likeliness or voice of the Participant. I grant permission to the Organization to use this media for its educational, athletic, marketing, and promotional purposes and understand that neither the Participant nor his/her family will be financially remunerated for this media usage.
  7. Authorization: I herby permit Participant to take part in the Activity.

By signing below, I represent that I have read, understand and agree to the terms outlined above. I understand that by signing this document, I am waiving certain legal rights, and do so voluntarily.
