WHEREAS, in consideration of being permitted to attend a course for instruction in firearms, for use of premises, and for other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, Undersigned agrees to the following:
Undersigned agrees to indemnify, hold harmless, and defend LIONESS DEFENSE FIREARMS TRAINING LLC AND ITS INSTRUCTORS, TRAINING COUNSELORS, AND RANGE SAFETY OFFICERS (hereinafter referred to as “Instructor(s)”) from any and all fault, liabilities, costs, expenses, claims, and demands or lawsuits arising out of, related to or connected with Undersigned’s presence at and/or participation in the course of instruction; the discharge of firearms by Undersigned, Undersigned’s presence on or use of the range, building, land, and premises (“Premises”); and, any and all acts or omissions of.
Undersigned furthermore waives for himself/herself and for his/her executors, personal representative, administrators, assignees, heirs, and next of kin; any and all rights and claims for damages, losses, demands, and any other actions or claims whatsoever, which h he/she may have or which may rise against Instructor (including, but not limited to the death of Undersigned and/or any and all injuries, damages, or illnesses suffered by Undersigned or Undersigned’s property,) which may, in any way, whatsoever, arise out of, be related to, or be connected with; the course of instruction; the Premises, including anf latent defect in the Premises; Undersigned’s presence on or use of said Premises; Undersigned’s property (whether or not entrusted to Instructor); and the discharge of firearms. The instructor shall not be held liable for, and undersigned, on behalf of himself/herself and on behalf of his/her executors, personal representative, administrators, assignees, heirs, and next of kin, hereby expressly releases the instructor from any and all such claims and liabilities.
Undersigned hereby expressly assumes the risk of taking part in the course for instruction in firearms and taking part in the activities on the Premises, which include, but are not limited to, instruction in the use of firearms, the discharge of firearms and the firing of live ammunition.
I understand that at this event or related activities, I may be photographed. I agree to allow my photo, video, or film likeness to be used for any legitimate purpose by the event holders.
Undersigned hereby acknowledges and agrees that undersigned has read this instrument and understands its terms and is executing this instrument voluntarily. Undersigned furthermore hereby acknowledges and agrees that he/she has read, understands, and will at all times satisfy the provisions of all range rules and procedures and other rules and procedures stated by the instructor.
Undersigned expressly agrees that this instrument is intended to be broad and inclusive as permitted by law, and that if any provision of this instrument is held invalid or otherwise unenforceable, the enforceability of the remaining provisions shall not be impaired thereby. No remedy conferred by any of the specific provisions of this Instrument is intended to be exclusive of any other remedy, and each and every remedy shall be cumulative and shall be in addition to every other remedy no or hereafter existing at law or in equity or by statute or otherwise. The election of anyone or more remedy hereunder by the instructor shall not constitute any waiver or instructor’s right to pursue other available remedies. This instrument binds undersigned and his/her executors, personal representative, administrators, assignees, heirs and next of kin.
I agree to maintain compliance with all U.S. Laws and regulations, including but not limited to, the Alcohol, Tobacco and Firearms Regulations, The Arms Export Control Act, and The International Traffic in Arms Regulations (ITAR). I understand this activity is covered under the U.S. Department of State Regulations and will treat the course materials and training as such. I understand that, under Part 127.3 of the ITAR, I can be subject to fine or imprisonment if I am convicted of willful violation of any provision of Section 38 or 39 of the Arms Export Control Act (AECA).
I HAVE READ THIS WAIVER AND RELEASE CAREFULLY AND HAVING DONE SO I AM SIGNING IT VOLUNTARILY.
FIREARMS STUDENT CANDIDATE FORM
The use of firearms is an exciting and safe sport, provided that common sense rules are followed. The instructor has distilled the approximately ten safety rules into four basic ones that I will MEMORIZE before being allowed to participate in live-fire range exercises. If the following rules are obeyed, all participants will have a safe and pleasurable experience. Inversely, if they are not, injury or death can result. I will read, understand, and commit to memory the following rules. I will obey them at ALL TIMES. I understand that failure to obey any of these rules can result in my immediate expulsion from the class and the range.
I will repeat the rules underneath the printed version in my own handwriting to show that I understand, and will memorize and obey them.
- I will ALWAYS keep the firearm pointed in a safe direction.
- I will ALWAYS keep my finger off the trigger until ready to shoot.
- I will ALWAYS keep the firearm unloaded until ready to use.
- I will ALWAYS know my target and what is beyond.
While on the range, I will obey these rules. Also, I will immediately notify the offending party and the instructor and/or range safety officer if I observe any of these rules being broken by anyone at any time. If there is any confusion about the rules or anything else, I will immediately stop what I am doing, take my finger off the trigger, point my firearm downrange, and raise my hand to ask the instructor’s help.
I understand that the discharge of firearms releases lead, the buildup of which can cause health problems, I will WASH MY HANDS, FACE, and CLOTHES as soon after discharging firearms as is practical, particularly before eating or drinking. If I am pregnant, I will not participate in any live-fire range activities for the same reasons.
