Outdoor Rock Climbing Liability Waiver & Assumption of Risk Agreement

1. Acknowledgment of Risks

I, the undersigned participant, understand that outdoor rock climbing, rappelling and related activities involve inherent and significant risks that may result in injury, illness, permanent disability, or death. These risks include, but are not limited to:

  • Falling from height
  • Falling rocks, equipment, or debris
  • Rope burns, abrasions, and impacts
  • Weather changes, lightning, and environmental hazards
  • Extreme heat or cold which may result in heat stroke, heat exhaustion and or frost bite and lesser related injuries.
  • Dangers related to plants, animals and insects which may include bites, stings etc.
  • Dangers related to being in remote locations where there are not medical services
  • Equipment failure or misuse
  • Physical strain or exertion
  • Injuries to hands, fingers, feet and toes, including but not limited to inflammation and/or strain of muscles, ligaments and or tendons, nerve damage or compression and broken bones
  • Injuries that may result of high altitude which may effect judgment and coordination
  • Human error by myself, guides, or others
  • Dangers related to walking on uneven terrain
  • Participant's own negligence, lack or judgment, balance, coordination or failure to follow instructions

I “Participant”the undersigned individual, desire to use the service of Mountain Goat Climbing Guides, LLC (“MGCG”) to participate in rock climbing, rappelling and related activities guided by MGCG, fully understanding the risks involved and in consideration thereof, voluntarily signing the forgoing waiver, warranting that I am a competent adult 18 years of age or older, or a minor accompanied by a competent adult.

Participant represents that they are in good health and proper physical condition to engage in rock climbing and related activities. Participant understands that they should not engage in activities that could be detrimental to their health or which would be against their physician's advice due to recent illness, injury or surgery. Participant acknowledges that they have adequate insurance to cover the cost of any injury sustained as a result of their participation in rock climbing, rappelling and related activities.

Participant understands that rock climbing, rappelling and related activities require sufficient physical stamina and conditioning as they are strenuous activities. Participant represents that they are in good health and proper physical condition to engage in rock climbing, rappelling and related activities. Participant represents that they understand people who have medical, mental or other physical conditions which might impair their ability to engage in rock climbing, rappelling and related activities should not do so.

Participant acknowledges that professional instruction does not eliminate all the risks associated with rock climbing, rappelling and associated activities.

2. Assumption of Responsibility

Participant understands that the above risks are not an exhaustive list of risks inherent to rock climbing, rappelling and related activities offered by MGCG. Participant acknowledges that additional unknown and unanticipated risks may arise from engaging in said activities and that these risks may result in injury, illness or death of Participant. Participant expressly agrees to accept and assume responsibility for all such risks and all responsibility for injuries, losses, (whether to persons or property), costs and damages Participant may incur from engaging in rock climbing, rappelling and related activities. Despite the inherent risks involved, Participant willingly chooses to engage in the services offered by MGCG and HEREBY AGREES to hold MGCG and its employees, agents etc harmless for any losses they may incur.

3. Medical Fitness & Consent

I certify that:

  • I am physically capable of participating in rock climbing, rappelling and related activities. 
  • I have disclosed all medical conditions that might affect my safety.
  • I authorize MGCG guides to provide or obtain emergency medical care if necessary. I agree to pay any associated medical or evacuation costs.

4. Equipment Responsibility

I agree to use all climbing gear—whether personal or provided—properly and as instructed. I am responsible for reporting equipment defects or concerns immediately.

I understand that wearing a helmet does not eliminate the dangers associated with climbing but that in certain instances a helmet can reduce the risk of permanent brain damage or other serious injury. I am also aware that it is my responsibility to use the helmet provided and or to ensure that my minor child does so as per instruction given and or manufacturers specifications. I acknowledge that if I am an adult and choose for myself and or my minor child not to wear a helmet or enforce this instruction, then I do so against the advice of MGCG and its employees, agents etc and assume all the associated risks thereof.

I further agree to hold MGCG and or its employees and agents harmless for any injury I may sustain as a result of choosing to use my own equipment including but not limited to helmet, harness, Carabiners, shoes and belay/rappel devices. 

5. Release of Liability

By signing below, Participant releases, discharges and covenants not to bring any lawsuit or claim against MGCG, its affiliates, successors, or assigns and if applicable, owners and lessors of the premises or grounds on which activities occur. Participant agrees to hold harmless, indemnify and release from liability, claims or demands for injuries, losses or death caused or alleged to be caused to person or property, in whole or in part by Participant's participation in the activities or negligence of MGCG and or its employee, agents etc.

If signing on behalf of a minor, adult signatory releases, discharges and covenants not to bring any lawsuit or claim against MGCG, its affiliates, successors, or assigns and if applicable, owners and lessors of the premises or grounds on which activities occur. Participant agrees to hold harmless, indemnify and release from liability, claims or demands for injuries, losses or death caused or alleged to be caused to person or property, in whole or in part by Participant's participation in the activities or negligence of MGCG and or its employee, agents etc.

6. Photography & Media Release

I grant MGCG permission to use photographs or videos of me for promotional or educational purposes, without compensation.

7. Parent/Guardian Consent (For Participants Under 18)

I, the parent/guardian of the above minor, consent to their participation. I accept and agree to all terms of this liability waiver on their behalf.

8. Governing Law & Severability

This agreement is governed by the laws of the state where the activity takes place. If any part of this agreement is found unenforceable, the remaining sections shall remain in full effect.

Participant Signature

By signing below, I acknowledge that I have carefully read this document, understand its contents, and sign it voluntarily without any inducements or assurances and intend this Agreement to be a complete and unconditional release of all liability to the greatest extent allowed by law and agree further that, if any portion of this Agreement is held invalid, the balance shall continue in full force and effect.
