THIS IS A RELEASE OF LIABILITY AND SEVERELY OR COMPLETELY LIMITS LEGAL RIGHTS AND THE ABILITY TO BRING A LAWSUIT OR SEEK COMPENSATION FOR INJURIES AND DAMAGES. By signing this document, I, on behalf of myself and any minors in my care or under my supervision, agree and acknowledge: - I am releasing Art Guttersen, LLC; Double Check Arena, LLC; and all of their agents, employees, principals, officers, members, and organizations, (collectively the “Released Parties”) who own and/or operate the equine arena that I intend to utilize.
- This document is intended to release the Released Parties of any legal liability for any injury and any claim and is intended to provide greater protection to the Released Parties than provided in Colorado Revised Statute § 13-21-119.
- As lawful consideration for being permitted on the premises, using the premises, and using any horse, animal, or equine in, on, or around the premises, I release the Released Parties from any and all legal liability Released Parties may have for any injury, damages, or death caused by my participation in the activities described below or my presence on the premises. I also agree not sue to the Released Parties, agree not to assert claims against the Released Parties, and agree not to attach the property of the Released Parties.
- I understand that by signing this document, I am releasing the Released Parties from all negligence Released Parties may commit during my participation in equine activities and all negligence of the Released Parties that may occur while I am on the premises.
- I understand that an animal irrespective of its training and usual past behavior and characteristics, may act or react unpredictably at times based upon instinct or fright which likewise is an inherent risk to be assumed by each participant in the activity, and I will be participating in equine activities and that inherent and other risks of such activities include a substantial risk of severe injury, including but not limited severe head injuries, broken bones, cuts, paralysis, torn ligaments, and permanent disfigurement. I also understand that equine activities involve a substantial risk of death. Despite these risks, I am voluntarily participating in equine activities and is doing so at my own risk and am releasing the Released Parties from any and all claims I may have arising out of or related to my participation in equine activities and my presence on the premises while equine activities are taking place.
- I understand and acknowledge that the Released Parties are not providing any equipment to me, that I must furnish all of his/her/their own equipment, including but not limited to all tack, saddles, safety equipment, helmets, and bridles. I understand and acknowledge the Released Parties are not providing any instruction, guidance, or supervision during my presence on the premises or my participation in any activities, including equine activities, while on the premises and that I must provide my own instructors, guides, or supervisors.
- I understand that despite the Released Parties’ efforts, maintenance, and work, the premises and any physical object I encounter on the premises, including, but not limited to fences, posts, seats, barrels, buildings, walls, and fixtures, may break, fail, or may cause me injury. I am nonetheless releasing and waiving any claims, even claims of negligence or claims under the Premises Liability Act (Colorado Revised Statute § 13-21-115), I may have against Released Parties for any injuries or damages I may suffer while on the premises caused by an issue, danger, or problem with the premises or physical objects on the premises.
- I have carefully read this document, understand it, and agree to be bound by its terms.
